It is submitted that the subject cited industry was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2024/25471493 dated 03/06/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2024/25471423 dated 03/06/2024, both valid upto 31/03/2026 subject to the conditions mentioned therein.
Further, the industry was issued show cause notice vide no. 5778 dated 11.11.2025 for revocation of ‘Consent to Operate’ granted under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Imposition of Environmental Compensation for non-operation of OCEMS, along with an opportunity of personal hearing before the Worthy Chairperson of the Board on 04.11.2025, wherein, it was decided as under:
1. The industry shall ensure continuous operation of Online Continuous Effluent Monitoring System (OCEMS) and transmission of data with PPCB server, at all times.
2. The industry shall get itself registered and establish connectivity of OCEMS with Online Data Acquisition and Monitoring System (ODAMS) portal of CPCB (https://cems.cpcb.gov.in) before 15.11.2025, in order to ensure the compliance of the directions issued by CPCB u/s 18 (1) (b) of the Water Act, 1974 and Air Act, 1981 at and thereafter submit compliance to the Board, immediately.
3. The industry shall adhere to the revised OCEMS calibration protocol available at https://cpcb.nic.in/ocems2/.
4. The Board shall be constraint to revoke/ cancel CTOs granted under the Water Act, 1974 & Air Act, 1981 to the industry along with imposition of Environmental Compensation for intentional avoidance of data submission or data manipulation by tampering the Online Continuous Emission / Effluent Monitoring systems and non-compliance of the aforesaid decisions.
Thereafter, the Board has issued office order no. 34461 - 64 dated 09.10.2025, vide which, the competent authority of the Board has decided that the Senior Environmental Engineers (SEEs) shall monitor the 17 Categories of Highly Polluting Industries falling under their respective Zonal Offices alongwith Environmental Engineers (EEs) posted in their Zonal Offices on surprise basis.
In compliance to the orders of the Competent Authority of the Board regarding monitoring protocol for 17 categories of highly polluting industries to be visited by the concerned SEE alongwith EE posted in their Zonal Office on surprise visit.
Thereafter, the subject cited industry was visited by the
Er. Gursharan Dass Garg, Sr. Environmental Engineer (ZP-1), Er. Arshdeep Singh, Environmental Engineer (ZP-1), Er. Gurinderpal Singh Chinna, Environmental Engineer (HQ-1), Er. Amarpreet Singh, Asstt. Environmental Engineer (RO, SAS Nagar) alongwith staff from Air Lab, Patiala on 26.12.2025 for quarterly surprise inspection and Mr. Sarthak Rath, Manager and Mr. Sandeep Dhanoa, EHS CPI (representative of the unit) was contacted. During visit, it was observed that that industry is violating the provisions of the Water Act 1974 and Air Act 1981, intentionally & deliberately at site.
Accordingly, the industry was issued show cause notice for revocation/cancellation of consent to operate granted under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 and notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Worthy Chairperson of the Board on 20.03.2026 vide Boards’ letter no. 8165 dated 03.03.2026 postponed to 02.04.2026.
Now, the Board has issued office order no. 55 dated 18.02.2026, vide which, the competent authority of the Board has decided that the Senior Environmental Engineers (SEEs), Zonal Office – 2, Patiala shall monitor the 17 Categories of Highly Polluting Industries falling under the Zonal Office-1, Patiala alongwith Environmental Engineers (EEs) posted in their Zonal Offices on surprise basis.
Now, the industry has applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 alongwith requisite documents.
As per record file earlier the fee deposited by the industry is adequate upto 15.03.2029. Now, the industry has submitted the CA certificate wherein the value of fixed assets of the industry of Rs. 598.48 crore as on 31.12.2025. The industry has deposited Rs. 420500/- vide R. no. 39324011 dated 20.02.2026 under the Water Act, 1974 and Rs. 420500/- vide R. no. 509612107 dated 20.02.2026. The fee deposited by the industry is adequate 31.10.2029 after adjusting NOC regularization fee against the total cost of the industry Rs. 598.48 crore (after deducting value of the Hoshiarpur Unit).
The industry has also submitted the compliance report of the previous consents granted by the Board under the Water Act, 1974 and under the Air Act, 1981. The industry has also submitted analysis report from the outlet of STP from Chandigarh Pollution Testing Laboratory dated 10.12.2025 and the same is within the prescribed standards by the Board.
The industry has submitted the bank guarantees as under:
• 240GTO2143030014 dated 30.10.2014 (Extended on 29.10.2015 amounting to Rs. 1000000/- which has expired on 29.04.2016
• 529020408124 dated 27.02.2012 amounting to Rs. 2000000 expired on 19.02.2018.
• 240GT02160200003 dt. 20.01.2016 amounting to Rs, 1700000 and the same has expired on 18.01.2017.
Further, the industry was requested vide this office letter number 1828 dated 30.08.2024 and 2275 dated 12.11.2024, 1398 dated 01.07.2025 regarding renewal of the above said bank guarantees. However, the industry has failed to renew the same till date.
Keeping in view of the above, may if approved, the case of the industry may be sent to the Zonal Office-2, Patiala for deciding the consent applications in accordance with the decisions of the personal hearing scheduled before the Competent Authority of the Board on 06.04.2026.
