It is submitted that as per decisions of the hearing held before the worthy Chairperson on 9.12.2025, the following decisions were made:
1) The following proposed Direction u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981, is hereby confirmed :
(i) That an environment compensation of suitable amount be imposed on the project proponent.
2) EE, RO, SAS Nagar shall calculate the environmental compensation to be imposed on the project proponent, get it verified from the Committee of the Board consituted to recheck / verify the Environmental Compensation amount and get the orders for imposition of EC issued from the CA of the Board, within 10 days.
3) The unit shall deposit EC in the office of EE, PPCB, RO, SAS nagar for violating the environmental norms, due to damage caused to the environment, for which orders shall be issued by the Board, separately.
4) Additionally, the PP shall furnish a Bank Guarantee amounting to Rs. 50.00 lacs to the RO, SAS Nagar of the Board, within 7 days; as a performance assurance towards compliance with all conditions stipualated in the EC, consent to establish (CTE) and adherence to the prescribed environmental norms under the Water Act, 1974 and Air Act, 1981.
5) The Project shall be revisited surprisingly by a team of officers of the Board, to be constituted by the Competent Authority. The team shall verify the submissions made by the PP during the hearing, undertake a comprehensive inspection of the project and submit a detailed monitoring report with clear and conclusive recommendations.
6) Further action in the matter shall be taken after receipt of report from the team constituted.
It is submitted that compliance has been made to point no. 1 to 4. However, as per decisions no. 5, the site is required to be visited by the team of the officers of the Board. As such, it is requested to direct the team members to provide the details of the visit conducted, so as to process the application on merits, please. |
