File Note: It is submitted that earlier, the HCF was granted authorization under BMW Rules, 2016 vide no. BMW/ EE/ SGR/F-122/V- 04/10/2011 valid upto 31/03/2017 for the operation of hospital having bed capacity @ 20 beds. Further, the HCF was granted authorization under BMW Rules, 2016 vide no. BMW/Fresh/SGR/2018/8390013 dated 13/09/2018 valid upto 31/03/2023. Thereafter, the HCF has auto renewed authorization under the Bio-Medical Waste Management Rules, 2016 vide no. BMW/Renewal/SGR/2025/27785921 dated 23.01.2025 valid upto 23.01.2030 under the name and style of Patiala Hospital and Maternity Home. Now, the HCF has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 along with requisite documents for 20 beds capacity. The HCF has also applied for authorization under BMW Rules, 2016 under the name and style of Patiala Hospital. The HCF has deposited consent fee of Rs. 15,000/- vide no. 316415849 dated 17.02.2026, under the Water Act, 1974 and Rs. 15,000/- vide no. 970503481 dated 17.02.2026 under the Air Act, 1981. The fee deposited by the HCF is adequate upto 30.03.2030. The brief detail of the case applied by the healthcare facility is as under: - 1. The HCF has made an agreement with M/s Medicare Environment Management Pvt. Ltd., Ludhiana which is valid upto 31.03.2028 for 20 bedded capacity. 2. The HCF has submitted receipt issued by MC, Malerkotla w.r.t. sewerage connection to discharge its effluent after treatment through 1% sodium hypo chloride and septic tank. 3. The HCF has submitted approved building plan. 4. The HCF has submitted copy of registry. 5. The HCF has submitted acknowledgment from EO, MC, Malerkotla w.r.t obtaining approved building plan. Accordingly, the HCF was visited by the undersigned on 03.03.2026 and during visit, it was observed as under: - 1) The HCF now has provided 20 beds and was found in operation. 2) The HCF has 01 no. OT, 1 no. lab, 1 no. labor room, 05 no. rooms, 3 no. wards and emergency and recovery facility. 3) The record of bio-medical waste lifting manifest is being maintained. 4) The industry has installed 01 no. of D.G. set having capacity of 40 KVA, with canopy and adequate stack height. 5) Needle Shredders have been provided on necessary points. 6) Color coded containers are provided for storage of bio medical waste. Segregation of bio medical waste is being done properly. Non-chlorinated bags are used for storage of bio medical waste. 7) The bio medical waste is being lifted regularly by CBWTF. 8) Bar code stickers are used for color coded bags. 9) The HCF has provided bio medical waste storage room for storage of biomedical waste. As per the latest Office Order of the Board vide no. 379 dated 27/10/2023, “It has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-Medical Waste Management Rules, 2016 as amended upto date and subsequent amendments, if any.” In the present case, the HCF is located in city Malerkotla, where the terminal STP has already been installed and the same is in operation and is achieving prescribed standards of the Board. The HCF is found complying with the provisions of BMW Rules, 2016, the Water Act, 1974 and the Air Act, 1981. As per record of this office, no action is pending against the health care facility. Keeping in view of above, if approved, the HCF may be granted consent to operate upto 30.03.2030 for 20 beds under the Water Act, 1974 and the Air Act, 1981 with suitable conditions and with special conditions that: 1. This consent is valid for 20 Beds only. HCF will apply for CTO/CTE if it increases its bed capacity. 2. The HCF will comply with the provisions of the BMW Rules, 2016, the Water Act, 1974 and the Air Act, 1981 in true letter & spirit. 3. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same. 4. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year. 5. The HCF will maintain proper record of generation and lifting of bio-medical waste. 6. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis. 7. The HCF shall obtain other statutory approvals required from other departments, if any. Competency EE, RO
