Clarification Note: Whereas, it is mandatory on the part of the industry to obtain consent to establish of the Board u/s 25/26 of Water (Prevention & Control of Pollution) Act, 1974 & u/s 21 of Air(Prevention & Control of Pollution) Act 1981 before the establishment/ expansion of the unit. And whereas, it is mandatory on the part of the industry to obtain consent to operate ofthe Board to operate an outlet u/s 25/26 of Water (Prevention & Control of Pollution) Act, 1974& industrial plant u/s 21 of Air (Prevention & Control of Pollution) Act 1981 for discharging ofeffluent/ emissions from its industrial premises. And whereas, it is mandatory on the part of industry to provide adequate and appropriatepollution control facilities to bring down the concentration of various pollutants in its effluent/emissions within the permissible limits prescribed by the Board. And whereas, the project proponent has applied for obtaining Consent to Establish'(NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air(Prevention & Control of Pollution) Act, 1981. And whereas, the project proponent proposes to establish a new machining unit formachining of forged parts @45,000 Nos./day with total project cost of Rs. 2567 lakhs and P&Mof Rs. 1700 lakhs. The site falls in designated Industrial Focal Point as per Ludhiana Master Plan2007-2031. And whereas, based on the application details and visit report dated 04.02.2026, it wasobserved that no machinery has been installed. Proposed activity is machining only. One DG setof 1250 KW with canopy and adequate stack is proposed. No trade effluent will be generated. Domestic effluent @ 20 KLD shall be treated in proposed STP and reused for flushing purpose.No discharge into MC sewer is proposed. The Hazardous waste of categories 5.1 and 5.3 will begenerated and authorization shall be obtained before operation. And whereas, it was observed by the Competent Authority that it is not possible to re-use100 % treated domestic effluent as the treated effluent use is limited to flushing activities only and that too after tertiary treatment. For other activities like drinking, hand wash, canteen /Kitchen/utensil wash/bathing etc fresh water is required. The flushing requirements varies 30-50% only. Considering maximum flushing requirement of 30-45 Its/day/worker, the industry willable to use 6- 9 KLD of treated effluents and rest of 11 to 14 KLD of effluent is to be disposed through some other modes unless it provide very advanced treatment systems like RO+ME. The practical aspects of the proposal is required to be checked. And whereas, the matter has been considered by the Competent Authority and it has been decided to refuse the'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, after giving an opportunity of personal hearing. As such, you are, hereby given an opportunity of personal hearing before Chief,Environmental Engineer at puniab Polutien Control Board, E-648-B, Ist Floor, Phase-V, FocalPoint, Ludhiana on 09.03.2026 at 11:00 am to explain your position with respect to above said observations, tailing which action as deemed fit in the matter shall be taken under the provisions of the Water (Prevention & Control of Polution) Act. 1974 and Air (Prevention & Control of Pollution) Act, 1981 without giving any opportunity/ notice.
