It is submitted that the proposed subject cited unit is small scale orange category rice sheller unit and was earlier granted Consent to Establish vide no. CTE/Fresh/MOG/2017/5965583 dated 20.07.2017 for the site, measuring 16 Kanals bearing Khasra No. 4//14(8-0), 15/1(5-12), 15/2(1-4), 13/1(1-4) Village Chuhar Singh Wala, Distt. Moga.
Thereafter, the rice sheller was granted consent to operate under the Water Act, 1974 & Air Act, 1981 vide no. CTOW/Fresh/MOG/2018/6867476 dated 22.02.2018 and vide no. CTOA/Fresh/MOG/2018/6867452 dated 22.02.2018 respectively, both were valid upto 30.09.2022 for the production of SORTEX RICE @ 5 TPH RAW RICE WITH DRIER @ 5 TPH by using PADDY @ 7.5 TPH UNSORTED RICE @ 5 TPH. The same has been renewed vide no. CTOW/Renewal/MOG/2022/19285623 dated 17.07.2022 and CTOA/Renewal/MOG/2022/19285421 dated 17.07.2022 both are valid upto 30.09.2027.
Now the project proponent has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 under green category for production of SORTEX RICE @ 9 TPH RAW RICE WITH DRIER @ 9 TPH by using PADDY @ 13.5 TPH UNSORTED RICE @ 9 TPH by addition of land area @ 41 Kanal 06 marla, bearing khasra no. 4//6/1/2(1-2), 6/2/2(0-5), 7/1/2(0- 9), 7/2/2(1-2), 8(0-19), 13/1(2-0), 13/2(3-4), 4//7/2/1(3-7), 6/2/1(0-16), 43//12(7-16), 13(1-13). 19(2-13), 2(8-0) and 9(8-0). The total land area of the 57 Kanals 06 Marla. The details of the case is as under:
• The PP has submitted CA certificate vide dated 25.02.2026 showing fixed assets Rs. 170.45 lakhs (including plant & machinery of Rs. 93.13 lakhs). …………….
• The industry has deposited Rs. 32000/- vide UTR No. 348112874 dated 25.02.2026 under the Water Act, 1974 and Rs 34200/- (including Rs. 2200/- as NOC Regularization fee) vide UTR No. 584647640 dated 25.02.2026 the Air Act, 1981, which is adequate for a period upto 30.09.2032 under both the Acts..…………………
• The PP has submitted a copy of report regarding siting guidelines countersigned by Naib Tehsildar, Kot Ise Khan dated 29.01.2026, the relevant part of which is reproduced as under:
ਸਾਈਟ ਅਧੀਨ ਰਕਬਾ ਪਿੰਡ ਦੀ ਫਿਰਨੀ/ਲਾਲ ਲਕੀਰ/ਸਕੂਲ ਕਾਲਜ/ਵਿਦਿਅਕ ਅਦਾਰੇ/ਗੁਰਦਵਾਰਾ/ਮੰਦਰ/ਧਾਰਮਿਕ ਸੰਸਥਾਵਾ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਨਹੀਂ ਆਉਂਦੇ ਹਨ। ਸਾਈਟ ਅਧੀਨ ਰਕਬਾ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਵੀ ਅਪਰੂਵਡ ਘਰ ਨਹੀਂ ਆਉਂਦਾ ਹੈ। ਜੋ ਕਿ ਕਿਸੇ ਵੀ ਸੰਸਥਾ ਤੋਂ ਅਪਰੂਵਡ ਹੋਵੇ। ਸਾਈਟ ਅਧੀਨ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਵੀ ਚਿੜਿਆਘਰ, ਵਿਲਡ ਲਾਈਫ ਸੈਂਚੂਰੀ ਅਤੇ ਪਰੋਟੈਕਟ਼ ਮੂਮੈਂਟਸ ਨਹੀਂ ਅਉੰਦੇ ਹਨ।
• The PP has submitted copy of letter issued by District Town Planner, Moga vide no. 180 dated 20.02.2026, relevant part of which is reproduced as under:
ਸਾਈਟ ਪਿੰਡ ਜਨੇਰ ਤੋਂ ਪਿੰਡ ਚੀਮਾਂ ਨੂੰ ਜਾਂਦੀ 6. ਕਰਮ (33-0") ਚੌੜੀ ਲਿੰਕ ਸੜਕ ਤੇ ਪਿੰਡ ਰਾਜੀਵਾਲਾ ਨੂੰ ਸੜਕ ਤੋਂ ਲਗਭਗ । ਕਿਲੋਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਖੱਬੇ ਹੱਥ ਪੈਂਦੇ ਰਾਈਸ ਸ਼ੈਲਰ ਮੈਸ:ਸ਼ਿਵ ਰਾਈਸ ਮਿੱਲਜ਼ ਦੇ ਵਿੱਚ ਵਾਧੇ ਅਧੀਨ ਹੈ। ਪਹਿਲਾਂ ਪ੍ਰਵਾਨਤ ਸਾਈਟ ਅਧੀਨ ਰਕਬਾ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ, ਮੋਗਾ ਦੀਆਂ ਤਜਵੀਜਾਂ ਅਨੁਸਾਰ ਖੇਤੀਬਾੜੀ ਜ਼ੋਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ ਅਤੇ ਵਾਧੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਰਕਬਾ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਕੋਟ ਈਸੇ ਖਾਂ ਵਿੱਚ ਪੈਂਦਾ ਹੈ। ਸਾਈਟ ਵਿੱਚ ਪਹਿਲਾਂ ਤੋਂ ਚੱਲ ਰਹੇ ਰਾਈਸ ਸ਼ੈਲਰ ਰਕਬਾ 16 ਕਨਾਲ 0 ਮਰਲੇ ਸਬੰਧੀ ਡਾਇਰੈਕਟਰ ਆਫ ਫੈਕਟਰੀਜ਼ ਵੱਲੋਂ ਪੱਤਰ ਨੰ: 9423, ਮਿਤੀ 13-09-2017 (ਕਾਪੀ ਨੱਥੀ) ਰਾਹੀਂ ਬਿਲਡਿੰਗ ਪਲੈਨ ਪਾਸ ਕੀਤੇ ਗਏ ਹਨ। ਹੁਣ ਸਾਈਟ ਵਿੱਚ 41 ਕਨਾਲ 06 ਮਰਲੇ ਰਕਬੇ ਦਾ ਵਾਧਾ ਕੀਤਾ ਜਾਣਾ ਹੈ, ਜਿਸ ਸਬੰਧੀ ਹਲਕਾ ਪਟਵਾਰੀ ਅਤੇ ਨਾਇਬ ਤਹਿਸੀਲਦਾਰ, ਕੋਟ ਈਸੇ ਖਾਂ ਵੱਲੋਂ ਤਸਦੀਕਸੁਦਾ ਨੁਕਤਾਵਾਈਜ਼ ਰੈਵੀਨਿਊ ਰਿਪੋਰਟ ਮਿਤੀ 24-12-2025 ਦੇ ਨੁਕਤਾ ਨੰ:2 ਅਨੁਸਾਰ ਪਿੰਡ ਚੂਹੜ ਸਿੰਘ ਵਾਲਾ, ਤਹਿਸੀਲ ਧਰਮੋਕਟ, ਜਿਲ੍ਹਾ ਮੋਗਾ ਦੀ ਰੈਵੇਨਿਊ ਅਸਟੇਟ ਦੇ ਖਸਰਾ ਨੰ: 4/6/1/2(1-2), 6/2/2(0-5), 7/1/2(0- 9). 7/2/2(1-2), 8(0-19), 13/1(2-0), 13/2(3-4), 4//7/2/1(3-7), 6/2/1(0-16), 43//12(7-16), 13(1-13), 19(2-13), 2(8-0) ਅਤੇ 9(8-0) ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਦੀ ਮਾਲਕੀ ਅਤੇ ਕਬਜੇ ਸਬੰਧੀ ਨਿਰੋਲ ਜਿੰਮੇਵਾਰੀ ਪ੍ਰਾਰਥੀ/ਫਰਮ ਦੀ ਹੋਵੇਗੀ। Government Of Punjab, Department Of Science, Technology & Environment ਵੱਲੋਂ ਜਾਰੀ Order 8. 10/48/2004 STE(4)932 Dated 15.10.2013 ਅਤੇ ਨੋਟੀਫਿਕੇਸਨ ਨੰ. 10/200/2020/STE(5)/223516, Dated 05.08.2021 ਅਨੁਸਰਾ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ/ਰਕਬੇ ਸਬੰਧੀ ਇਸ ਦਫ਼ਤਰ ਨਾਲ ਸਬੰਧਤ ਨੁਕਤਿਆਂ ਦੀ ਰਿਪੋਰਟ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਹੈ :-
i. ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਕਿਸੇ ਵੀ ਫੋਕਲ ਪੁਆਂਇੰਟ ਅਤੇ ਡੈਜੀਗਨੇਟਡ ਇੰਡਸਟਰੀਅਲ ਜੋਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ।
ii. ਪਹਿਲਾਂ ਪ੍ਰਵਾਨਤ ਸਾਈਟ ਅਧੀਨ ਰਕਬਾ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ, ਮੰਗਾ ਦੀਆਂ ਤਜਵੀਜਾਂ ਅਨੁਸਾਰ ਖੇਤੀਬਾੜੀ ਜ਼ੋਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ ਅਤੇ ਵਾਧੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਰਕਬਾ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਕੋਟ ਈਸੇ ਖਾਂ ਵਿੱਚ ਪੈਂਦਾ ਹੈ। ਸਾਈਟ ਕਿਸੇ ਵੀ ਪ੍ਰਵਾਨਤ ਮਾਸਟਰ ਪਲੈਨ ਦੀ Urbanisable Limit ਦੀ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ। ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦੇ 2 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕਿਸੇ ਸ਼ਹਿਰ ਦੀ Local Body Limit ਨਹੀਂ ਪੈਂਦੀ।
iii. ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਬਾਈਪਾਸ/ਨੈਸ਼ਨਲ ਹਾਈਵੇ/ਸਟੇਟ ਹਾਈਵੇ ਅਤੇ ਸ਼ਡਿਊਲਡ ਰੋਡ ਨਹੀਂ ਪੈਂਦੀ ਹੈ।
To verify the facts the site of the industry was visited by undersigned on 27.02.2026 and it was observed as under:-
1. The industry was not in operation as per its requirement.
2. The industry has installed cyclones as APCDs with paddy cleaner of dryer section and shelling section, separately, to contain the process emissions and the same were found in line / operational conditions with dust emitting points connected to the APCDs.
3. The industry has provided stacks of adequate height with the APCDs and provisions to facilitate emission sampling. APCDs installed by the industry are adequate in principle.
4. The industry has provided brick wall of adequate length with 10' height around husk discharge / storage area and further mesh wire of 5' height has been provided above the said wall in compliance to code of practice prescribed by the Govt. vide order dt. 15.10.2013.
5. The industry has provided brick paving at movement area of vehicles, within its premises.
6. The industry has provided septic tank for treatment of domestic effluent and has made provision to discharge onto land for irrigation/plantation.
7. The industry has provided plantation along its boundary wall.
8. The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013
Keeping in the view of above, it is recommended that varied consent to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the industry for production of SORTEX RICE @ 9 TPH RAW RICE WITH DRIER @ 9 TPH by using PADDY @ 13.5 TPH UNSORTED RICE @ 9 TPH by addition of land area @ 41 Kanal 06 marla, bearing khasra no. 4//6/1/2(1-2), 6/2/2(0-5), 7/1/2(0- 9), 7/2/2(1-2), 8(0-19), 13/1(2-0), 13/2(3-4), 4//7/2/1(3-7), 6/2/1(0-16), 43//12(7-16), 13(1-13). 19(2-13), 2(8-0) and 9(8-0). The total land area of the 57 Kanals 06 Marla for a period upto 30.09.2032, subject to the suitable conditions:………………..
i. The industry will discharge only treated domestic effluent onto land for plantation / green belt…………….
ii. The industry shall not increase its existing land area without prior permission of the Board. …………………
iii. The industry shall always comply with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013
iv. The industry shall not increase its production capacity without the prior written permission/NOC of the Board………………
v. The industry will obtain permission from Concerned Authority for abstraction of ground water………………………
vi. The industry shall comply with zoning regulations of Master Plan ………………
