File Note: Kindly peruse the note history & agenda note/details sent by EE, RO, Patiala… The details of the case are as under: • Earlier, the pp was issued notice u/s 33-A of the Water Act, 1974 & Air, Act, 1981, alongwith an opportunity of personal hearing before CEE(P) on 27.10.2025, wherein, it was decided as under:”” 1. The project proponent shall comply with all the observations of the visiting officer within 15 days and shall comply with the environmental laws, at all times. 2. The project proponent shall apply for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981, within 15 days. 3. EE, RO, Patiala shall visit the site of the project, check the compliance of the Environmental Laws and process the consent application of the project on merits.”” • Now, the pp has applied for obtaining CTO under the provisions of the Water Act, 1974 & Air Act, 1981… • As per the report of RO, the unit is a restaurant of capacity 76 Seats and has provided applied for CTO for discharge of domestic effluent @ 8 KLD into sewer after passing through Oil and Grease trap… • However, the same is not in consonance with the CPCB’s “Mechanism/Guidelines tor Control of Pollution and Enforcement of Environment Norms at Individual Establishinents and the Area/ Cluster of Restaurants/ Hotels/ Motels/ Banquets” issued in 2020 and as adopted by the Board vide o/o no. 64 dated 02.02.2021, as per which, “A restaurant with minimum seating capacity of 36 shall install ETP”…. • As, the pp has not installed the ETP at site and is thus not complying with the said guidelines/mechanism… • Accordingly, a ckarification was raised to the RO and now RO has replied to the same, which may kindly be perused. • In view of above and report/recommendations sent by EE, RO, Patiala, if approved, A. the pp may be granted consent to operate under the Water Act, 1974 & Air Act, 1981, for a short time period, i.e. upto 30.09.2026, subject to suitable conditions, conditions as imposed by RO and following additional conditions: 1. the project proponent shall install ETP of adequate capacity for the treatment of the wastewater generated from kitchen, laundry and domestic sewage, within 06 months and obtain varied consent to operate under the provisions of the Water Act, 1974 before commissioning of the same. 2. The unit shall apply for authorization under the Hazardous and other Waste Management Rules, 2016 within 15 days. 3. This consent is granted for the discharge of domestic effluent @ 8 KLD only. 4. The industry shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA) from time to time. 5. The entrepreneur/industry shall obtain necessary statutory permissions /clearances from all other concerned departments. 6. The unit shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic. 7. The unit shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. 8. The unit shall ensure that there is no public nuisance in the area, due to activities of the unit. 9. The unit shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. 10. The adequacy/ efficacy of the pollution control arrangements & disposal scheme shall be the sole responsibility of the project proponent and the pp shall be bound to implement/ upgrade its pollution control & disposal arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 11. The pp shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/ choe/ nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 12. The project has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances/ permissions from all other concerned departments. 13. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 14. The consent is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form and during hearing. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 15. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. B. The Environmental Engineer (Computers) be requested to put a patch on the OCMMS ID of the industry, so as to restrict it from obtaining the auto renewal consent under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981… *Competency- CEE(P) (as earlier notice u/s 33-A of the Water Act, 1974 was issued to the pp)
