Subject: Application for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 - M/s Gurbaz Farm Machinery Private Limited, Village Amampura, Distt. Patiala.
It is submitted that the restaurant is a small scale GREEN category unit and was established without obtaining consent to establish of the Board.
Now, the restaurant has applied for fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Super Seeder @ 1150 No./year, Straw Reaper @ 300 No./day, Rotavator @ 780 No./year and Straw baller @ 100 No./year by using HR sheets @ 2050 MT/year, ARW Pipe @ 200 MT/year, Angle Channel @ 350 MT/year and Gear Box @ 2000 No./day as raw material along with documents covered under green category no. 125. Spray Painting, Paint baking, Paint shipping.
The establishment has deposited fees as under Rs. 87360/- (Rs.
62160/- as water consent fee and Rs. 25200/- 300% penalty fee) vide UTR no. 294255289 dated 31.12.2025 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 96260/- (Rs. 62160/- as air consent fee, Rs. 25200/- 300% penalty fee and Rs. 8400/- as NOC regularization fee) vide UTR no. 529449039 dated 31.12.2025 under the Air (Prevention & Control of Pollution) Act, 1981, which is valid upto 31.12.2030 (after consideration as of commissioning as 09.08.2023 as per documents submitted, against the value of fixed assets of Rs. 438.21 lakh as on 30.11.2025 as per CA certificate dated 15.12.2025 submitted by the establishment. The industry has submitted lease deed of the land w.e.f 01.09.2023 to 31.08.2038 (copy attached)
The industry has obtained Change of land use from agriculture to industrial (Manufacturing Agricultural Parts) Vill. Amampura (H.B.No: 53), Tehsil & Distt. Patiala from Department Of Town & Country Planning, Punjab vide memo no. 3690 dated 03.12.2023 for an area measuring 2.974 Acres falling in village Amampura (H.B.No: 53), tehsil & district Patiala for Industrial purpose (Manufacturing of Agricultural Parts) has been considered in this office. The site falls in Agricultural / Rural Land Use Zone of Statutory Master Plan Patiala.
The industry has submitted revenue report from Tehsildar, Patiala dated 13.02.2026, which attached in the agenda note.
In compliance to the above, the project proponent has submitted approved map from Director of Factories, Punjab.
The establishment was visited by the undersigned on 23.03.2026 and contacted Sh. Jagtar Singh, Proprietor of the industry. During visit, it was observed as under:
1. The industry was found in operation.
2. The industry has installed 1 no. plasma cutting, 4 no. lathe machines, 2 no. hydrulic presses, 5 no. power presses and 1 no. laser cutting machine.
3. The industry has also provided 1 no. powder coating section and electric heater for painting of machinery with inbuilt bag filter house as APCD and stack of adequate height.
4. The industry has provided 1 no. D.G. set of capacity 250 KVA with canopy and stack of adequate height.
5. No trade effluent is being generated and domestic effluent is being discharged onto land for plantation after passing through septic tank.
6. No MC limit / NP limit, residential area / 15 Pucca Houses and village Lal Lakir / Phirni falls within the 100 mtr radius of the industry site. As such, as per report of DTP and Tehsildar and site visit of undersigned, the site is suitable for establishment of the unit as per Master Plan of Patiala.
In view of above, it is found that the industry is complying with the provisions of Water Act, 1974 and Air Act, 1981.
Therefore, keeping in view of above mentioned facts, it is recommended that project proponent may be granted fresh consent under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 up to 31.12.2030 under green category subject to certain conditions as per policy of the Board.
