File Note: Sir, the matter was discussed with record file. 1.0 The Industry was issued direction u/s 33-A for closure for its operation without consent of the Board and disconnection of electricity was ordered vide zonal office letter no. 2967 dated 25.04.2013. 2.0 Thereafter, the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. ZO-II/LDH/RO-III/WPC/2013/F-1061 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. ZO-II/LDH/RO-III/APC/2013/F-938 dated 26.08.2013, which were valid up to 25.02.2014 & Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the PSPCL vide Zonal office-II, Ludhiana letter no. 5638 dated 29.08.2013 with the directions to restore the electric supply of the industry temporary for further six months i.e. up to 28.02.2014. 3.0 In the meantime the amusement park was visited by the officers of the Board on 21.02.2014 and collected the effluent sample from the final outlet of STP and as per analysis report various parameters are within the prescribed limits of the Board. The detailed report was sent to Zonal office-II, Ludhiana vide this office letter no. 777 dated 14.05.2014 in which it was observed that industry was operating without consent of the Board. Thereafter, show cause notice for the violation of the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry along with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal office-II, Ludhiana on 04.06.2014. 4.0 Thereafter the Industry was granted consent to operate under both acts for six months and electricity connection was restored up to 12.01.2017 vide zonal office-2 letter no. 5017 dated 13.07.2016. In the meantime, samples were collected from STP on 16.08.2016 and same were found to be compliant. The samples were again collected on 24.11.2026 and same were found to be non-compliant 5.0 Thereafter, Industry again applied for consent to operate was issued proceedings vide zonal office-2 letter no. 672 dated 08.02.2017, in which resampling was directed, and accordingly samples were collected on 21.02.2017 and same were found to be compliant in all parameters except Oil & Grease (11 mg/l vs. 10 mg/l). Then, Industry was issued Consent to operate under both acts and six months electric connection restoration valid up to 27.08.2017 issued vide zonal office-2 letter no. 1037 dated 02.03.2017. In the meantime, samples were collected on 06.06.2017, 21.08.2017and same were found to be compliant 6.0 Thereafter, Industry was granted Consent to operate under both acts and temporary restoration was extended up to 01.05.2018 vide zonal office-2 letter no. 519 dated 28.05.2018. Meanwhile, samples collected on 06.04.2018 failed to meet prescribed standards consequently proceedings were issued against the unit vide zonal office-2 letter no. 3609 dated 17.07.2018. Also samples were collected on 21.08.2018 and same were found to be non-complying and industry was issued proceedings vide zonal office-2 letter no. 2149 dated 18.04.2019. The decisions of personal hearing were as under :- • The consent to operate under the Water Act, 1974 and Air Act 1981 be granted to the industry for one year. • Case regarding restoration of electric connection temporarily for a period of 6 months be forwarded to the Competent Authority for consideration. • The industry will make an agreement for disposal of Municipal Solid Waste with an authorized agency within 15 days and Regional Office to check the compliance within the stipulated time period. Thereafter, the industry was granted consent to operate under Water Act vide CTOW/Renewal/LDH3/2019/8205338 and under Air Act, 1981 vide CTOW/Renewal/LDH3/2019/8205341 dated 29.04.2019 both valid up to 28.04.2020 and the directions u/s 33-A of Water Act for temporary restoration of electricity supply for six months vide letter No. 3585 dated 19.06.2019. 7.0 Thereafter, details of CTOs renewed by the industry are as given below:- • CTOW/Renewal/LDH3/2020/12581981 dated 30.06.2020 and CTOA/Renewal/LDH3/2020/12581992 dated 09.07.2020 both valid up to 29.12.2020. • CTOA/Renewal/LDH3/2022/17937016 and CTOW/Renewal/LDH3/2022/17937009 both dated 06.04.2022 valid up to 05.10.2022. • CTOA/Renewal/LDH3/2022/19846067 and CTOW/Renewal/LDH3/2022/19846064 Both. dated 12/10/2022 valid up to 11/04/2023. • CTOA/Renewal/LDH3/2023/21417502 and CTOW/Renewal/LDH3/2023/21417496 both dated 22.05.2023 valid up to 31.07.2023. • CTOW/Fresh/LDH3/2025/27953384 dated 25.03.2025 valid up to 24.09.2025 and CTOA/Fresh/LDH3/2025/27953386 dated 19.03.2025 valid up to 18.09.2025. Also, the electric connection of the resort was temporarily restored vide letter No. 2150 dt 07.04.2022, No. 6263 dt 12.10.2022, No. 2343 dt 22.05.2023 and No. 1972 dated 25.03.2025. 8.0 As per record, last samples were collected on 14.09.2022 and same was found to be compliant. Hence, during the last 12 years, 9 samples have been taken and unit has passed 5 of them (including last sample on 14.09.2022). Originally the disconnection was issued due to operation without consent of the Board and thereafter, industry has been granted consent number of times. 8.0 The Industry’s last sample on 14.09.2022 was compliant however prior to that sample failed to meet the standards. 9.0 In view of the above, it is recommended that:- 1. Renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for further six months with usual conditions. 2. The directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 may be issued to restore the electric connection of the industry temporarily for further six months. 3.0 Also, permission be granted to take two recurring samples so that compliance can be ensured as temporary restoration is been going on for last 12 years.
