It is submitted that the industry is small scale red category unit.
Earlier the industry was granted consent to operate under the Water Act,1974 vide no. CTOW/Fresh/LDH4/2023/23587677 dated 28.09.2023 valid upto 30.06.2028 and under the Air Act vide no. CTOA/Fresh/LDH4/2023/22063146 dated 14.08.2023 valid upto 30.06.2028 for MANUFACTURING OF BICYCLE PARTS ( FREE WHEELS) @ 8000 Numbers/Day MANUFACTURING OF BICYCLE PARTS ( CHAIN) @ 5000 Numbers/Day MANUFACTURING OF BICYCLE PARTS ( HUB) @ 6000 Numbers/Day MANUFACTURING OF BICYCLE PARTS ( CHAIN WHEELS) @ 600 Numbers/Day MANUFACTURING OF BICYCLE PARTS( RIM) @ 1000 Numbers/Day.
A list was received from JBR regarding effluent overlifting and non-lifting by various industries. It was found that this industry has an agreement for 10,000 Liters with JBR but is regularly lifting approx. 12,000 litres. The industry was visited by officer of the Board on 03.11.2025 and it was observed as under. 1. The industry was in operation during visit. 2. The industry was engaged in process of Powder Coating, Phosphating and Pickling. 3. The industry has installed 04 Phosphating tanks, 03 Rotary furnace (02 LPG based & 01 Electric), 05 Polish Barrels, 02 Powder Coating Booth, 01 Electric Oven. 4. The industry is also engaged in cleaning iron rods using an acid solution and oil in plastic drums. 5. It was observed that the effluent generated from this process is being discharged directly onto the main road without any treatment, and the effluent was found to be highly acidic. 6. The condition of the water meter was found to be very poor, and the readings were not legible. 7. The records provided by the industry were found to be unsatisfactory, as the JBR slips for the month of September were not submitted. It was also observed that the industry is lifting approximately 12,000 liters of effluent, whereas the agreement with JBR is limited to 10,000 liters. The industry is violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The matter was considered by the Competent Authority of the Board and it was decided to issue Show cause notice for revocation of consent to operate under the Water Act,1974 and notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 before confirming the following directions after affording an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana proposing to confirm directions for closure of unit and electric disconnection. Accordingly, Show cause notice for revocation of consent to operate under the Water Act,1974 and notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 was issued to the industry with an opportunity of personal hearing before the Chief Environment Engineer, Ludhiana on 10.12.2025. Sh. Amit Raheja, Partner on behalf of the industry attended the hearing and submitted a written reply which was taken on record. He stated that the industry was in operation during the officer's visit and is engaged in process of Powder Coating, Phosphating and pickling. The industry has installed 04 Phosphating tanks, Rotary Furnace (02 LPG Based & 01 electric,) 05 Polish Barrels, 02 Powder Coating Booth, 01 Electric Oven. Cleaning iron rods using acid solution and oil in plastic Drums is not part of the routine process, the sample rod was washed only during that specific instance. The industry refused to accept the visiting officer’s observation that the effluent generated from this process is being discharged directly onto the main road without any treatment and the effluent was found to be highly acidic, as no such activity is carried out by the industry. The water meter at premises is well-maintained, clean, and fully readable. Approx. 10,000 liters of water lifted to JBR as per annual record, if some extra lifted from the industry’s limit just because some trade effluent was stored in collection tank. The industry has provided 13000 Ltrs storage tank for collection of trade effluent. The industry is complying with all norms & regularly lifting all trade effluent to CETP as per guidelines by PPCB. Senior Environmental Engineer, Zonal Office-2, Ludhiana informed that the industry has already submitted bank guarantee of Rs. 02 lakhs as an assurance to comply with all environmental laws, valid upto 08.08.2026. After hearing the partner of the industry and officers of the Board and considering the material facts of the case, the Chief Environment Engineer, Ludhiana decided as under: - 1. The industry shall make revised agreement with CETP operator, as per the actual generation of effluent and submit the same to the Board, within 15 days. 2. The industry shall increase the capacity of effluent collection tank or install additional storage in its premises, within 15 days, so as to have sufficient storage for collection of effluent and ensure that no overflow shall take place from the storage tanks even in case of non-periodic lifting of trade effluent by the CETP operator due to unavoidable reason. 3. The industry shall prepare a revised lifting schedule (atleast on weekly basis) with the CETP operator and to ensure that adequate lifting shall be made in a month. 4. The industry shall install CCTV cameras with 30 days backup within 15 days, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks d) any other suitable point deemed fit to ensure that whole of the water consumed is metered and whole of the trade effluent is lifted to CETP operator The industry shall maintain in-house monitoring mechanism through mobile phone/ office screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed. 5. The industry shall ensure that there is no unauthorized mode of wastewater disposal. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. 6. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. 7. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law. 8. The industry shall apply for revised consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 as per revised lifting agreement carried out with CETP operator, within 15 days. 9. For the non-compliances and violations observed during the visit of the officer of the Board, an amount of Rs. 01 lakh be enchased from earlier submitted bank guarantee of Rs. 02 lakhs. 10. The Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry within 15 days to verify contentions of the industry, carry out audit of the waste water generation, submit compliances with respect to the decisions alongwith fresh recommendations and process consent applications on merit.
Now the industry has applied for varied consent to operate under the Water Act, 1974 through OCMMS for MANUFACTURING OF BICYCLE PARTS ( FREE WHEELS) @ 8000 Numbers/Day MANUFACTURING OF BICYCLE PARTS ( CHAIN) @ 5000 Numbers/Day MANUFACTURING OF BICYCLE PARTS ( HUB) @ 6000 Numbers/Day MANUFACTURING OF BICYCLE PARTS ( CHAIN WHEELS) @ 600 Numbers/Day MANUFACTURING OF BICYCLE PARTS( RIM) @ 1000 Numbers/Day.
The industry has deposited consent fee amounting to Rs. 1400/- vide R.No. 192486294 dated 14.01.2026 under the Water Act, 1974, which is adequate upto 31.07.2031 (after deducting NOC regularization fee) against gross value of fixed assets Rs. 246.00 lac and plant & machinery Rs. 200.94 Lacs as on 31.12.2025.
Accordingly, the industry was visited by Er. Manraj Singh Randhawa, AEE of this office on 02.02.2026 and observed as under: -
1. The industry is engaged in the manufacturing of cycle wheel spare parts.
2. The industry has provided 04 no. phosphating tanks, one acid dip section, one annealing furnace, 02 rotary furnaces and one coloured Bhathi.
3. The industry has also installed Powder Coating Booth, Powder Coating Oven, Lathe machines, 43 no. power presses, 03 friction press, 03 no. hydraulic press, 04 no. rolling machine, 27 no. turning machine, 11 no. Drill Machine 02 Spendal, 02 no. RIM Rolling Machine, 02 no. but welding Machine, 02 Vibrator, Chain assembly and other allied machinery.
4. The industry has done agreement dated with M/s JBR Technologies Pvt. Ltd., Phase-8, Focal Point, Ludhiana @ 10000 Ltr./Month for lifting of trade effluent generated from process.
5. The industry has provided water meter on the source of fresh water supply for process, its reading during visit was noted to be 318.03 KL.
6. The industry has provided 01 no. storage tank for storage of trade effluent of capacity 13000 ltr. and approx. 4500 ltr. were lying stored.
7. The industry is maintaining the record of water consumed in the process viz-a-viz effluent lifted. As per the record, the reading on 01.10.2025 was 276.67 KL and the reading during the visit was 318.03 KL. Thus, the industry was consumed 41.36 KL and lifted out 34.0 KL during the same period, which is in consonance after assuming evaporation. No bypass/unauthorized mode of disposal was observed during the visit.
8. The cooling water is being re-circulated and domestic effluent is being discharged into sewer.
9. The industry has provided CCTV Cameras at the entry gate of processing shed, flow meter and at the process area.
10. The industry has provided designated box near the process area to keep record for easy and ready accessibility.
11. In compliance of hearing decision, the Bank Guarantee was partially encashed for and amount of Rs. 1.0 Lakh from the total B.G. value of Rs. 2.0 Lakh, vide no. 217 dated 11.02.2026 and fresh letter issued by the Bank has been received for remaining Bank Guarantee of Rs. 1.0 Lakh in this office dated 18.02.2026.
12. As such the industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981 as well as hearing decisions.
In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30.06.2030 with suitable conditions as per policy of the Board.
