It is submitted that the project proponent was granted Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 vide no. CTOW/Varied/SAS/2025/28042993 dated 11.03.2025, valid till 31.03.2025 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/SAS/2025/28042984 dated 11.03.2025, valid till 31.03.2025 with special conditions:
1. The industry shall submit revised approved building plan for the project i.e. M/s P.K. Enterprises including new addition of area (i.e. M/s Precise Micro Heat Treaters) under Factories Act,1948, within 01 month.
2. The industry shall submit an extended copy of rent agreement within 01 month.

Now, the project proponent has applied varied Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as per new categorization 101.4 Heat treatment with any of the new technology like ultrasound probe, induction hardening, ionization beam, gas carburizing etc.

Fee Details
The project proponent submitted CA certificate with the value of fixed assets of Rs. 4.29 crore. As per record of this office, the consent fee was valid till 30.06.2027 under both acts. Now, the project proponent has deposited Rs. 4925/- vide no. 943713381 dated 30.12.2025 under Water Act, 1974 and Rs. 4200/- vide R no. 510999621 dated 30.12.2025 under Air Act, 1981, which is adequate till 31.12.2027.
Documents – Udyam Registration, lease agreement, Site plan
The industry has submitted the Udyam Registration Certificate issued by the Ministry of MSME dated 20.06.2021 for manufacture of parts and accessories for motor vehicles. The industry has submitted a copy of the building plan approved by the competent person Er. Rajnish Kumar Singla under Director of Factories Act on 20.08.2022.
The industry has submitted lease agreement executed on 25.03.2025 between Mrs. Raveena Suri and M/s PK Enterprises, which is adequate till 31.03.2030.
The project proponent has submitted approved layout plan issued by the competent person under Factory Act.
Manufacturing process
The industry has submitted its manufacturing process chart, which is as under:

Visit
The site was visited by the undersigned on 27.02.2026 and contacted Sh. Nitesh, representative of the industry (87551-88502). During visit it was observed as under:
1. The industry is engaged in manufacturing of auto/ tractor parts and was in operation.
2. The industry has installed 01 band jaw cutter, 04 no. gathering machine, 03 induction hardening (02 currently operational), 01 forging press, 05 CNC, 02 VMC machine, 2 no. electric furnace, one quenching tank of capacity 10000lts capacity and 3 tempering furnace based on electricity in its premises. However, at the time of visit lot of fumes were observed from one of the furnace.
3. The industry has installed 3 no. of cooling towers. During visit leakage was observed from the one of the cooling towers. During the servicing and maintenance of the cooling tower the used process water is sent to pan evaporator manually. However, during visit, the pan evaporator was not in operation and was in a very bad condition.
4. The project proponent has not maintained any record of the operation of the pan evaporator.
5. Source of freshwater is MC supply with water meter installed on the pipeline. The water is stored in separate tank from where it is used further in the process in cooling towers. The project proponent has been advised to install water meter on the process line.
6. Domestic effluent generated is being directly discharged in MC Sewer.
7. The industry has installed 01 DG set of capacity 82.5 KVA, which is equipped with canopy and stack of adequate height.
8. During visit one no. pit was found which was filled with mixture of oil & water and provided permanent motor with flexible pipe in the pit to discharge the wastewater outside the premises into the MC sewer.
9. Housekeeping of the industry was very poor.
10. No separate room was provided for storage of hazardous waste.
11. The project proponent has provided one no. of lab for testing hardening of manufactured parts.
From above, it is clear that the industry is violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations: -
In view of the above-mentioned violations, the application of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused with opportunity of personal hearing.
