File Note: The point-wise clarification is submitted as under: 1. Regarding revocation of CTO dated 09.04.2025: It is submitted that CTO was revoked as the unit was found operating without valid mining registration, which was cancelled by the Mining Department. The same was in violation of consent conditions. (CTO revocation copy attached herewith). It is further clarified that subsequently directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 were issued to industry for not to operate the stone crusher without obtaining valid consents of the Board vide Zonal Office Letter No. 63 dated 12.01.2026 and to the PSPCL authorities for disconnection of its electric connection vide Zonal Office, Jalandhar letter no. 59-60 dated 12.01.2026 (copy attached) due to operation without Valid consents of the Board. 2. Status of mining registration: The unit does not possess a valid mining registration; however, as per discussion with the officials of the Mining Department, the mining registration will be granted only after the unit obtains valid Consents to Operate (CTOs) from the Punjab Pollution Control Board. 3. Whether consent can be granted without mining registration: It is submitted that as per the policy of the Board, submission of mining registration is not a mandatory requirement. However, the Board requires a confirmation from the Mining Department regarding availability of legal source of raw material. 4. Availability of legal source of raw material: The unit has submitted certificate from Mining Department (Letter No. 400/4 MW dated 27.01.2026) confirming availability of raw material from legal sources. 5. Regarding plantation deficiency: Partial green belt has been developed. However, additional plantation is required along the boundary, which can be ensured through specific condition in CTO within stipulated time. It is further submitted that the unit has already planted additional saplings within the premises, and photographs of the plantation are attached herewith. 6. Compliance of Code of Practice (CoP): As per inspection dated 09.03.2026, the unit was found complying with pollution control measures such as covering of crushers and conveyor belts, water sprinkling system, stabilized roads and dust suppression arrangements. Hence, substantial compliance of CoP is observed, subject to improvement in plantation. 7. Pending enquiry status: As per record, no enquiry/investigation is pending against the unit at present. In view of availability of legal source of raw material and compliance of pollution control measures, it is recommended that: 1. Short Term Consent to Operate under Water Act, 1974 & Air Act, 1981 for a period of six months may be granted to the unit with condition to complete green belt development. 2. Directions to PSPCL for temporary restoration of electric connection may be issued for the said period.
