It is submitted that the Regional Office has furnished the point-wise reply to the observations raised, which is summarized as under:
1. APCDs with Boilers:
The industry has installed two boilers i.e., one of 25 TPH capacity (rice husk/cotton straw fired) with ESP as APCD and another of 2 TPH capacity (wood fired) with cyclone as APCD. However, since the industry has remained non-operational for more than 5 years, both the boilers and APCDs were found to be in non-functional condition with significant deterioration and rusting.
2. Energy Meters:
As the boilers and APCDs are non-operational for the last more than 5 years, no separate energy meters were found installed and no records are being maintained.
3. Ash Disposal:
Since the boilers are not in operation, no ash is being generated and accordingly no arrangement for ash disposal has been made by the industry.
4. Compliance of Previous CTO Conditions:
In the previous CTO, a condition was imposed for upgradation of APCDs within 03 months to meet the emission standards prescribed by MoEF&CC vide notification dated 16.05.2023. However, the industry is currently non-operational due to an ongoing arbitration process, and a formal arbitrator has been appointed to resolve the disputes.
5. Status of Non-operational Units:
The industry is under arbitration proceedings; therefore, no definite timeline or proposal for re-commissioning can be ascertained at this stage.
6. Future Expansion/Allotment:
In view of the ongoing arbitration process, no new units are proposed or allotted within the food park as of now.
In view of the reply submitted by the Regional Office and as proposed by the RO, it is recommended that the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry up to 30.09.2026 for operation of DG sets only, subject to the earlier stipulated conditions along with the following special conditions:
1 . The food park shall not operate its boilers without obtaining prior permission/Consent to Operate from the Board.
2 The food park shall not allot plots to any unit without obtaining prior permission/Consent to Operate from the Board.
3 The food park shall ensure regular maintenance of the plantation area and improve housekeeping at the site.
