In view of the detailed examination of the case, past violations, present compliance status, and the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, the following is submitted for kind consideration:
The industry had earlier operated without obtaining Consent to Operate (CTO) and violated closure directions issued under Section 33-A/31-A, which constitutes a serious non-compliance. However, the primary deficiency regarding installation/certification of the Air Pollution Control Device (APCD) has now been addressed through submission of a provisional certificate from PSCST and installation of the requisite pollution control systems, as verified during inspection.
The continued operation of the unit despite closure directions indicates enforcement gaps, which prima facie appear attributable to non-compliance by PSPCL officials.
After obtaining legal opinion, it is proposed that the recommedation made by the EE, ZO, Bathinda at Sr. No. 1 may be accepted.
Further, the recommendation made at Sr. No. 2 is within the competency of SEE, Bathinda and hence, the same is approved
