Earlier History Under Air Act, 1981
The BKO falls under the orange category. The brick kiln was earlier granted 'Consent to Operate' under Air (Prevention & Control of Pollution) Act, vide no. CTOA/Renewal/LDH1/2020/12809138 dated 07/07/2020 valid upto 30.09.2029 for manufacturing of brick tiles @ 40000 No./day.
Present under Water Act, 1974
Now the brick kiln has applied fresh of 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1976 for manufacturing of brick tiles @ 40000 No./day..
1. The Brick Kiln is an existing unit Since Apr / 1999.
2. The Brick Kiln has submitted the copy of Location Plan, Manufacturing Process.
3. The kiln has provided induced draft technology with Zig-Zag firing.
4. As per document submitted by the BKO has also constructed induced draft Technology with ZIG-ZAG firing arrangement as per technology evolved by PSCST. The Brick kiln has also submitted the certificate regarding issued by the PSCST vide no.1019 dated 24.02.2020 in which it is stated that this unit have constructed high draft brick kiln with ZIG-ZAG technology, rectangular in shape as per PSCST design.
5. As per the CA certificate the total cost of the project is 26.99 lac and plant and machinery 17 lacs. The subject cited brick kiln has deposited adequate consent fee i.e. Rs. 52200/-under Water Act, 1974 vide R.no. 145736179 dated 10.11.2025 same is valid up to 30.06.2030 after deducting penalty of 700%.
To verify the facts, the site of the Brick Kiln was visited by the undersigned on 01.04.2026 During visit it was observed as under:-
1. The Brick Kiln was not in operation.
2. It has provided Porthole and platform to collect the sample of stack emissions.
3. There is only generation of domestic effluent @ 1 KLD and same is discharged onto land for plantation after septic tank.
4. The BKO has provided the display board in compliance to Hon’ble National Green Tribunal (NGT) order dated 25.02.2025 in OA no. 359/2022 in the matter of Rafhat Naeem Siddiqui Vs state of UP & Ors.
5. The Brick Kiln is complying with the Code of Practice Prescribed for Brick Kilns.
Keeping in view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to Brick Kiln upto 30.06.2030 with usual conditions and special conditions that:-
1. The BKO will comply with all the code of practice prescribed by the Board for Brick kilns all times.
2. The BKO shall provide the display board in compliance to Hon’ble National Green Tribunal (NGT) order dated 25.02.2025 in OA no. 359/2022 in the matter of Rafhat Naeem Siddiqui Vs state of UP & Ors within one month.
3. The BKO shall inform the regional office about its operational schedule in advance so that sampling can be carried out.
