It is submitted that the industry was granted ‘consent to operate' under the Water Act, 1974 vide no. CTOW/Renewal/LDH1/2025/27796488 Date of issue: 12/03/2025 Date of expiry: 11/03/2026 for Dyeing, Washing & Finishing of Cloth @ T/day 24.
Now, the industry has applied for obtaining renewal of 'consent to operate' under the Water Act, 1974 with requisite documents through OCMMS for the manufacturing of Dyeing, Washing & Finishing of Cloth @ 24 T/day using Dyes and Chemicals@ 300kg/day raw material
The industry was visited by Er. Nitish Pushkarna,AEE on 12.03.2026 and it was observed as under: 1. The industry was in operation during visit. 2. The industry has already submitted letter dated 17.08.2023 issued by PDA that the demat account of the industry is opened and the industry has shares for effluent discharge 1200 KLD. 3. The industry has installed 19 soft flow machines of different capacities. CALCULATION OF POLYESTER CLOTH FOR POLYESTER DYEING: S. The industry has connected its effluent discharge to CETP, Focal Point, Ludhiana line. The industry is discharging its trade effluent @ 1195KLD and domestic effluent@5KLD into dedicated CETP conveyance line . 5. The industry is discharging average effluent @650 KLD( average of January and February 2026) into CETP line and discharge of the industry is within the consented capacity and is within the shares capacity allotted to the industry. 6. The industry has already submitted copy of request letter to Municipal Corporation, Ludhiana for disconnection of its sewer connection. 7. The industry has also installed the flow meter at the outlet to CETP line. 8. The industry has already obtained PWRDA permission for ground water extraction. Applicability of Factories Act, 1948: 9. It is submitted that the subject cited industry is located in the designated industrial zone i.e. Focal Point Ludhiana as per Master Plan of Ludhiana (2007-31). Therefore, there is no requirement of SAC/ Site Clearance u/s 41 (A) of the Factories Act, 1948. 10. The industry has submitted compliance report of previous granted consent in annotated form. The industry has also submitted approved Building Plan. The industry is maintaining record of the flow of trade effluent into CETP conveyance line regularly( record attached for kind perusal) The industry is complying with the special conditions and also the provisions of the Water Act,1974. The industry has existing plot area 4270 sq.yds .There are no specific sitting guidelines for such type of industries. However, the existing as well as proposed area is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana being in Focal Point. Applicability of press note 17: The press note 17 (1984 series was withdrawn by Ministry of Commerce and Industry vide letter no. 2(41)/2018-IL dated 11/09/2019.
It is submitted that a similar matter was processed by ZO-II, Ludhiana to give advice regarding further action to be taken for acceptance/ non- acceptance of consent to operate applications of the member dyeing units of CETP's. As per Legal opinion given by the Senior Law Officer of the Board, Board cannot directly or indirectly restrain the operation of the industrial units. The matter regarding discharge of CETPs of 50, 40 & 15 MLD is pending before the Hon’ble National Green Tribunal vide Appeal no: 40,41& 48 of 2024 respectively and Hon’ble Tribunal has not passed any specific orders regarding restraining the operation of member units viz-a-viz granting ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 to the member units. The Board may grant conditional consents to units if the units are making compliance of conditions of consent granted by the Board. Also as per the directions of the Board given vide letter dated 06.05.2025: No new NOC or NOC for expansion or Varied Consent to Operate for increase in discharge of trade effluent shall be granted to member units connected to CETP except in the cases of scattered units to whom Board has given directions to shift to CETP areas
In view of above, it is recommended that 'Consent to Operate' under Water Act, 1974 may be considered for grant for a short period of 6 months with suitable conditions and special conditions that 1. The consent shall be subject to the final decision of the Hon'ble National Green Tribunal in appeal no. 41 of 2024 titled as Punjab Dyers Association (Focal Point Module) vs Punjab Pollution Control Board and ors.. 2. The industry shall be bound to achieve PETP inlet standards for discharge into CETP as and when prescribed by the Board. 3. The industry shall ensure that Proper records are maintained. 4. There shall be no increase in trade or domestic effluent without prior approval of the Board.(category- Red Small, Competency-SEE)
