A. It is intimated that the industry is a large-scale red category and has a CETP shares of 2000 KLD. The industry was earlier granted varied Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH4/2023/2397021 dated 24.11.2023, which is valid upto 31.03.2028 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2021/16760661 dated 20.12.2021, which is valid upto 19.12.2026 for production of Dyeing of Polyester Fabrics/Cloths @ 24750 Kgs/day, Dyeing Of Pc Fabrics/Cloth @ 8100 Kgs/day and Dyeing/Washing Of Garments @ 3600 Kgs/day with suitable and special conditions mentioned therein.
B. Thereafter, the industry was granted Consent to Establish (NOC) for expansion vide no. CTE/Exp/LDH4/2024/25453434 dated 24.05.2024, which is valid upto 23.05.2025 for expansion of 01 no. boiler of capacity 12 TPH with Multi Cyclone Separator, 2 Stage Alk Scrubber as APCD and 01 no. steam generator of capacity 03 TPH with Multi Cyclone Separator, 2 Stage Alk Scrubber as APCD with suitable and special conditions mentioned therein.
C. Thereafter, the industry was visited by the officer of this office alongwith lab officials on 11.02.2025 and it was observed that the industry has done the expansion and has installed of the boiler of capacity 12 TPH using Pet Coke as fuel with Trima cyclone followed by double stage alkali scrubber as APCD. During visit boiler of 12 TPH was in operation and stack emission sample has been collected from porthole on stack after APCD (Thermax Boiler @ 12 TPH) and as per analysis results received from Zonal Lab, Ludhiana the concentration of particulate matter was found to be 386 mg/Nm3, which was beyond the prescribed limits and concentration of SO2 is found to be 296 mg/Nm3 which was within permissible limit as prescribed by the Board. The industry has also failed to apply varied consent to operate under the Air Act, 1981 till date. The industry was not complying with the provisions of the Air Act, 1981.
D. Accordingly, an advisory regarding upgradation of Air Pollution Control Devices (APCD) installed by the industry for achievement by MoEF&CC vide notification of revised air emission standards as prescribed no. GSR 376 (E) dated 16.05.2023 vide Board’s letter no. 5433 dated 18.09.2025.
E. The industry was visited by the officer of the Board during surprise visit on 23.09.2025 for sample collection of stack emissions and it was observed that: - The industry was in operation during the visit. The industry has installed (a)boiler @ 12 TPH, (b) boiler @ 6 TPH, (c) thermopac @ 2500 U and (d) thermopac @ 1500 U out of which only boiler @ 12 TPH was operational during the visit. The industry is using pet coke as fuel to the boiler. The industry has installed multi cyclone -> double stage alkali scrubber as APCD to each boiler/thermopac separately. The stack emissions were clean during sampling and 01 no. stack emission samples were collected during the visit and were sent to Zonal Lab, Ludhiana for analysis. As per the analysis report received from Zonal Lab., Ludhiana vide letter endst no 1921 dated 10.10.2025, concentration of SPM is found to be 223 mg/Nm3 and SO2 at 6 % O2 is found to be 669 mg/Nm3. As per the notification of Punjab Pollution Control Board letter no. 26901 dated 27.10.2023, the new prescribed limit of particulate matter emission for boiler of capacity 12 TPH for other than agro based fuel/bagasse is 100 mg/ Nm3 for PM emission and 400 mg/Nm3 for SO2 emission.
As such the industry is not complying with the new emission standards laid by the Board. The industry has obtained NOC for expansion which was valid upto 23.05.2025. Further, the industry has failed to apply for varied consent to operate under Water Act, 1974 and Air Act, 1981.
The industry was not complying and is violating with the provisions of the Water Act, 1974 and the Air Act, 1981.
The matter was considered by the Competent Authority and it has been decided to afford an opportunity of personal hearing before the Chairperson of the Board.
Accordingly, show cause notice for revocation/cancellation of consent to operate under the Water Act, 1974 as amended in 1988 and the Air Act, 1981 as amended in 1987 alongwith notice to issue directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 was issued to the industry with an opportunity of personal hearing before the Chairperson of the Board on 02.12.2025, wherein, it was decided as under:-
1. Consent to operate granted to the industry under the Air (Prevention & Control of Pollution) Act, 1981, shall be cancelled.
2. The industry shall submit Bank Guarantee of Rs. 05 lakhs, within 07 days, as an assurance to upgrade its Air Pollution Control Devices (APCD) and for not emitting black smoke from its stack alongwith following measures to be provided for the abatement of air pollution, within a period of one month: -
i. The upgraded Air Pollution Control Devices (APCDs) shall achieve the revised emission standards as notified by MoEF&CC vide Notification No. GSR 373(E) dated 16.05.2023 and shall be operated regularly & efficiently.
ii. ii. APCD shall be equipped with rotary valve for regular removal of APCD dust and regular removal must be ensured.
iii. APCD shall be provided with the separate electric energy meter and daily record of energy consumed shall be maintained.
iv. CCTV cameras shall be installed focusing towards the boiler stack and fuel feeding for self-monitoring of emissions and maintain 30 days footage as part of compliance records within one month. The CCTV cameras to be monitored regularly by the industry through in-house mechanism to be developed by the industry.
v. Mechanized fuel feeding system shall be provided and to be operated regularly.
vi. Only authorized fuel for which consent has been granted is to be used. vii. Fuel should not be moistured or wet. For that, quality of fuel shall be monitored regularly and a covered shed should be provided for fuel storage. viii. The industry shall carry out scientific storage and handling of boiler ash by making proper and covered arrangements to avoid its dispersion into atmosphere and prevent dust emissions.
3. The industry shall apply for obtaining consent to operate under the Air (Prevention & Control of Pollution) Act, 1981, within 15 days, in view of decision no. 01.
4. Environment Engineer, Regional Office-4, Ludhiana shall verify contentions of the industry, submit compliance with respect to the decisions as per the timelines given above and process consent applications on merit.
To check the compliance of the proceedings issued by the competent authority, the industry was again visited by Er. Gurwinder Kaur, AEE on 30.12.2025 and it was observed as under: -
1. The industry was not in operation during visit due to maintenance of Boilers, which was ongoing during visit.
2. The industry has installed. 02 Boilers of capacity 12T and 6T each and has also installed 2 Thermopac of capacity 1500 U & 2500 U with twins cyclone and wet scrubber as APCD.
3. The industry has provided separate energy meter for each boiler & thermopac. The industry representative informed that the industry is operating Boiler of capacity 12T & thermopac of capacity 2500 U and other two units are standby. The industry has started maintaining record of energy meter installed at various APCD units on regular basis.
4. The industry has installed CCTV at the requisite places, as conveyed during their personal hearing.
5. The industry is using pet coke as fuel in boilers thermopac installed. No separate storage room has been provided for fuel storage. The fuel is being stored in the boilers area along with ash generated which are reused as fuel. However, during the visit, the industry representative informed that the industry is approaching the concerned company for installing a fabricated storage room for fuel storage.
6. The industry has installed rotary valves with all the APCDs wherever feasible and the same were in working condition.
7. The industry has installed 2 DG set of capacity 380 KVA each with canopy and adequate stack height.
8. The industry is discharged domestic effluent and trade effluent in PDA dedicated sewer line. The industry has obtained 2000 KLD shares with PDA (CETP 40 MLD) for treatment of effluent generated.
9. The industry has deposited bank guarantee amounting to Rs. 1,00,000/- valid upto 02.01.2027.
Now, the industry has applied CTO application under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS.
The industry has already deposited fee of amounting Rs. 283400/- vide UTR no 738066122 dated 18.04.2023 and Rs. 11040/- vide R.no. 232185800 dated 28.05.2023 under the Water Act,1974 and has already deposited fee of amounting Rs. 118400/- Vide R. No. 750289205 dated 02.09.2021 under the Air Act ,1981.
The industry has already deposited fee of amounting Rs. 378500/- vide R.no. PSIBR22025112000740184 dated 20.11.2025 under the Water Act, 1974 and Rs. 427200/- vide R.no. PSIBR22025112000731492 dated 20.11.2025 under the Air Act, 1981 which is adequate upto 31.03.2033 (after deducting late penalty and NOC Regularization fees) against the gross fixed assets of Rs. 4147.91 Lacs and Plant & Machinery of Rs. 3329.15 Lacs as per CA certificate dated 19.11.2025.
The industry was recently visited by the surprise team comprising of Er. Amritpal Singh Chahal, EE, RO-4, Er. Nitish Pushkarna, AEE, RO-1 and Sh. Mamta from Zonal Lab, Ludhiana on 30.01.2026 for stack emission sampling.
1. Stack emission samples were collected from stack of boiler @12 TPH and stack of thermopac @2500U and as per analysis report received from Zonal Lab, Ludhiana the concentration of particulate matter is found to be 201 mg/Nm3 and 129 mg/Nm3 respectively and concentration of SO2 were found to be 417 mg/Nm3 and 367 mg/Nm3 respectively. The results are found beyond prescribed limit. (Report attached).
2. The industry has installed 18 soft flow machines of capacities 04 no. 600 kg, 02 no. 500 kg, 09 no. 300 kg, 02 no. 200 kg and 03 no. 50 Kg, 02 no. Long jet machine of capacity @ 200 Kg, 01 no. u jet machine of capacity @ 150 Kg, 11 no. jigger machine of capacities @ 10 no. 200 kg and 01 no. 300 kg, 01 no. mursrizer machine, 01 CVR Machine, 01 CPV machine and 04 no. garment washing machine of capacities @ 02 no. 200 kg and 02 no. 100 kg. 3. The industry has submitted a letter from Lal Ghai & Associates (PDA) wherein it has been mentioned that the industry is their member and the industry has paid full and final amount equivalent to 2000 KLD of CETP discharge and also joined the CETP and discharging their effluent through the conveyance system dedicated to CETP 40 MLD. The industry has also submitted letter from PDA regarding opening of demat account and has got transferred all the shares into the demat account.

As such, the industry is not complying with the provisions of the Air (Prevention & Control of Pollution) Act, 1981.
Keeping in view of above, it is recommended that SCN for violation of the provision of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the industry along with an opportunity of personal hearing before the Competent Authority of the Board.
