It is submitted that the in the meeting held under Chairmanship of Chief Environmental Engineer (P) on 13.07.2023, wherein, following general instruction was given:
“While processing the consent cases of projects falling under Zirakpur area, 15.06.2022 is the cut off date for the project proponent to obtain permission of sewerage connection from MC, Zirakpur. The consents cases shall be processed accordingly. Further, agreement of land given by the project proponent to be developed for plantation shall be got freeze from the Local Government Department/ GMADA/ Revenue Authorities to avoid its use for other purpose.”
The project proponent has obtained permission from Municipal Council, Zirakpur vide no. 891 dated 12.04.2021 regarding no objection certificate for disposal of Sewerage treated water as per norms of plotting colony of M/s Highland Park Luxuria, Highground Road, Zirakpur, Distt. SAS Nagar. Further, Municipal Council, Zirakpur was afforded an opportunity of personal hearing before the Chairman of the Board on 11.04.2022, wherein, it was decided as under:
1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 shall be issued to the MC Zirakpur as under:
i. MC Zirakpur shall not give permission to new project till its new STP is made operational.
ii. Now, new sewer connection shall be allowed to the domestic consumer still the completion of new STP as existing/old STP is overloaded.
2. MC Zirakpur, be directed not to approve new project lands till necessary infrastructure like sewer/ STP/ disposal mechanism is not put in place.
From the above, it is clear that the project proponent has obtained permission from MC Zirakpur regarding discharge of treated effluent into MC sewer well before directions issued to the MC Zirakpur to not give permission to new project till its new STP is made operational.
The project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2023/21034021 dated 24.03.2023 valid upto 31.01.2024 with disposal arrangement that Domestic Effluent @ 69.0 KLD - Onto 0.56 acre green area & excess to 1 acre land reserved under Karnal Technology till MC sewer connected, subject to certain terms and conditions mentioned therein.
Accordingly, now the project proponent has applied with revised disposal arrangement and the project proponent has submitted a copy of letter no. 254 dated 03.04.2025 issued by MC Zirakpur regarding connectivity of sewerage line of the project with MC sewer.
Further, Municipal Council, Zirakpur has not upgraded and enhanced the capacity of its terminal STP(s) and is not adequate to handle additional domestic effluent load from the new project (as per decision held before the Chairman of the Board on 11.04.2022). Furthermore, being an old project and discharge permission granted by MC Zirakpur to the project well be before the directions issued by the Board to MC Zirakpur. Accordingly, the project proponent can discharge its excess treated effluent into MC Zirakpur sewer (as per decision of the meeting held on 13.07.2023 before the CEE). MC Zirakpur was in process to install new STP at Village Sanoli. The project proponent is complying with the conditions of earlier granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
