File Note: It is submitted that the Project Proponent has applied for Consent to Operate (CTO) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for mining of ordinary earth under the orange category i.e. 2.2 - Standalone mining lease area up to five hectares in areas (not a part of any cluster mining). The present application pertains to mining of 1,30,284 TPA of sand. The project proponent has deposited consent fee of Rs. 42000/- vide e-R no. 273682699 dated 26/02/2026 under Water act and Rs. 42000/- vide e-R no. 696976532 dated 26/02/2026 under Air Act, which is adequate for a period of five years i.e. upto 30/06/2030 under both acts, as per Board's office order dated 29/10/2018 after deducting NOC regularization fee. The project proponent has submitted the following documents along with the application: 1. Approved Mining Plan issued by the Mining Officer, Department of Mines & Geology, Water Resources Department, Chandigarh vide letter No. Glg/Pb/M.P./Chakli Kasab/368 dated 11.12.2025, valid up to 10.12.2030. 2. Environmental Clearance (EC) granted under the provisions of the EIA Notification, 2006 vide letter dated 18.02.2026, wherein the project has been categorized under Category B2 for mining of minerals with a capacity of 1,30,284 TPA over an area of 4.70 Ha (Khasra no. 17//4, 5/1, 8//16/2, 17/2, 18/2, 24 25, 8//6/1/1, 15/2, 16//11/1, 16,17, 19, 20, 22, 23, 24, 25/1, 9//11on River Bed Mining site upto a depth of 3.0 m. 3. Project report. 4. Environment Management Plan 5. District survey report 6. Site plan of the mining area. 7. Mining flow chart. 8. Land ownership documents along with fard. It is pertinent to mention that as per the approved Mining Plan and Environmental Clearance, the site has been permitted for mining of 1,30,284 TPA of on River Bed Mining site upto a depth of 3.0 m and the said approvals are valid up to 17.02.2033. In reference to the present application, the site was visited by the undersigned on 05.03.2026, and the following observations were recorded: 1. The land at the site was found vacant, and no mining activity was observed at the time of visit. 2. No excavation machinery or mineral storage was observed at the site. 3. The site boundaries were generally identifiable as per the submitted site plan. 4. Permanent pillar marking of the mining lease area had not been carried out at site at the time of visit, and the project proponent was guided to undertake permanent pillar marking before commencement of mining operations. 5. No habitation was observed in close proximity to the mining area. 6. As per the Environment Clearance condition, the Project Proponent has not submitted NOC from Forest Department regarding applicability of PLPA, 1900. 7. The Project Proponent has submitted AEA (Afforestation and Environmental Amelioration) plan and EMP plan stating that 1551 saplings shall be planted and Rs. 6.16 is proposed by him in five years. In view of the above, it is recommended that Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for mining of minor minerals upto 30.06.2026 subject to compliance of all general conditions and the following special conditions: 1. The Project Proponent will not extract additional quantity over 1,30,284 TPA till credible replenishment study data is submitted by the Mining Department and approved by SEIAA. 2. The Project Proponent shall submit NOC from Forest Department regarding applicability of PLPA, 1900. 3. The project proponent shall carry out mining as per letter issued by the State Environment Impact Assessment Authority (SEIAA) vide file no. 2026/EC/F/395 dated 18.02.2026. 4. The project proponent shall comply with the all the terms & conditions mentioned in the provisional acceptance letter issued by the Executive Engineer –cum– District Mining Officer, Ludhiana vide no. Glg/Pb/M.P./Chakli Kasab/368 dated 11.12.2025. 5. The industry shall earmark the boundary properly before starting mining activity at the site. 6. The Project proponent will carry out mining process is open cast, semi mechanized, without drilling and blast. 7. The contractor shall maintain the computerized record of daily mining/ lifting of sand at site. 8. The project proponent shall not carry out mining beyond the allotted area, if the industry found illegal mining beyond the area then consent to operate under Water (Prevention & Control of Pollution) Act, 1974 &the Air (Prevention & Control of Pollution) Act, 1981 will be revoked without any notice. 9. The project proponent shall obtain necessary clearance / permission from the other Departments, if required, on its own level. 10. The project proponent shall strictly comply with all the terms and conditions stipulated in the Environmental Clearance dated 18.02.2026 and the approved Mining Plan. 11. Permanent pillar marking of the mining lease area shall be carried out before commencement of mining operations, as per the approved Mining Plan and directions of the Mining Department. 12. Mining activity shall be carried out strictly within the approved lease area, quantity, and depth as permitted. 13. Adequate dust suppression measures such as regular water sprinkling shall be ensured during mining and transportation activities. 14. No mining activity shall be undertaken without valid Consent to Operate from the Board. 15. Records pertaining to quantity of mineral excavated and transported shall be maintained and produced to the Board as and when required. 16. The Project Proponent shall submit correct value of plantation in EMP report as Rs. 6.16 is being mentioned. (Competency: Environmental Engineer)
