It is submitted that the HCF was earlier granted consents to operate under the Water Act, 1974 & Air Act, 1981 vide no. CTOW/Renewal/MOG/2025/27598542 dated 13/01/2025 which is valid upto 30/06/2026 & CTOA/Renewal/MOG/2022/16835382 dated 01.07.2022 which is valid upto 30.06.2025 for operation of hospital with bed capacity @ 100 beds, subject to the conditions mentioned therein alongwith special condition that the hospital will ensure the compliance of the Bio-Medical Waste Management Rules, 2016.
Now, the HCF has applied for obtaining renewal of consent to operate under Air Act, 1981 for bed capacity @ 100 beds. Details of the case are as under: - •
• The hospital has submitted copy of an agreement dt 01.07.2023 with common facility of M/s Meridian Mileu Care Pvt. Ltd., authorized by the Board for 100 beds and is valid for a period upto 30.06.2026.
• The hospital has submitted an undertaking regarding the bed capacity.
• The hospital has deposited the consent fee of Rs. 20,000/- vide R. No. 112846240 dated 17.02.2026 under the Air Act, 1981 against total bed capacity of 100 beds, which is adequate upto 30.06.2027 as per Board’s office order dated 06.01.2023.
• The HCF has submitted a copy of Adhaar card and Driving licence of new Applicant Sh. Vineet Kumar.
The HCF was visited by Er. Manmohit Kumar, AEE and Er. Muskan, JEE on 27.02.2026 and it was observed as under:-
1. The HCF has 100 no. beds installed in its premises, consisting of 02 no. Operation Theatres (OT) and 01 no. lab. As per record, avg. occupation of the HCF is about 41 beds.
2. The HCF has installed ETP which was not in operation and untreated effluent was being overflow from ETP and untreated trade effluent was being discharged into 02 nos. borewells provided in the adjoining parking area.
3. The HCF has not shown any record of operation ETP i.e., water meter & energy meter.
4. The hospital is segregating Bio medical Waste being generated by its category wise at the point wise of their generation as per color coding, collected in non-chlorinated puncture proof bags, which are placed in plastic containers in each ward.
5. The hospital has provided shredders/cutters for shredding of used needles and same was found in working condition.
6. The hospital has maintained the record of Bio-Medical Waste, being lifted by the CBMWTF.
7. The hospital has provided common collection centre for storage of bio medical waste and Bio-medical waste was found scattered in the room.
8. The HCF has installed 01 DG set of capacity 320 KVA with canopy and adequate stack height.
9. The HCF is complying with the provisions of Air Act, 1981.
10. The HCF is not complying with the provisions of the Bio-Medical Waste Management Rules, 2016 and Water Act, 1974.
Keeping in view of the above, it is recommended as under:
1. Consent to operate under the Air Act, 1981 may be granted to the HCF for operation of hospital with bed capacity @ 100 beds for a period upto 30.06.2027 as per the adequacy of consent fees.
2. Authorization granted to the HCF under Bio-medical Waste Management Rules, 2016 may be revoked and action under the provisions of Bio-medical Waste Management Rules, 2016 may be initiated against the HCF.
3. Consent to Operate under Water Act, 1974 granted to the HCF may be revoked and action u/s 33-A of the Water Act, 1974 may be initiated for its Closure, please.
