Subject: Application for obtaining fresh Consent to Establish (NOC) under the Water Act, 1974 and Air Act, 1981 – M/s R S Enclave, Vill. Sanour, Near Devigarh Road, Distt. Patiala.

It is submitted that the subject cited establishment is a proposed residential and commercial plotting colony and Project Proponent has applied for obtaining consent to establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 by the name and style of M/s R S Enclave, Revenue area of Vill. Sanour, Near Devigarh Road, Distt. Patiala.
As per application form
The total project is having total area of 38445.1 sqm (45980 Gaj or 9.50 acres) and is proposed to have 183 no. residential plots and 45 nos. Commercial Plots having area of 38445.1 sqm (9.50 acres).
CLU/LOI and License for setting up a affordable residential colony
The owner of M/s R S Encalve has obtained Regarding issuance of provisional certificate to an unauthorized colony named RS Enclave in 45980 square yards within the limits of Nagar Council, Sanor on an area of 38445.1 sqm (9.50 acres) at Vill. Sanour, Near Devigarh Road, Distt. Patiala from the O/o Additional Deputy Commissioner (Urban Development) Patiala vide letter no. 5242 dated 18.7.2023.
Approved Layout Plan
The project proponent has submitted copy of approved layout plan for the residential colony and commercial area as approved by Additional Deputy Commissioner (UD), Patiala vide letter no. 5350 dated 20.07.2023 showing the location of STP and proposed green area to be developed.
NOC Fee:
The project proponent has deposited fees of Rs. 10800/- vide UTR No. 775356619 dated 07.10.2025 as NOC fee against the project cost of Rs. 216.0 lakh, which is adequate for one year under Orange category.
Water Pollution
As per the feasibility report submitted by the project proponent, the total fresh water demand will be around 385 KLD and there will be generation of 308.16 KLD (172 KLD will be discharged onto land for plantation after treated through STP, 130 KLD Flushing requirement recycled in the colony by providing Dual Plumbing line system) of wastewater and 6.16 KLD sludge of 2% from STP.
The project proponent has proposed to install STP of capacity 350 KLD (MBBR technology) consisting of Primary Treatment (Screen Chamber, Oil & Grease Chamber, Sewage collection tank) Secondary or Biological Treatment (MBBR Reactor I & II, Secondary Tube Settler) Tertiary Treatment (Filter feed Tank, Pressure sand Filter, Activated Carbon Filter, and Hypo Dosing System) Sludge Handling System (Sludge drying beds or Sludge Dewatering Machine) Treated Water to be used for Gardening.
As per the proposal, total requirement of the fresh water is 385 KLD and there will be generation of wastewater to the tune of 172.0 onto adjacent irrigation land 3 acres.
Air pollution
The project proponent has proposed 1 no. D.G set of capacity 125 KVA with canopy and stack of adequate height.
Solid Waste
Non-liquid domestic refuse (commonly known as municipal solid waste – MSW) will be generated by the complex. Average quantity of this waste will be @ 0.3 kg/capita/day from residential facility and 0.2 kg/capita/day for commercial/floating population) will be generated from the project. Thus, about 929 kg/day of MSW will be produced by the township.
As per the proposal, the Management of solid waste includes as under:-
Bio degradable or wet waste - Will be converted into manure using Mechanical composter of capacity 492 Kg/day.
Non- Biodegradable or dry waste - Will be Handed over to authorized recycler @ 418 Kgs/day as per SWM rules, 2016.
Domestic Hazardous Waste - Will be disposed off to authorized vendor @ 19 kgs/day as per Solid Waste Management Rules, 2016.
Visit Report
The proposed site of the residential-cum-commercial project was visited by the undersigned on 31.10.2025. During visit, it was observed as under:
1. The proposed site falls in the revenue estate of Vill. Sanour, Near Devigarh Road, Distt. Patiala.
2. The project proponent has partially demarcated the boundaries of the proposed project site.
3. No construction activity pertaining to the project has been started. As per the boundaries of the site shown by the representative during visit, there is no air polluting industry falls within a radius of 100 m from the boundary of the project site and there is no MAH industry within a radius of 250 m radius from the boundary of the proposed site.
Moreover, as per Department of Science, Technology & Environment and Non- Conventional Energy, Govt. of Punjab vide order no. 3/6/07/STE(4)/3770 dated 30/10/2009, the statutory master plan has been notified under the Punjab Regional and Town Planning and Development Act, 1995 (Amended) 2006, mixed land use or any other development/ construction which comes up as per the earmarked zone, in case of new residential/ commercial, there is no need to keep any additional distance from the existing industry from the environment point of view because these factors have already been considered while earmarking the use of land for different categories in the Master Plan, as per notification no. 6312 dated 11th August, 2009 issued by Department of Housing and Urban Development.
Moreover, the proposed project is a residential and commercial and only plots will be sold by the promoter. Regarding the construction of commercial plots, EWS plots and independent floor, the total area of the project is 9.50 acres with proposed total saleable area 32398 sqr. yards approx., which is very much less than 50 Hectare (120 Acres)/built up area of 1,50,000 sq. mtr. Hence the project does not cover under the ambit of under EIA notification dated 14/9/2006.
The competency for grant of CTE to such units lies with the Senior Environmental Engineer being Small Scale, Orange category unit as per the policy of the Board.
In view of the above, May if approved, recommendations be sent to SEE that the project proponent may be granted consent to establish from pollution angel
for the above said project for one year with suitable conditions as per policy of the Board and some special conditions that:
1. The PP shall be bound to install sewage treatment plant (STP) of adequate capacity for treatment of entire wastewater to be generated from the colony.
2. The PP shall provide adequate plantation area for utilization of treated wastewater onto land for plantation.
3. The PP shall comply with all the terms & conditions approved layout plan for the residential-cum-commercial project as approved by Additional Deputy Commissioner vide letter no. 5350 dated 20.07.2023.
4. The PP shall obtain necessary permissions from the concerned departments.
