It is submitted that as deducted from the note dated 13.02.2026 of visiting AEE, The industry has presently installed 08 soft flow machines of capacities (01x500 Kg, 02x400 Kg, 01x300 Kg 03x250 Kg, & 01x25 Kg) for dyeing of fabric purpose and at time of consent in 2022 the industry had installed 08 soft flow machines of capacities (01x200 Kg, 01x150 Kg, 03x100 Kg, 01x75 Kg & 02x50 Kg) for dyeing of fabric purpose......
As such, the dyeing machinery no. is same, however capacity of each machinery now installed by the industry is being reduced, as such effluent discharge of the industry in CETP Module will be lower than the previous machinery as mentioned in the CTO granted to it. There will be not be any increase in discharge, accordingly the industry fulfills PPCB directions dated 6.5.2025. ..........
Further the industry has not submitted any proposal for upgradation of APCD or given any commitment in writing to to do so as deducted from RO notes....
In view of above, it is recommended that: - A. Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for a short term of three months, and the electric connection of the industry may be restored temporarily for the same period three months with suitable conditions as per Board's policy and following special conditions as under:- 1. The unit shall resolve its civil dispute with other party and the consent granted shall be subject to the decision of the Civil Court, if any case is pending in this regard.2. This consent to operate is subjected to the decisions of Hon'ble National Green Tribunal in the appeal case no. 41 of 2024 filed by the CETP of 40 MLD. 3. The industry shall continue to comply with all the Board directions already issued to it under the relevant act. 4. The industry shall not generate/discharge trade & domestic effluent more than its allotted shares capacity. 5. The industry shall discharge the whole of its consented effluent into a dedicated sewer line leading to CETP for final treatment. 6. The industry shall not make any new connection/undisclosed connection for the discharge of effluent either into the public sewer or PDA conveyor system. 7. The industry should either take measures to control its inlet parameters by good practices and selection of good chemicals for processing or shall operate and maintain its existing effluent treatment plant (ETP), regularly and efficiently, so as to achieve the inlet effluent standards of CETP as per DPR. 8. The industry shall make the necessary arrangements to achieve the effluent standards as per the inlet-designed parameters of the CETP. 9. There shall be no any other physical expansion of the unit either with the installation of new machinery without valid permissions of the Board. 10. The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or the dedicated conveyance system is overflowing. 11. The industry shall maintain the record of flow meter installed at source and at the outlet leading to CETP. 12. The industry shall carry out third-party audit from any reputed institute to access the actual discharge capacity of the dyeing unit in compliance with the proceedings issued by the Board vide letter no. 4387 dated 09.08.2023 to the CETP 40 MLD. 13. The industry shall obtain necessary permissions for the abstraction of ground water from PWRDA/CGWA. 14. The industry shall maintain the record of untreated effluent at the outlet in such manner that it shall not affect the working of CETP.15. The industry shall upgrade air pollution control device connected to the boiler section, within 15 days so as to achive revised emission standards as MOef & CC notification 16.05.2023.…………………….. B. Notice for imposition of Environmental Compensation for the period of violation from 19.02.2025 (date of visit when the unit was found in violation of environmental norms by the visiting officer and the unit was being operated by M/s R.S. Dyeing) upto 26.09.2025 (date of disconnection of electricity supply by the Punjab State Power Corporation Ltd on the directions of the Punjab Pollution Control Board) when unit was being operated on rental basis by M/s R.S. Dyeing, shall be issued to the industry with opportunity of personal hearing before Chairperson of the Board………….. Competency to decide the application: SEE (being small scale red category unit)……………… Competency to restore the electric connection: CEE in concurrence with Chairperson of the Board…… Approval for issuing of Notice for imposition of Environmental Compensation on the industry: Chairperson of the Board………..
