File Note: Subject: Application for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 - M/s Elysian, Building no. 18, Ground Floor, J.P. Tower, Punjabi Bagh Road, Distt. Patiala. It is submitted that the restaurant is a small scale GREEN category unit and was established without obtaining consent to establish of the Board. Now, the restaurant has applied for fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for operation of restaurant of capacity 70 persons at J.P. Tower, Punjabi Bagh Road, Distt. Patiala along with documents i.e. application form, CA certificate, lease agreement land, proprietorship, Commercial building plan for MC certificate etc. under green category i.e. Restaurants/ Dhabas/ Eateries with minimum seating capacity of 36. The establishment has deposited fees as under Rs. 29290/- (Rs. 29000/- as water consent fee and Rs. 290/- 10% penalty fee) vide UTR no. 841197933 dated 19.02.2026 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 32190/- (Rs. 29000/- as air consent fee, Rs. 290/- 10% penalty fee and Rs. 2900/- as NOC regularization fee) vide UTR no. 149421055 dated 19.02.2026 under the Air (Prevention & Control of Pollution) Act, 1981, which is valid upto 30.09.2035 (after consideration as of commissioning as 11.10.2025 as per documents submitted, against the value of fixed assets of Rs. 68.26 lakh as on 05.01.2026 as per CA certificate dated 12.01.2026 submitted by the establishment. It is pertinent to mention here that the proposed site of the project falls within MC limit of Patiala and Board vide its notification no. 271 dated 10/10/2011 as laid down following siting guidelines for setting up of Hotel / Restaurant / Banquet Hall / Marriage Palace: “The project proponent shall be allowed to set up of Hotel / Motel/ Inn / Lodge/ Guest House / Restaurant / Banquet Hall / Marriage Palace within MC limits, in case, the project proponent submits a certificate issued by the concerned Municipal Corporation / Municipal Council / Nagar Panchayat / Notified Area committee to the effect that the site is suitable as per the statutory / non-statutory Master Plan and their bye-laws and / or submits building plan duly approved by the said authorities.” In compliance to the above, the project proponent has submitted approved map from MC, Patiala dated 30.01.2025. The establishment was visited by the AEE of this office on 18.03.2026 and contacted Sh. Tarish Gupta, Partner of the hotel. During visit, it was observed as under: 1. The establishment is a restaurant & was found in operation. 2. The establishment has provided restaurant at ground floor having capacity of 70 persons. 3. The establishment has provided kitchen at ground floor, where waste water from washing is being discharged into MC sewer after passing through oil & grease trap. 4. The establishment has provided suction hood followed by ducting to capture emission from LPG cooking hob & tandoor bhathi. 5. The establishment has provided 1 D.G set of capacity 125 KVA, equipped with canopy and stack of adequate height. Moreover, the Hon’ble NGT while disposing of the matter of O.A. no. 400/2017 titled as Westend Green Society V/s UOI and others has passed orders dated 4/2/2021 and the relevant part of which is reproduced as under: ”ETPs need to be installed by all the big units, not connected to the sewer line.” However, the subject cited establishment is a Small Scale restaurant and has provided screen bars followed by oil & grease trap for treatment of kitchen wastewater and is connected with terminal STP of Patiala. In view of above, it is found that the establishment is complying with the guidelines for control and enforcement of environmental norms as notified by Board’s circular no. 64 dated 2/2/2021. Therefore, keeping in view of above mentioned facts and submissions made by the project proponent, it is recommended that project proponent may be granted fresh consent under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 up to 30.09.2035 under green category for operation of restaurant of capacity 70 persons with usual conditions and special conditions that: - 1. The project proponent shall get its effluent samples analyzed from Board’s / Board’s approved lab in compliance to the Board’s office order dated 10/10/2011. 2. The project proponent shall maintain the record of water meter on the source of its fresh water. 3. The project proponent shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA), issued for the abstraction of ground water from time to time. 4. The project proponent shall not use any unauthorized mode for disposal of treated/untreated wastewater. 5. The project proponent shall regularly get cleaned the oil & grease trap, so that the wastewater can be effectively treated in the septic tank and the Oil & Grease so removed shall be disposed of in an environmentally sound manner. 6. The adequacy & efficacy of the waste water treatment system will be the entire responsibility of the establishment.
