• It is submitted that the project proponent has applied for obtaining consent to establish (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 for the establishment of Resort consisting of Hotel-Cum-Banquet Hall-cum Restaurant with 17 rooms and banquet hall of capacity @250 persons in an area of 747.21 sq. m. or 0.1846 acre (approx.) or 29.54 marlas in the Khasra no. 14M/13/1 and 14M/12/1 in the Village Rampura, Tehsil and Distt Fazilka through OCMMS on 24.01.2026…………….
• The project proponent has submitted site plan and building permit/sanction digitally signed by Municipal Council, Fazilka vide File No. PB/FKA/FAZIL/208419. As per the site plan, the total plot area is mentioned as 747.21 sq. m. or 0.1846 acre (approx.) or 29.54 marlas……………..
• The PP has submitted the Vikrinama in which the land ownership is mentioned in the name of partners and PP has also submitted the Tehsildar report confirming the ownership of land in the name of partners……………
• Show cause notice before refusal of consent to establish (NOC) under the provisions of Water Act, 1974 & Air Act, 1981 was issued to the project proponent vide letter no. 480 dated 02.03.2026 along-with an opportunity to show cause to explain his position in writing, within a period of 10 days. The project proponent has submitted reply to the show cause notice.
• Regional office reported as under: -
1. The industry has submitted the revised certificate (NOC) from Municipal Council Fazilka vide no. 9590 dated 19.02.2026 for disposal of treated effluent.........................
2. The industry has submitted that the actual capacity of the banquet hall is only 200 persons and it had calculated water balance considering 250 persons keeping in mind additional safety margin. Hence total water usage will be 13.72 KLD and the maximum average effluent generated will be around 11 KLD. However, in actual, the average effluent generation will always be less than 11 KLD.
3. The industry has proposed coarse bar screen, oil and grease chamber and septic tank arrangement for treatment of domestic effluent and it has submitted that it will be bound to achieve required prescribed standards. If it fails to achieve the standards, it will install upgraded STP to achieve the standards. Further, Marriage Palace generate approx 11 KLD domestic effluent which is very small quantity and also not generated daily because functions are not everyday. The proposed treatment system having coarse bar screen, oil & grease chamber and septic tank which is sufficient for treatment of domestic waste water. The said system remove suspended solids and oil/grease before disposal of the effluent. Also there is no industrial effluent generated from the premises. Therefore installation of full STP is not proposed considering the small quantity of waste water generation. The management will ensure that system is properly maintain and effluent disposal will not cause any pollution problem. Moreover, additional conditions, if necessary, may be imposed by the competent authority for ensuring adequate safeguards...........................
4. The industry has proposed compost pits for treatment of biodegradable waste generated from the premises. The biodegradable waste from kitchen and food activities during functions will be segregated at source and disposed in compost pits developed inside the premises. The compost pits will be made with impervious base and side lining and proper arrangement for leachate collection so that it do not seep into the soil. Adequate measures like covering of waste with soil/organic material and use of bio culture will be adopted to control odour problem. Pest and vector control will also be done through regular sanitation and other control measures. During peak functions additional bins will be placed for proper segregation and timely removal of waste. The non biodegradable waste will be handover to Municipal Council/authorized agency as per Solid Waste Management Rules, 2016. Moreover, additional conditions, if necessary, may be imposed by the competent authority for ensuring adequate safeguards.............................
5. The industry has submitted that the waste water generated during functions will be collected in a holding tank provided in the premises. The holding tank is proposed with sufficient capacity to store the waste water generated during peak events and functions. The collected waste water will be further passed through the proposed treatment system for proper treatment and disposal. Proper monitoring will be done so that overflow of tank will not happen during operation. In case any problem occurs in treatment system, the waste water will be stored temporary in holding tank till the system become operational again. The management will ensure that proper operation and maintenance of system is done at all time. Moreover, additional conditions, if necessary, may be imposed by the competent authority for ensuring adequate safeguards...........................
In view of the above, if approved, it is recommended that consent to establish (NOC) may be granted to the project proponent under the Water Act, 1974 & the Air Act, 1981 for a period of one year, with suitable conditions alongwith following special conditions: -
1. The project proponent shall ensure that the total built-up area of the project remains below 20,000 sq. m. In case the built-up area exceeds 20,000 sq.m, the project proponent is bound to obtain Environmental Clearance as per the provisions of the EIA Notification dated 14.09.2006.
2. This consent to establish (NOC) is being granted for the establishment of hotel in an area of 747.21 sq. m. or 0.1846 acre (approx.) or 29.54 marlas in only those khasra numbers for which it has obtained CLU from Senior Town Planner, Bathinda vide no. 1119 dt. 25.08.2025.
3. The PP is bound to comply with all the terms and conditions mentioned in the CLU issued by Senior Town Planner, Bathinda vide no. 1119 dt. 25.08.2025.
4. The project proponent shall comply with the zoning regulation of Master Plan as and when notified.
5. The project proponent shall not use fresh water for green belt or plantation within the project premises and shall make adequate arrangements for reuse of treated effluent through dual plumbing for flushing and irrigation of green areas within the premises. Surplus treated effluent, if any, shall be discharged into the Municipal Corporation sewer strictly as per permission granted by MC, Fazilka vide no. 9590 dated 19.02.2026.
6. The project proponent shall ensure reuse of treated wastewater within the project premises through dual plumbing system for flushing purposes and for plantation/green area development. Fresh water shall not be used for green belt or plantation within the project premises.
7. The project proponent shall utilize approximately 3.5 KLD treated wastewater for flushing through dual plumbing and shall ensure that no treated or untreated wastewater is discharged outside the premises without prior approval of the Board.
8. The project proponent shall install STP of adequate capacity in case the treatment capacity i.e. oil & grease trap followed by septic tank as proposed by the project proponent fails to achieve prescribed standards.
9. The project proponent shall not abstract or utilize groundwater for any purpose without obtaining prior permission/NOC from the Central Ground Water Authority (CGWA), Punjab Water Regulation Authority or any other competent authority, as applicable from time to time.
10. The Punjab Pollution Control Board shall not be responsible for any loss (if any) incurred in case the site of the project comes under non-confirming zone of Master Plan to be prepared by the Department of Town & Country Planning Punjab.
11. In case, any of the document submitted by the project proponent found forged or incorrect, the Consent to Establish shall be deemed cancelled and the Board shall not be responsible for any cost incurred by the project proponent in this regard.
12. The project proponent shall develop adequate plantation area within the project premises for disposal of treated effluent as proposed, before commissioning of the project.
13. The project proponent shall utilize all treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling, plantation, parks etc.
14. The project proponent shall not use fresh water in the green area/ plantation area / flushing and shall make adequate arrangements for reuse of treated effluent for gardening / plantation / flushing.
15. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it.
16. The industry shall install water meter at fresh water supply and shall maintain its record on daily basis.
17. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016.
18. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies.
19. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
20. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
21. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required.
