File Note: Background It is submitted that the industry was granted consent to establish under the provisions of the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2024/27497588 dated 12.12.2024, valid till 11.12.2025 under green category for an area 2.29 acre. Raw Material Iron And Steel @ 2 MTD Product Sheet Metal Fabrication @ 2 MTD Complaint A complaint had been published in newspaper regarding disposal of wastewater by the industry on the main road. Visit – 20.11.2025 To verify the facts of complaint the industry was visited by the officer of the Board on 20.11.2025 and during visit it was observed as under: 1. The industry was in operation and engaged in manufacturing of Rail coach components in one shed. The industry was in process of erection of new shed. The representative of the industry informed that the total site of the industry is in 7 acres and the site is in operation since 2022. 2. The industry involved sheet metal cutting, welding and painting in the unit. 3. The industry has provided DG set of capacity of 260 KVA with canopy, with adequate stack height. 4. The industry has provided STP for treatment of domestic effluent. However, physical condition of the same reveals that the same is not in operation since long. 5. The wastewater from the labour section was found accumulated in the shape of ponds in untreated form. 6. The representative of the industry informed that due to leakages while digging the new tubewell inside its premises. The water was gets discharged onto the road. 7. The project proponent has not obtained Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 from the Board. Show Cause Notice The industry was issued show cause notice for the violations of the provisions of Air (Prevention & Control of Pollution) Act, 1981 vide letter no. 4711 dated 26.11.2025 with an opportunity of personal hearing on 12.12.2025 before undersigned. However, the said hearing was postponed due to administrative reasons and another opportunity of personal hearing was given to the industry on 15.12.2025 before the Environmental Engineer, Regional Office, SAS Nagar. Decision of personal hearing held on 15.12.2025 After hearing the Environmental Engineer decided as under :- 1. The project proponent shall submit bank guarantee amounting to Rs. 1,00,000/- as an assurance to comply with the provisions of the Environmental Laws, within 7-days in the name of Environmental Engineer, PPCB, Regional Office, SAS Nagar. 2. The industry shall apply for obtaining Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 7 days, failing which further action against the industry under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 will be taken. 3. It was made clear to the industry in case the industry again found non-complying with the provisions of the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 strict action shall be initiated against the unit. 4. Assistant Environmental Engineer shall visit the industry after 7 days to verify the contentions made by the industry during the hearing. Bank Guarantee The project proponent has deposited bank guarantee amounting to Rs. 1 lakh vide bearing no. 1944IBG158764 dated 07.02.2026, valid till 06.02.2027. Present Status Now, the project proponent has applied fresh consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under green category. Raw Material Iron And Steel @ 2 MTD Product Sheet Metal Fabrication @ 2 MTD Fee Details The project proponent has submitted CA certificate with the value of fixed assets of Rs. 4.98 crore. The project proponent has deposited Rs. 12000/- vide R no. 602474463 dated 03.01.2026 under Air Act, 1981 and Rs. 84000/- vide R no. 707302392 dated 13.01.2026 under Water Act, 1974. After deduction of late fee, the consent fee under the Water Act, 1974 and under the Air Act, 1981 is adequate till 31.12.2030. Site Suitability  Change of Land Use vide no. PBIP/CAPA(HUD)/2020/71 dated 11.03.2020 issued by Competent Authority Project Approval Housing & Urban Development Department o Khasra no. 76, 81/2 and 82/2 (11 Bigha Or 2.29 acres) o Manufacturing of railway parts o The site falls under the FEZ zone.  Change of Land Use vide no. PBIP/STP(HUD)/2021/367 dated 19.08.2021 issued by Senior Town Planner, Housing & Urban Development Department o Khasra no. 73/1, 73/2, 74 and 75 (10 Bigha- 3 Biswa Or 2.114 acres) o Manufacturing of railway parts o The site falls under the FEZ zone. Site Plan The project proponent has submitted approved site plan from the Competent person approved under Factory Act. Visit 1. The industry was in operation and engaged in manufacturing of Rail coach components in one shed. The site of the industry is located in an area of about 4.4 acres. The industry has separated the additional land of about 2.5 acres adjacent to the site of the industry, the said site is lying vacant. 2. The industry involved sheet metal cutting, welding and painting in the unit. 3. The industry has provided DG set of capacity of 260 KVA with canopy, with adequate stack height. 4. The industry has removed stagnation from the labour section. The industry has provided STP for treatment of domestic effluent and same was in operational condition. The industry has developed plantation along the boundary to contain treated wastewater of STP. 5. No treated/ untreated wastewater was found accumulated in the industrial premises or outside the unit. 6. The industry is located in FEZ zone and CLU for the manufacturing of railway parts has been obtained by the industry. As such the site is suitable for the establishment/ operation. Recommendations In view of above, it is recommended that consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2030 with suitable and additional conditions as under: 1. The industry shall not add adjacent land of about 2.5 acres to the industrial premises without obtaining consent to establish/ operate from the Board. 2. The industry shall not carry out any activity in its premises, which is covered under Red/Orange category, without obtaining prior written permission from the Board. 3. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances. 4. The industry shall not use any fuel in its premises except HSD for operation of DG set without prior permission of the Board. 5. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 6. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 7. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. *Competency – Environmental Engineer
