Subject: Application for obtaining 'consent to establish' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 by M/s- Goutam Kalucha Contractor (Hot Mix Plant), Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar.
In this regard, it is submitted that the industry has applied for 'consent to establish' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under orange small category for establishment of Hot mix plant @ 60 TPH by using raw material Aggregates @ 35 TPH, Sand @ 20 TPH, Stone Dust @ 5 TPH and Bitumen @ 6 TPH in Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar.
The industry has deposited NOC fee of Rs. 4100/- along with application fees vide R. No. 696827322 dated 20.02.2026, against the proposed cost of project of Rs. 56.96 lacs. The NOC fee deposited by the industry is adequate for one year.
The industry has submitted, Project report authenticated by CA, Feasibility report, Distance certificate from Revenue authorities/ Tehsildar, Sri Anandpur Sahib, District Rupnagar, undertaking regarding authorized signatory, DTP letter regarding site suitability/land use classification, land lease document, and other requisite documents.
The Site Suitability, DTP Rupnagar vide ਯਾਦ ਪੱਤਰ ਨੰ. 68/ਡੀ.ਟੀ.ਪੀ ਰੂਪਨਗਰ/LUC-1 dated 05.02.2026 has issued letter to this office wherein it is mentioned that the industry is located in Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar, Hadbast no. 360, Khasra no. 100/1(6-16); wherein, it is mentioned that The applicant shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 7 9 along with other provisions of PRTPD Act, 1995, in case the site falls In non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department.

From above report, it is evident that the industry is meeting with the siting guidelines prescribed for such units.
Accordingly, the proposed site was visited by the Himani Goyal, AEE of this office on 05.03.2026 and contacted Sh. Goutam Kalucha (Representative of the industry). During visit, it was observes as under:
1. During visit, it was observed that the proposed site is located in village – Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar.
2. The site is in located nearby to M/s M.S Minerals (Stone crusher) village Agampur.
3. No high tension wires are crossing over the proposed site.
4. The project proponent has started with installation work of machinery at site.
In view of the above, if approved, the proposed industry may be granted 'consent to establish' for establishment of Hot mix plant @ 60 TPH for one year subject to the suitable conditions along with special conditions as under:
1. The NOC is valid for a period of one year or till the commissioning of industry, whichever is earlier.
2. The industry shall not operate without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
3. The industry shall submit approved layout plan/site plan and approved building plan from director of factory before 'CONSENT TO OPERATE' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
4. The industry will be entirely responsible for earmarking its boundary and installation of plant at the site for which distance certificate and site suitability certificate has been issued by the Revenue Authority.
5. The industry is responsible for installing the plant at the proposed site for which distance certificate and land use classification has been submitted to DTP.
6. The industry shall obtain necessary regulatory clearances from the concerned departments.
7. The industry has been approved by the Board from pollution angle and does not give right of ownership.
8. The industry shall obtain the statutory clearances / permissions from all other concerned departments.
9. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
10. The industry shall comply with the code of practice laid down by the CPCB and PPCB at all time and guidelines issued by Government from time to time.
11. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received.
12. The CTE/NOC is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form and submitted in the office. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
13. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
14. The sole responsibility for any wrong information/ declaration and/or any litigation/loss arising due to grant of this Consent to Establish shall be of the industry/ project proponent and its all the responsible/ concerned person(s).
