File Note: The report/ recommendations of RO has been examined and it was noted as under: # It is submitted that earlier the project proponent was granted CTE dated 14.10.2022 which was valid upto 13.10.2023 for the development of Residential colony having 486 flats (442 flats + 44 EWS flats) project namely Sandwoods Opulencia in the revenue estate of Vill. Bhagomajra, Distt. SAS Nagar in an area of 6.45 acres having built up area of 72892.6 sqm subject to certain conditions as mentioned therein. # The project proponent was also granted extension in the validity of CTE dated 30.11.2023 valid upto 18.11.2024 for the development of Residential colony having 486 flats (442 flats + 44 EWS flats), subject to certain terms and conditions mentioned therein. # Thereafter, the project proponent was granted CTE under the Water Act, 1974 dated 29.09.2022 valid upto 28.09.2023 and under the Air Act, 1981 dated 30.11.2023 valid upto 30.11.2024 for Residential Colony having 258 flats with disposal arrangement that Domestic Effluent @ 117 KLD - After STP, utilized for flushing purpose, construction purpose and onto land for plantation in green area, subject to certain conditions as mentioned therein. # The project proponent has obtained revised Environment Clearance by the SEIAA vide no. SEIAA/2524 dated 10/06/2016 for establishment of residential complex namely “M/s Sandwoods Infratech Projects Pvt. Ltd.’ having total land area 26102 sqm (6.45 Acre) and built-up area increase from 67490 sqm to 72892.6 sqm for the construction of flats (442 flats +44 EWS flats). # As per the Environment Clearance, the total water requirement of the project is 407 KLD. Total 410 KLD waste water will be generated within the premises, which will be treated in the STP of capacity 410 KLD. The project proponent has proposed to use 84 KL/day of treated wastewater for flushing purpose, 37 KL/day will be used for irrigation of green area (6768 sqm) and remaining 281 KL/day will be discharged into M.C. sewer in summer season. # Now, the project proponent has applied for obtaining varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Residential colony having 394 flats, alongwith requisite documents. Also, the project proponent has applied for obtaining extension in the validity of CTE for Residential colony having 486 flats (442 flats + 44 EWS flats) and the same is being processed separately. # The RO has calculated that the fees deposited by the PP is adequate upto 30.09.2027 against the total cost of the project incurred of Rs. 17887 lacs. # The project proponent has submitted compliance report of the conditions of the earlier granted consent to establish (NOC) as well as Environmental Clearance granted by the Competent Authority. # The RO has raised observation to the PP to pointing out that the Environmental Clearance granted by the Competent Authority to the project proponent is going to expired on 09.06.2026 (valid only for five months). However, the project proponent has not submitted any extended/revised Environmental Clearance issued by the Competent Authority to the project proponent as the project proponent has submitted request letter for obtaining CTE for two years. In this regard, the PP has replied that the Environmental Clearance (EC) for the project was granted on 10.06.2016 with a validity of 10 years, as per MoEF&CC Notification vide F.No. IA3-22/10/2022 IA.III dated 22.04.2022. The project was admitted under NCLT proceedings on 25.10.2021 and remained non-operational during the pendency of the case. Subsequently, the resolution plan submitted by Mr. D. Konda(Director) was approved by the NCLT on 10.08.2023, and implementation activities commenced thereafter. In accordance with the Office Memorandum F.No. IAS-dated 22/22/2025 IA.III [E-280329] 30.10.2025, the period consumed in such legal proceedings shall not be counted against the validity of the EC. Accordingly, the duration of approximately two years (25.10.2021 to 10.08.2023) is excluded from the validity calculation, thereby extending the effective validity of the EC beyond the original 10 year period. # The site of the residential project was visited by the officer of Regional Office on 09.03.2026 and it was observed as under 11. The project is a residential group housing and having total 486 flats (i.e. 442+44 EWS flats). 12. The project proponent has provided occupancy around 276 flats (70 % of constructed flats). 14. The project proponent has installed one tubewell and is maintaining record of the same. 15. The project proponent has provided dual plumbing line in all the tower and provided treated water storage tank on each tower for the utilization of treated effluent into flushing purposes. 16. The project proponent has constructed 02 rainwater harvesting pit in the premises. 17. The project proponent has installed 01 DG set of capacity 200 KVA, which is equipped with canopy and stack of adequate height. 18. The promoter company has also provided a skid mounted type STP for the treatment of domestic effluent and same was in operation. The project proponent has provided water meter at the final outlet of STP and maintaining the record of the same. The effluent samples collected from the outlet of STP and sent to Head Office laboratory for analysis. 19. The treated effluent is being utilized for flushing purposes, construction purposes and onto land for plantation in green area. The project proponent has developed plantation area with broad leaf trees containing Piple, Pilkhan and Chukrasia Jamun, Neem etc. (as per Karnal Technology) in an area of 1 acre land. The project proponent has also developed green areas along the boundary wall, park area in about 1.2 acres. 20. The project proponent has provided mechanical composter of capacity 100 kg for management of solid waste generated from the project. # The RO has concluded that the project proponent is complying with the previous consent granted to it under the Air (Prevention & Control of Pollution) Act, 1981 as well as Environment Clearance conditions granted to it. # The RO has recommended that the varied Consent to Operate under the Water Act, 1974 and the Air Act, 1981 be granted to the project upto 30.09.2027, subject to suitable conditions. # It is brought out that the analysis results of the effluent sample collected from the STP outlet by the visiting officer on 09.03.2026 has been received from Board’s HO Water lab on 27.03.2026 and the same revealed that the concentration of various parameters as pH 7.7, TSS 12 mg/l, TDS 459 mg/l, COD 88 mg/l, BOD 20 mg/l, O&G 6.2 mg/l; which are within the permissible discharge limits. In consideration of the report/ recommendations of RO; if approved, the varied Consent to Operate under the Water Act, 1974 and the Air Act, 1981 be granted to the project upto 30.09.2027, for operation & occupancy in 394 flats subject to suitable general and the following additional conditions that: 1. The project proponent shall regularly operate its STP and shall maintain operational record of the same on daily basis 2. The project proponent shall maintain separate record regarding treated water being generated from the project and being re-utilized in green area and flushing. 3. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be collected. 4. The project proponent shall not discharge any treated/ untreated wastewater into sewer/ drain/ choe under any circumstances. 5. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 6. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
