Discussed and it is submitted that the project proponent was earlier granted ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 dated 17.07.2024, having validity upto 16.07.2025 for establishment of a group housing project @ 176, for the following effluent treatment & disposal arrangements: "Domestic Effluent @ 105 KLD - After treatment in STP of Capacity 140 KLD, domestic wastewater @ 44 KLD will be used for flushing purposes and 14 KLD will be discharged onto land for plantation/ irrigation to be developed as per Karnal Technology and remaining 47 KLD into sewer after obtaining permission from the MC. In case, the capacity terminal STP may not be adequate or permission by the MC to discharge treated wastewater into sewer may not be granted only then project proponent shall install electric evaporator of adequate capacity to handle the treated wastewater @ 47 KLD" Now, the project proponent has applied for obtaining extension in the validity of ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, already granted by the Board.
The competent authority has mentioned that the project proponent shall make own arrangements for treated effluent utilization.
Therefore, the project proponent is required to provide arrangement/ proposal for utilizaiton of the excess 47 KLD treated effluent by providing plantation area/ land for utilization of the same.
In view of the above facts and the report/ recommendations of RO; if approved, the competent authority be recommended that the validity of the consent to establish earlier granted to the project under the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2024/25535696 dated 17/07/2024, having validity upto 16/07/2025, may be further extended for another one year i.e. upto 16.07.2026, subject to all terms & conditions as mentioned in the original consent to establish granted to the project (except conditions no. 1 to 4) and the following additional conditions that: 1. The project proponent shall provide additional land, adjoining/ contiguous to the project site, for development of plantation/irrigation area for utilization of excess treated effluent @ 47 KLD as per Karnal Technology, as an interim arrangement. This arrangement shall remain in force till such time the sewerage connection is made available and the terminal STPs of the area are upgraded to adequately handle the treated wastewater. 2. The promoter shall not allow any occupancy in the project till the time adequate arrangements for treatment & disposal of wastewater and solid waste are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
