File Note: It is submitted that the industry is engaged in the manufacturing of MIG Welding Wire @ 3 TPD using 5.5 mm Wire rod @ 3 TPD, Powder/wire lubricant @ 5 Kgs/day, Wet lubricant @ 6 Kgs/day, Sulphuric Acid @ 450 Liter/day as raw material. A complaint was received telephonically from Village Gehle regarding a wire manufacturing unit discharging acidic effluent onto open land, causing stagnation. The site of the industry was visited by the officers of the Board on 18.12.2025 after taking permission from worthy Member Secretary. During the visit, it was observed that as under: 1. The industry namely M/s Vee Aar Industries, Village Gehle, District Mansa, is engaged in the drawing of wires which was found in operation without obtaining CTE/NOC or Consents to Operate of Board 2. The industry was using H2SO4 as a cleaning agent. 3. The effluent generated from the manufacturing process is being discharged directly onto land without any treatment, resulting in water stagnation. 4. The industry is violating the provision of the Water Act, 1974 knowing and deliberately. In view of the above, it is clear that the industry is violating the provisions of the Water (Prevention and Control of Pollution) Act. Whereas, the Hon’ble Supreme Court of India in Parivahan Suraksha Samiti & Anr. vs. Union of India & Ors. has upheld the powers of Pollution Control Boards to take coercive measures, including disconnection of electricity and water supply, to enforce compliance with environmental laws. The Board has issued Directions u/s 33-A of the Water Act, 1974 to the industry vide no. 110 dated 14.01.2026 in which the following decision were taken: 1. That the industry shall close down its operations, not to operate the unit and dismantle and remove all outlets and stop forthwith discharging its wastewater onto land or through any other mode. 2. That the industry shall not restart any process unless all necessary water control measures are taken and concentration of various pollutants in its treated trade effluent conforms to the standards laid down by the Board for such type of discharges. 3. That the Industry shall not restart until it obtains consent of the Board u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974. 4. That the Punjab State Power Corporation Limited authorities shall disconnect the supply of electricity available to the industry. 5. That the machinery & DG set installed by the industry be sealed, immediately. The Board has also issued Direction’s u/s 33-A of the Water Act, 1974 to the PSPCL vide no. 112 dated 14.01.2026 to disconnect the supply of electricity to the industry. Thereafter, this office vide letter no. 127 dated 19.01.2026 also issued the letter in reference of the directions for disconnection of electricity. Now, the industry has applied for fresh Consent to Operate under the Water Act, 1974 and Air Act, 1981 manufacturing of MIG Welding Wire @ 3 TPD using 5.5 mm Wire rod @ 3 TPD, Powder/wire lubricant @ 5 Kgs/day, Wet lubricant @ 6 Kgs/day, Sulphuric Acid @ 450 Liter/day as raw material through OCMMS for operation of under the red category as per the prevailing policy. The details of the case are as under: • The industry has submitted the electricity bill as proof of commissioning i.e., 30.05.2025. • The industry has submitted the CA certificate dated 17.02.2026 reflecting the value of fixed assets as 185 lakhs. The industry has deposited consent fee of Rs. 32400/- vide Receipt No. 887294076 dated 17.02.2026 under the Water Act, 1974 and Rs. 43,200/- (including 10800/- as NOC fees) vide Receipt No. 821098392 dated 17.02.2026 under the Air Act, 1981, which is adequate for a period upto 31.03.2028 • The industry has submitted the copy of CLU duly approved by Senior Town Planner, Patiala vide no. 1743 – STP(P) SP-327 dated 02.07.2021 as pe which the site falls in Industrial Land Use Zone of Notified Master Plan, Mansa. As per Zoning Regulations of Master Plan, Mansa this unit is permissible in this Land Use Zone. • The industry has submitted the approved building plan from Er. Lokinder Bansal, Competent person, approved under Punjab Factories Act. • The industry has submitted the copy of agreement dated 04.02.2026 valid upto 27.05.2026 with M/S Fertichem Plant Shakti Agro Pvt Ltd, Village- Raiyan, Ludhiana which is authorized form PPCB vide no. HWM/RENEW/LDH/2021/15185022 From Dated 28/05/2021 to 27/05/2026 for lifting of @ 20000 ltr./month waste pickling liquid generated from the industry. • The industry has submitted the feasibility report as which the industry has proposed wet scrubber as APCD and also submitted the invoice for the same. • The industry has submitted the invoice of the Air Pollution Control Devices vide no. ATE/PI/APCD/25-26/94 dated 25.02.2026. The site of the industry was visited by Er. Harmanpreet Singh, AEE on 03.03.2026 and it was observed as under: 1. The industry was not in operation due to technical failure but the supply of electricity to the industry was intact. 2. The industry has installed Wire drawing > Pickling > Copper Coting > Layer Winding unit its premise. 3. The industry is using sulphuric acid as a cleaning agent and the effluent generated form the same is collected in pacca underground tank of capacity @ 26000 litre. 4. The effluent is generated from pickling of wire and has made agreement with M/S Fertichem Plant Shakti Agro Pvt Ltd, Village- Raiyan, Ludhiana for the lifting of waste water generated due to pickling of wires. 5. The industry was installing the wet scrubber as APCD along with adequate stack height to control the fumes generated during the process. From the above, it is clear that the industry is complying with direction issued to the industry except Sr. no. 1. In view of above, it is recommended that: 1. The direction u/s 33-A may be issued to the industry for its operation for a period of 6 months. 2. The directions u/s 33-A may be issued to the PSPCL for temporary restoration of supply of electricity to the industry for a period of 6 months. 3. The Consents to Operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for manufacturing of MIG Welding Wire @ 3 TPD using 5.5 mm Wire rod @ 3 TPD, Powder/wire lubricant @ 5 Kgs/day, Wet lubricant @ 6 Kgs/day, Sulphuric Acid @ 450 Litre/day as raw material for a period of 6 months with suitable condition as under: 1. The industry shall install adequate water meters and energy meters to monitor water consumption and effluent generation. The industry shall maintain proper logbooks/records of the same and submit monthly reports to the Regional Office, Bathinda regularly. The point wise Compliance of the direction issued to the industry is attached enclosed herewith. Competency: 1. Senior Environmental Engineer (Red/Small) 2.
