File Note: Kindly peruse the note history & agenda note/details sent by EE, RO, Patiala… The details of the case are as under: • As pre the report of RO, the unit is a restaurant of capacity 75 Seats and has provided applied for CTO for discharge of domestic effluent @ 12 KLD into sewer after passing through Oil and Grease trap… • However, the same is not in consonance with the CPCB’s “Mechanism/Guidelines tor Control of Pollution and Enforcement of Environment Norms at Individual Establishinents and the Area/ Cluster of Restaurants/ Hotels/ Motels/ Banquets” issued in 2020 and as adopted by the Board vide o/o no. 64 dated 02.02.2021, as per which, “A restaurant with minimum seating capacity of 36 shall install ETP”…. • As, the pp has not installed the ETP at site and is thus not complying with the said guidelines/mechanism… • Accordingly, the project proponent was issued show cause notice for refusal of grant of consent to operate under the water act, 1974 and Air act 1981, along with an opportunity of show cause in writing within 10 days… • Now, RO has mentioned that the PP has submitted its written reply dated 17.02.2026, wherein, it has requested to grant six months' time period to install the ETP in compliance to the CPCB's "Mechanism/Guidelines for Control of Pollution and Enforcement of Environment Norms at Individual Establishments and the Area/ Cluster of Restaurants/ Hotels/ Motels/ Banquets" issued in 2020 and as adopted by the Board vide o/o no. 64 dated 02.02.2021… • RO has recommended to grant CTO to the project proponent, for a short time period, alongwith suitable conditions and an additional condition that the unit shall install an ETP for the treatment of the wastewater generated from kitchen, laundry and domestic sewage within 06 months and obtain varied consent to operate under the provisions of the Water Act, 1974 before commissioning of the same… • In view of above and report/recommendations sent by EE, RO, Patiala, if approved, A. the pp may be granted consent to operate under the Water Act, 1974 & Air Act, 1981, for a short time period, i.e. upto 30.09.2026, subject to suitable conditions, conditions as imposed by RO and following additional conditions: 1. the project proponent shall install ETP of adequate capacity for the treatment of the wastewater generated from kitchen, laundry and domestic sewage, within 06 months and obtain varied consent to operate under the provisions of the Water Act, 1974 before commissioning of the same. 2. The adequacy/ efficacy of the pollution control arrangements & disposal scheme shall be the sole responsibility of the project proponent and the pp shall be bound to implement/ upgrade its pollution control & disposal arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 3. The pp shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/ choe/ nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 4. The project has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances/ permissions from all other concerned departments. 5. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 6. The consent is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form and during hearing. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 7. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. B. The Environmental Engineer (Computers) be requested to put a patch on the OCMMS ID of the industry, so as to restrict it from obtaining the auto renewal consent under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981… Competency- SEE, ZP-1
