It is submitted that earlier the consent to operate Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 was granted to the industry vide online reference no. CTOW/Fresh/GRP/2021/14955603 & CTOA/Fresh/GRP/2021/14955508 dated 29/03/2021, which are valid upto 30/09/2025 under orange category.
Now, the industry has applied for obtaining Fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 after change in partners.
The BKO has submitted an undertaking along with application and intimated that the BKO has been taken over by its new Partners namely Sh. Harmanpreet Singh S/o Sh. Kawaljit Singh from old owner Balwinder Singh but the name & style of BKO i.e. M/s Birdavinder Singh Brick Kiln, Village-Ghoga, Tehsil-Batala, District-Gurdaspur has remain the same. The industry has submitted copy of GST certificate as a documentary proof. The industry has submitted all documents related to its previous owners and new owners along with the change in the ownership in revenue record, for which the BKO has submitted copy of farad showing name of its new partners.
The industry has deposited Rs. 17,900/- Vide UTR No. 664256016 dated 27/01/2026 and Rs. 17,900/- vide UTR No. 705315234 dated 27/02/2026 as consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading Fee, which is adequate upto 30/09/2030 including Rs. 500/- as Form downloading fee against total gross value of fixed assets worth Rs. 43,19,141/- as on 31/01/2026.
The industry has submitted completion certificate issued by PSCST, Chandigarh vide letter no. PSCST/CC/1609 dated 15/12/2020 intimating that the industry has constructed induced draft Brick Kiln with zig-zag firing as per the technology evolved by the Punjab State Council for Science & Technology. The Kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report (SPL-1491). The Brick Kiln has also submitted the copy of dimensional drawing/plan of Kiln showing the length of Central Island of brick kiln is less than 245 ft.
The industry was visited by officer of the Board on 05/03/2026 and observed as under:-
1. The industry has modified its existing brick kiln into induced Draft Brick Kiln with Zigzag Firing.
2. The industry was not in operation during the visit.
3. The industry has stabilized the peripheral road around the kiln trench with brick bats/keri.
4. The industry has planted trees along the boundary of Brick Kiln.
5. The industry has installed platform and ladder with stack for sample collection purpose. Sampling facility installed by the industry is adequate.
6. The industry complied with the code of practice prescribed by the Board for brick kilns.
In view of the above, may if approved “Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln for a period upto 30/09/2030 with suitable conditions along with the special condition that:-
1. The project proponent shall comply with code of practice/directions issued by PSCST, Chandigarh.
2. The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016.
3. The brick kiln shall get its stack emission analyzed as per policy of the Board.
4. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
5. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
6. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
7. The Brick Kiln shall use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s notifications no. 10/574/2022-STE1/443 dated 04/11/2022.
