It is submitted that the project proponent was earlier granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2025/29667223 dated 25.09.2025 valid upto 24.03.2027 for establishment of commercial project consisting of Hotal having 11 no. rooms, Restaurant having 70 persons capacity, Party Hall having 50 persons capacity with disposal arrangement that the total wastewater generation will be 8.8 KLD will be treated in STP of capacity 10 KLD and after treatment in STP, 3.37 KLD will be reused in flushing purpose and excess will be discharged onto land for plantation to be developed as per Karnal Technology within the project within project(600 sqyard i.e. 501 sqm), subject to certain terms and conditions mentioned therein.
Present:
Now, the project proponent has applied for partial consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for operation of Restaurant having 70 persons capacity & Party Hall having 50 persons (Except Hotel), alongwith requisite documents.
Fee:
The project proponent has deposited Rs. 16800/- vide R. no. 780005198 dated 13.03.2026 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 16800/- vide R. No. 151818335 dated 13.03.2026 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate for 31.10.2028 against the total cost of the project Rs. 198.01 lacs as per latest CA certificate submitted by the project proponent.
Site Suitability:
The project proponent has submitted building permit/ sanction for establishment of hotel building in village Gazipur vide no. PB/SAS/ZIRAK/239410 dated 01.01.2025.
Water Detail:
The project proponent has submitted water calculation detail for which, the partial consent to operate applied and the same is given below:
The project proponent has submitted completion certificate regarding installation of STP of capacity 10 KLD issued by M/s Alliance Enviro Solutions on 28.02.2026.
Visit:
The site of the project was visited by the undersigned on 18.03.2026. During the visit, it was observed that:
1. The project proponent has completed the construction work of restaurant and party hall. The construction work of hotel is under progress.
2. The project proponent has proposed to commission its project 1 April, 2026 (restaurant and banquet hall).
3. The project proponent has installed STP of capacity 10 KLD for the treatment of wastewater generated from the project. The treated effluent is being utilized in flushing and rest onto land for karnal technology in an area of 600 sq.yard and the same is adequate.
4. The project proponent has provided DG set of capacity 125 KVA with canopy and stack off adequate height.
The project proponent is complying with the conditions of the earlier granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of the above, it is recommended that the partial consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent upto 30.09.2028, subject to suitable conditions and following additional conditions that:
1. This consent to operate is valid for operation of restaurant and party hall only.
2. The project proponent shall not carry out any activity in its premises, which can change the category of unit from Green to Orange/Red, without prior permission from PPCB.
3. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
4. The project proponent shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received
5. The Consent is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
6. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
7. The restaurant shall use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
