It is submitted that the subject cited industry is a small scale red category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2018/8276933 dated 14/09/2018 valid upto 30/06/2022 for Job work for zinc plating @ 400 Kg/day.
Earlier, a complaint was received regarding water pollution in this office through whatsapp and to check the facts of complaint, the industry was visited by undersigned on 10.12.2025 and it was observed as under:
1. The industry was in operation at the time of the visit and engaged in zinc plating of auto parts.
2. The industry has 03 no. barrels, 01 caustic dhol, 01 drier, 02 HCL barrels and 02 no. dips.
3. The industry was taking water from unmetered supply in the toilet.
4. A bypass arrangement was also found about 2 ft outside the toilet.
5. The storage tank of 1500 ltr was full upto the brim.
6. No record was present with the industry and no agreement with CETP operator was produced by it.
7. The industry is operating without valid consent of the Board.
Accordingly, the industry was issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 vide no. 199-200 dated 20.01.2026 for disconnection of electric connection available to the industry.
To ensure the compliance of the directions issued against the industry was visited by Er. Harmanjit Singh (JEE(OS)) on 10.03.2026 and following things were observed:
1. During visit the industry was found not in operation and engaged in zinc plating of auto parts.
2. The industry has installed 3 no. Barrels, 1 no. caustic dhol, 2 no. HCL barrels, 2 no. dips and 1 no. drier in its premises.
3. The industry has provided storage tank of 1500 ltrs capacity which was found almost 50% filled.
4. The industry’s electricity was not disconnected yet.
5. Sealing of the wet process (Machinery) was completed.
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 with requisite documents. The industry has already deposited consent fee against the un-depreciated fixed assets of Rs. 3.02 Lacs as on 15/12/2025 as per CA certificate dated 15/12/2025, which is adequate upto 30/06/2031 under Water Act, 1974, as per Board's Office Order dated 29/10/2018 after penalty charges 400 % and NOC regularization fee.
The industry was visited by the undersigned on 01.04.2026 and it was observed as under:
1. The industry was not in operation. PSPCL authorities has disconnected the electric supply of the unit vide TDCO no. 16/102 dated 09/02/2026. During the visit, wet process was found to be sealed.
2. It is involved in Job work of zinc plating @ 400 Kg/day by using raw material as Zinc Chemical @ 06 Kgs/day, Sulphuric Acid @ 05 Ltr/day and HCL @ 16 Liter/day.
3. The manufacturing process of the industry is as Raw material - Acid Dip - Electroplating - Washing - Rinsing - Hydro Dryer - Ready - Dispatch.
4. The industry has provided 04 barrels for carrying out the plating process.
5. The industry has made agreement with M/s JBR Technology Pvt. Ltd., Ludhiana (CETP) for disposal of its trade effluent @ 5000 ltr/month.
6. No bye pass of effluent was observed during visit.
7. Domestic effluent generated by the industry is discharged into sewer.
8. The industry has now provided 03 storage tanks of capacity 1500 ltr, 1000 ltr and 1000 ltr for storage of its trade effluent and about 700 Ltr. effluent was lying stored at the time of visit. The industry did not have space for any more storage tank.
9. The industry has now installed 01 CCTV camera facing processing shed, on fresh water meter installed in processing area and 01 no. on effluent storage tank.
10. The industry has not installed any DG set in the premises.
11. The industry has submitted building plan prepared by Sh. Sukhjinder Singh approved Architect from Director of Factories, Punjab.
The site of the industry falls in Industrial Area-C as per khasra no’s mentioned in the gazette notification.
In the subject cited case, the industry has mentioned ground water extraction @ 0.65 KLD. Considering 25 working days per month, ground water extraction will be 16.25 KL/month, which is less than 300 KL/month.
It is pertinent to mention here that in case of M/s Kalsi Sons Fabricators, #13581, Street No. 7, Parbhat Nagar, Dholewal, Ludhiana, Competent Authority of the Board has decided not to restore electric connection in such cases till such small scale illegal industry deposit Rs 1.0 lac as environment compensation.
It is further submitted that vide office memorandum no. 428 dated 23.09.2025 among other decisions the Board has decided as under:
“The Bank Guarantee be returned and /or permanent restoration be allowed on compliance of specified violation or submission of necessary document based on single site visit subject to decision of the Competent Authority.”
It is therefore recommended that:
1. The industry may be imposed an environmental compensation amounting to Rs 1.0 Lakh being a small scale unit as approved by the Competent Authority in the case M/s Kalsi Sons Fabricators.
2. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30/06/2030 with suitable conditions as per policy of the Board. (Competency – Senior Environmental Engineer)
3. Environmental Engineer, RO-2, Ludhiana may be directed to de-seal the machinery.
4. PSPCL authorities may be directed to restore the electric connection available with the industry, permanently after deposition of EC by the industry. (Competency: Chief Environmental Engineer)
5. The industry will atleast get its trade effluent twice a month.
