It is submitted that project proponent has applied for obtaining fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for operation of shopping complex with same components.
As such, there is no change in the application form and the project proponent is required to apply for renewal of consent to operate. The RO has also clarified that the present application has been filed as fresh CTO due to system limitation (auto-renewal option only).
The Regional Office has also clarified that the application has been filed under the “fresh” category due to system limitations (availability of auto-renewal option only), and not due to any actual change in the project.
In view of the above, the application being in the nature of renewal, does not fall within the purview of consideration at PBIP level.
In view of above, it is recommended that the application is returned to the Regional Office to get the same processed through competent authority of the Board.
