Subject: Application for obtaining fresh Consent to Establish (NOC) under the Water Act, 1974 and Air Act, 1981 – M/s Taj Green Valley (Promoter Jitu Real Estate Pvt. Ltd.), Village Seona, Near Bhadson Road, District Patiala.

It is submitted that the earlier granted consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. PTA/NOC/2008/F-147 dated 19.02.2008, valid upto 18.02.2010.
Thereafter, the project proponent has not obtained NOC extension. It is pertinent to mention here that Consent to Establish (NOC) can be extended for a maximum time period of five years and upon expiry of that, the project proponent is required to apply for obtaining fresh consent to establish (CTE).
Now, the project proponent has applied for obtaining fresh consent to establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 by the name and style of M/s Taj Green Valley (Promoter Jitu Real Estate Pvt. Ltd), Revenue area of Village Seona, Near Bhadson Road, District Patiala.
As per application form
The total project is proposed to have 100 no. residential plots and 25 nos. commercial plots having area of 47 bigha 16.5 biswa OR 9.96 Acres.
CLU/LOI and License for setting up a affordable residential colony
The project proponent i.e. M/s Taj Green Valley has obtained CLU/LOI and License for developing land as Residential Colony and commercial project in the name and style of ‘Jitu Real Estate Pvt. Ltd.’ on an area of 47 bigha 16.5 biswa (9.96 acres) at Village Seona, Near Bhadson Road, District Patiala from the Department of Housing and Urban Development, Patiala vide letter no. 369 CTP(PB)/SP-432 (P) dated 24.01.2006 issued by Chief Town Planner, Patiala.
Approved Layout Plan
The project proponent has submitted copy of approved layout plan for the residential colony and commercial project approved layout plan issued by Senior Town Planner, Patiala dated 13.02.2006. Further, the project proponent has also obtained final letter of approval to develop and colony by the competent authority of house and urban development department of Punjab vide no. 2681 (STP-Patiala)/CP-182 (P) dated 20.11.2006.
NOC Fee:
The project proponent has deposited fees of Rs. 78000/- vide UTR No. 801132688 dated 20.01.2026 as NOC fee against the project cost of Rs. 302.8 lakh, which is adequate for one year under orange category.
Water Pollution
As per the feasibility report submitted by the project proponent, the total fresh water demand will be around 80 KLD and there will be generation of 65 KLD (After treatment use for watering green area within the township and disposal on land for irrigation) treated through STP.
The project proponent has proposed to install STP of capacity 65 KLD consisting of Primary Treatment Secondary (Biological) Treatment Tertiary Treatment Sludge Handling System Treated Water to be used for Gardening.
Air pollution
The project proponent has not proposed any D.G set.
Solid Waste
Non-liquid domestic refuse (commonly known as municipal solid waste – MSW) will be generated by the complex. Average quantity of this waste will be @ 0.50 kg/day from residential facility. Thus, about 250 kg/day of MSW will be produced by the township.
As per the proposal, the Management of solid waste includes as under:-
Recyclable rejects – e.g., plastic, paper, rubber, metal, etc. - about 25% (by weight). The total quantity of this waste is expected to be about 60 kg/day.
Non- recyclable rejects - about 20% (by weight). This includes reject residues by processed biodegradable waste. Average bulk density of the waste will be about 600- 700 kg/m³, which will increase to about 1100 kg/m³ after compaction (in landfill layers). The total quantity of this waste is expected to be less than 50 kg/day.
Biodegradable (partially/fully) - about 60% (by weight). Average bulk density of the waste will be about 500 kg/m³. The total quantity of this waste is expected to be a maximum of 150 kg/day. Additionally, less than 50 kg/day of partially bio-degradable solid waste will be generated, in the form of primary and secondary sludges from the sewage treatment facility.
Domestic Hazardous Waste - Will be disposed off to authorized vendor as per Solid Waste Management Rules, 2016.
Visit Report
The proposed site of the residential-cum-commercial project was visited by the undersigned on 05.03.2026. During visit, it was observed as under:
1. The proposed site falls in the revenue estate of Village Seona, Near Bhadson Road, District Patiala.
2. The project proponent has partially demarcated the boundaries of the proposed project site.
3. 3 no. house have been constructed and people have started residing in these house. The effluent generated from these houses is being discharged onto land for plantation after passing through septic tank.
4. As per the boundaries of the site shown by the representative during visit, there is no air polluting industry falls within a radius of 100 m from the boundary of the project site and there is no MAH industry within a radius of 250 m radius from the boundary of the proposed site.
5. The project proponent has not yet installed STP in the colony.
Moreover, as per Department of Science, Technology & Environment and Non- Conventional Energy, Govt. of Punjab vide order no. 3/6/07/STE(4)/3770 dated 30/10/2009, the statutory master plan has been notified under the Punjab Regional and Town Planning and Development Act, 1995 (Amended) 2006, mixed land use or any other development/ construction which comes up as per the earmarked zone, in case of new residential/ commercial, there is no need to keep any additional distance from the existing industry from the environment point of view because these factors have already been considered while earmarking the use of land for different categories in the Master Plan, as per notification no. 6312 dated 11th August, 2009 issued by Department of Housing and Urban Development.
Moreover, the proposed project is a residential and commercial and only plots will be sold by the promoter. Regarding the construction of commercial plots, EWS plots and independent floor, the total area of the project is 9.96 acres, which is very much less than 50 Hectare (120 Acres)/built up area of 1,50,000 sq. mtr. Hence the project does not cover under the ambit of under EIA notification dated 14/9/2006.
The competency for grant of CTE to such units lies with the Senior Environmental Engineer being Small Scale, Orange category unit as per the policy of the Board.
In view of the above, May if approved, recommendations be sent to SEE that the project proponent may be granted consent to establish from pollution angel for the above said project for one year with suitable conditions as per policy of the Board and some special conditions that:
1. The PP shall be bound to install sewage treatment plant (STP) of adequate capacity for treatment of entire wastewater to be generated from the colony.
2. The PP shall apply for partial consent to operate for houses constructed within one month.
3. The PP shall provide adequate plantation area for utilization of treated wastewater onto land for plantation.
4. The PP shall obtain necessary permissions from the concerned departments.
