File Note: Discussed. It is submitted that there is no such circular or any policy to ask the industry to submit the copy of agreement with CETP at the time of obtaining CTE. However, the purpose of taking the agreement at the time of CTE is to ensure that the industry shall not face any problem in future w.r.t lifting of effluent. As the CETP at Chanalon is in process of making agreements with different industries for treatment of effluent and it is quite possible that in future, the capacity of CETP might get exhausted and the CETP may not able to handle the additional effluent of the industry. Thus, the thought process was to make sure that the industry shall not face any problem in future regarding lifting of effluent to the CETP operator… But the industry is in present case has submitted that the agreement has been executed between the industry and CETP operator on 10/02/2026 for lifting of effluent @ 45 Kl/month (1.5 KLD) and further requested that they will obtain the partial consents to operate for above said effluent once the CTE is granted. But if the industry intends to operate on full capacity in future, then a condition can be imposed to the effect in the CTE that the industry shall submit the revised agreement from the CETP operator for enhanced capacity of effluent to be lifted at the time of obtaining fresh consents to operate under both the Acts intending to operate on full capacity. In case, the CETP operator denies the permission to handle additional effluent in future then the industry shall operate its unit on partial capacity and Board shall not be liable for any financial liability arising from grant of CTE…. In light of the above report/ recommendations given by Regional Office, may if approved, Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Fabricated Steel Structures & Hot Dip Galvanized Products @ 28000 MT/year by using Angles/Channels/ Beams/Plates /Sheets @ 30000 MT/Year, Zinc @ 560 MT/Year & Hydro Chloric Acid @ 210 Kl/Year may be granted to the industry upto 01/01/2027 ( adequacy of NOC fee) with suitable conditions and additional conditions as proposed by Regional Office+ additional condition that the industry shall submit the revised agreement from the CETP operator for enhanced capacity of effluent to be lifted at the time of obtaining fresh consents to operate under both the Acts intending to operate on full capacity.
