It is submitted that the promoter has granted Consent to Establish (NOC) vide no. CTE/Fresh/PTA/2019/9119420 dated 14/03/2019, valid upto 13/03/2020 for Residential colony (359 nos residential plots and 27 nos. SCO's) and thereafter, the project proponent had obtained NOC extension from the Board vide no. CTE/Ext/PTA/2022/19478690 dated 06/10/2022, valid upto 15/01/2023 and obtained auto renewed upto 16.07.2026 to develop residential colony having 360 residential plots & 27 SCOs in an area of 27.67 acres i.e. 111959.4 sq. mtr. at Village Dilwal, Patiala under Orange Category, subject to certain conditions as mentioned therein.
As per the record file, a compliant was received in the O/o PPCB through PRGS portal against the project.
To verify the contentions of complaint, the site of subject cited colony namely M/s Panchvati enclave (promoter Gulshan estates), Village Dilwal, was visited on 03.07.2025 alongwith the complainants.
Accordingly, the reply to the complaint was submitted through PRGS portal. During visit, it was observed that 2-3 houses have started their residing in the colony and construction work of 4-5 houses is under progress.
Meanwhile, the complainants has also filed a complaint in the before Civil Judge, Junior Division, Patiala vide case no. CS/1555/2025 dated 16.07.2025 for permanent Injunction, restraining the defendant no.1, its agents, servants, supporters, and partymen, from constructing sewerage treatment plant near the houses of the plaintiffs and locality, and also restraining the defendants no.2 and 3, not allow the defendant no. 1 to construct the sewerage treatment plant at Panchvati colony near the houses of the plaintiffs and the locality of Royal Enclave, Urban Estate, Patiala.
The establishment has given occupancy in the project without obtaining partial consent to operate of the Board under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and therefore, violating the condition of NOC.
Therefore, the project promoter is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, intentionally and deliberately.
The matter has been considered by the Competent Authority and it has been decided to take action against the project promoter under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause notice alongwith personal hearing, due to aforesaid violations.
As such, show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 issued to the project promoter vide Board's letter no. 5153 dated 15/10/2025 alongwith an opportunity to appear in person before the Senior Environmental Engineer (2P-1) on 30/10/2025 at 11:00 am (postponed to 17/11/2025 due to administrative reasons). After hearing, it was decided that:
1. The project proponent shall deposit a bank guarantee amounting to Rs.
2.00 lacs as an assurance to comply with the environmental laws, within 7 days in Regional Office, Patiala.
2. The project proponent shall immediately provide septic tank at the site for the waste water being generated from the occupied houses.
3. The project proponent shall immediately apply for partial consent to operate under the Water Act, 1974 and the Air Act, 1981 for the present occupancy in the project.
4. The Environmental Engineer, Regional Office, Patiala shall visit the site of the project after 15 days, check the compliance of the environmental norms and send further report/ recommendations in the matter.
The proceedings were conveyed to the project proponent vide
Board’s letter no. 6007 dated 20.11.2025 for compliance.
The industry has deposited Rs. 126000/- vide UTR No. 335983776 dated 19.12.2025 and Rs. 18000/- vide UTR no. 712151601 dated 12.02.2026 against the project cost of Rs. 750 lakhs, which is adequate upto 31.12.2030.
The promoter was submitted approved building plan from the Chief Town Planner, Punjab on 23.08.2004.
The project proponent has proposed to install STP of capacity 250 KLD consisting of consist of Bar Screen Collection Tank Primary Clarifier Activated Sludge Process (Aeration tank followed by secondary clarifier)
Sludge Drying Beds Treated Water to be used for Gardening.
The promoter has submitted an undertaking that the treated domestic waste water will be utilized round the year for plantation purposes. This land will not be used for any other purpose; till date there is no other alternative source of waste water disposal as approved by PРСВ.
Therefore, the establishment is complying with the conditions of granted Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981.
Thereafter AUTO-RENEWED CTE obtained by the project proponent vide no. CTE/Renewal/PTA/2025/29204805 dated 16/07/2025 which is valid 16/07/2026, has been cancelled due auto-renewal of CTE obtained by the project proponent is not in order, as, in the case of Area development projects, the CTE can be extended for a maximum time period of five years and upon expiry of that, the project proponent is required to apply for obtaining fresh consent to establish (CTE).
The project proponent was granted partial consent to operate for operation of outlet of 50 residential plots and 25 no. SCOs (i.e. discharge of 30 KLD), upto 30.09.2027, subject to suitable conditions as mentioned therein.
Now, the promoter has applied for obtaining fresh consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 to develop residential colony having 360 residential plots & 27 SCOs in an area of 27.67 acres i.e. 111959.4 sq. mtr. at Village Dilwal, Patiala under Orange Category. The site was a l r e a d y visited by the AEE of this office on 20.01.2026.
During visit, it was observed that:
1. In the colony, 3 houses have been constructed and residence has been made in these houses. 10-12 house are under construction. The colonizer has informed that around 50 houses will be constructed within an span of 2 years as agreements have been made with them.
2. The project proponent has provided septic tank at the site for the waste water being generated from the occupied houses and domestic effluent is being discharged onto land for plantation after passing through septic tank.
3. The project proponent has not increased any land area.
Keeping in view of above, it is recommended that fresh consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 to develop residential colony having 360 residential plots & 27 SCOs in an area of 27.67 acres i.e. 111959.4 sq. mtr may be granted for one year subject to certain conditions as per policy of the Board. |
