It is submitted that the subject cited industry is a small scale red category unit.
Earlier, a complaint was received telephonically in this office in which the complainant alleged that the industry is operating illegally and due to which nuisance cause in the nearby location. Thereafter, to check the content of the complaint the industry was visited by the officer of this office on 10.03.2026 and contacted Sh. Ram Vilas, Proprietor at the site. During visit, it was observed as under:
1. During visit, the industry was found in operation and is engaged in powder coating & Acid pickling process.
2. The industry has installed 1 no. powder coating booth, 1 no. electric oven in its premises.
3. The industry has also provided wet process area in which they are operating acid pickling activity and provided 3 no. dip tanks, 1 no. drier.
4. The industry has provided MC supply as a source of fresh water and the water meter reading (993.0 KL).
5. The industry has been made an agreement with CETP facility of 1 KL valid upto 16.10.2026.
6. The industry has provided 1 no. storage tank of 1500 ltrs capacity which was found 50% full.
7. The representative of the industry was failed to produce any record of fresh water consumption and effluent lifted by CETP facility.
8. The industry was found operating without obtaining prior consent from under the Water Act, 1974 and the Air Act, 1981.
File is under process vide E-office file no. 373919.
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 with requisite documents. The industry has already deposited consent fee against the un-depreciated fixed assets of Rs. 20.23 Lacs as on 31/03/2025 as per CA certificate dated 09/05/2025, which is adequate upto 30/06/2031 under Water Act, 1974, as per Board's Office Order dated 29/10/2018 after penalty charges 500 % and NOC regularization fee.
1. It is engaged in Labor job Cycle parts powder coating @ 5000 Kg/day by using raw material as HCL @ 1 Liter/day.
2. The manufacturing process of the industry is as Raw material - Powder coating - Acid Dip – Bhatti - Finish.
3. The industry has made agreement with M/s JBR Technology Pvt. Ltd., Ludhiana (CETP) for disposal of its trade effluent @ 1000 ltr/month.
4. The industry has not installed any DG set in the premises.
5. The industry has submitted building plan prepared by Sh. Sukhjeet Singh approved Architect from Director of Factories, Punjab.
Site Suitability
The industry has submitted land use classification certificate from ATP, Zone-C, Ludhiana vide letter no. 618 dated 25.03.2026, which is reproduced as under:
"ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਆਪ ਵੱਲੋਂ 18-03-2026 ਨੂੰ ਦਿੱਤੇ ਬੇਨਤੀ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿੱਚ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਆਪ ਦੀ ਸਾਈਟ ਬੀ-29, ਖਸਰੀ ਨੰ. 141/7/2/1, 8/2/1, 9/2/1, 15//20/2 ਖੇਵਟ ਨੰ. 109, ਖਾਤਾ ਨੰ: 200/206 ਵਸੀਕਾ ਨੰ. 3208 ਮਿਤੀ 21-06-2018 ਜਮ੍ਹਾਬੰਦੀ ਸਾਲ 2008-2009 ਵਾਕਿਆ ਪਿੰਡ ਗਿਆਸਪੁਰਾ ਹਦਬਸਤ ਨੰ: 261 ਅਬਾਦੀ ਸ਼ਾਂਤੀ ਨਗਰ ਤਹਿਸੀਲ ਵਾ: ਜਿਲ੍ਹਾ ਲੁਧਿਆਣਾ ਦੀ ਮਲਕੀਅਤ ਹੈ। ਸਬੰਧਤ ਸਾਈਟ ਪ੍ਰਵਾਨਤ ਮਾਸਟਰ ਪਲੈਨ ਅਨੁਸਾਰ ਇੰਡਸਟਰੀਅਲ ਜੋਨ ਅਧੀਨ ਪੈਂਦੀ ਹੈ। "
In the subject cited case, the industry has mentioned ground water extraction @ 0.6 KLD. Considering 25 working days per month, ground water extraction will be 15 KL/month, which is less than 300 KL/month.
It is therefore recommended that:
1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be refused.
2. Show cause notice under provisions of Water (Prevention & Control of Pollution) Act, 1974 may be issued with an opportunity of personal hearing before Competent Authority of the Board.
