The industry was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2022/19017591 dated 08/08/2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH2/ 2022/18837957 dated 08/08/2022 both expired on 19/07/2023.
Thereafter, the industry was given personal hearing before the CEE, Ludhiana on 22.10.2024 and after hearing it was decided as under :-
1. The industry shall operate its APCD regularly and efficiently, so as to achieve the prescribed emission standards.
2. The industry shall made the proper arrangement for collection, storage and disposal of Hazardous waste under Hazardous & Other Wastes (Management Handling & Transboundary Movement) Rules, 2016.
3. The industry shall maintain proper record of storage and lifting of hazardous waste under Hazardous & Other Wastes (Management Handling & Transboundary Movement) Rules, 2016.
4. The industry shall install CCTV cameras facing towards stack and make online connectivity for 24x7 surveillance.
5. The industry shall provide separate energy meters with APCD and maintain record of energy consumption for operation of APCD on daily basis.
6. The industry shall submit a Bank Guarantee of Rs. 1.00 lac within 7 days as an assurance for regular operation of APCD, achievement of stack emission standards and for ensuring that no black smoke will be emitted in future.
7. Environmental Engineer, Regional Office-2, Ludhiana shall verify submissions made by the industry and process consent / authorization application on merits.
8. In case of non-compliance of above decisions or repeated violations, the Board reserve the right to take action as deemed fit under the Environmental Laws.
Thereafter, in compliance of the hearing decisions, the site was visited by officer of the Board on 25.06.2025 and during visit it was observed as under :-
1. The industry was in operation at the time of visit and engaged in the manufacturing of M.S. Rounds from billets and ingots.
2. The industry has maintained the record registered for energy consumption of APCD which has cyclone followed by wet scrubber.
3. Hazardous waste was stored in bags, 9 in number and stored in a room, but the record of storage and lifting of hazardous waste was not maintained.
4. There by 23 CCTV Cameras in the industry but none of them was facing towards the stack at the time of the visit.
5. The industry has made an agreement with TSDF Nimbua Green Field (Punjab) Ltd, for hazardous waste handling.
6. The consent to operate of the industry had expired on 19.07.2023.
Now, the industry has applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981 alongwith requisite document. The industry has already deposited Rs. 109800/- e-R No. 411154875 dated 07.03.2026 (Rs. 1,08,000/- water consent & Rs. 1800/- as NOC regularization fee) & Rs. 1,08,000/- e-R No. 798238685 dated 07.03.2026 under Air Act, 1981 as consent fee against the un-depreciated fixed assets of Rs. 1045.56 Lacs as on 31/12/2025 as per CA Certificate dated 08/01/2026, which is adequate upto 31.03.2028 under the both Acts as per Board's Office Order dated 29/10/2018 after deducting 300% penalty charges.
The site of the industry was visited by Er. Dharatveer Singh, AEE of this office on 19.03.2025 and it was observed as under:
1. The industry was in operation during visit.
2. It was engaged in rerolling, forging and painting operation.
3. The industry has installed rolling mill having coal & oil based reverberatory furnace.
4. The industry has installed twin cyclone followed by wet scrubber as APCD. It has maintained record of energy meter of APCD.
5. The industry has installed 3 no. hydraulic hammer with coal fired forging furnace. It has installed 1 no. additional hydraulic hammer which is yet to be made operational. The furnace is without APCD and adequate height, the forging furnaces were being operated without obtaining permission from the Board.
6. The industry has provided hazardous waste room without proper sign Board, without danger sign and HW category code. The door of the HW room was rusted. 12 HDPE bags containing APCD dust were found stored in site. The industry has not maintained register of hazardous waste and no manifest regarding lifting of hazardous waste provided during the visit. Empty paint containers were found lying in the open.
7. The domestic effluent discharge into public sewer. Cooling water is being re-circulated.
8. As per hearing decisions no. 4 the industry has provided CCTV camera facing towards the chimney but the view of outlet of the stack is not covered by the camera.
9. The industry has added painting process in its sledge hammer section which is neither declared in its previous application nor in the current application form.
10. The industry has installed one D.G set of capacity 250 KVA, with canopy and adequate stack height.
11. The industry has not obtained the renewal of authorization under HWM Rules, 2016.
Keeping in view of above, it is recommended that:
1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 be refused.
2. Notice to issue direction u/s 31-A of the Air Act, 1981 may be issued to the industry alongwith an opportunity of personal hearing, please.
3. Show cause notice for violation of provisions under Hazardous Waste Rules, 2016 may be issued to the industry.
