It is submitted that the industry has applied for 'consent to establish' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under orange small category for establishment of Hot mix plant @ 95 TPH by using raw material Bitumen @ 15 TPH and Gravel Stone @ 80 TPH in Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar.
The industry has deposited NOC fee of Rs. 11300/- along with application fees vide R. No. 188238125 dated 17.03.2026, against the proposed cost of project of Rs. 462.0 lacs. The NOC fee deposited by the industry is adequate for one year.
The industry has submitted, Project report, Feasibility report w.r.t bag filter followed by wet scrubber as APCD, Distance certificate from Revenue authorities/ Tehsildar, Sri Anandpur Sahib, District Rupnagar, undertaking regarding authorized signatory, layout plan from the competent person of Director of Factories (PB.) Er. Dharminder Singh, DTP letter regarding site suitability/land use classification, Patanama/lease deep and same is valid upto 31.12.2046, Partnership deed (between Sh. Karan Son S/o Sh. Simerinder Singh), and other requisite documents.
The Site Suitability, DTP Rupnagar vide ਯਾਦ ਪੱਤਰ ਨੰ. 75/ਡੀ.ਟੀ.ਪੀ(ਰ)/ dated 13.02.2026 has issued letter to this office wherein it is mentioned that the industry is located in Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar, Hadbast no. 360, Khasra no. 74//9, 12 (05 Kanal, 09 Marle) wherein it has mentioned that ਇਹ ਰਕਬਾ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਸ਼੍ਰੀ ਅੰਨਦਪੁਰ ਸਾਹਿਬ ਦਾ ਹਿੱਸਾ ਹੈ ਜਿਸ ਦਾ ਮਾਸਟਰ ਪਲੈਨ ਅਜੇ ਉਲੀਕਿਆ ਜਾਣਾ ਹੈ।
The distance verification report of Tehsildar Sri Anandpur Sahib, District Rupnagar issued vide no. 134/ਰੀਡਰ on 27.03.2026 for Village Agampur, Tehsil Anandpur Sahib, District Rupnagar for Hadbast no. 360, khasra no. 74//9,12 and the same is as below:

1. ਮਿਊਨੀਸੀਪਲ ਕਾਰਪੋਰੇਸ਼ਨ ਦੀ ਹੱਦ 5 ਕਿਲੋਮੀਟਰ ਲਗਭਗ
2. ਕਲਾਸ ਏ ਟਾਊਨ ਅਤੇ ਸ਼ਹਿਰ ਦੀ ਹੱਦ 2 ਕਿਲੋਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
3. ਹੋਰ ਸ਼ਹਿਰਾਂ ਅਤੇ ਕਸਬਿਆਂ ਦੀ ਹੱਦ 1 ਕਿਲੋਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
4. ਪਿੰਡ ਦੀ ਫਿਰਨੀ ਅਤੇ ਲਾਲ ਲਕੀਰ 500 ਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
5. ਜੰਗਲੀ ਜੀਵ ਸੈਂਚੂਰੀ / ਚਿੜੀਆ ਘਰ 500 ਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
6. ਨੈਸ਼ਨਲ ਹਾਈਵੇ 500 ਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
7. ਸਟੇਟ ਹਾਈਵੇ / ਸ਼ਡਿਊਲਡ ਰੋਡ (requisite 200 meter as per latest revised siting criteria from center line) 300 ਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
8. ਰਿਹਾਇਸ਼ੀ ਇਲਾਕਾ (15 ਪੱਕੇ ਘਰਾਂ ਤੋਂ ਦੂਰੀਂ) (ਕੀ 300 ਮੀਟਰ ਦੇ ਦਾਇਰੇ ਵਿੱਚ ਹੈ) 300 ਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
9. ਵਿਦਿਅਕ ਆਦਾਰਿਆ / ਪ੍ਰੋਟੈਕਟਡ ਮੋਨੁਮੈਂਟਸ / ਇਤਹਾਸਿਕ ਧਾਰਮਿਕ ਸਥਾਨ 300 ਮੀਟਰ ਤੋ ਵੱਧ ਹੈ।
10. ਰਿਹਾਇਸ਼ੀ ਕਲੋਨੀ ਤੋਂ ਦੂਰੀ 500 ਮੀਟਰ ਤੋਂ ਵੱਧ ਹੈ।
11. ਹਸਪਤਾਲ, ਕੋਰਟ ਅਤੇ ਟੂਰਿਸਟ ਸਪੋਟ ਤੋਂ 1 ਕਿਲੋਮੀਟਰ। 1 ਕਿਲੋਮੀਟਰ ਤੋਂ ਵੱਧ ਹੈ।
From above report, it is evident that the industry is meeting with the siting guidelines prescribed for such units.
Accordingly, the proposed site was visited by the Harsimran Singh, AEE of this office on 30.03.2026 and contacted Sh. Arun Soni (Representative of the industry). During visit, it was observed as under:
1. During visit, it was observed that the proposed site is located in the revenue estate of Village Agampur, Tehsil Shri Anandpur Sahib, District Rupnagar.
2. No high-tension wires are crossing over the proposed site.
3. The project proponent has started with installation work of machinery at site for the Hot Mix Plant.
4. There is no Village phirni/lal-lakir within 500 mtr of the proposed site.
In view of the above, if approved, the proposed industry may be granted 'consent to establish' for establishment of Hot mix plant for production of Premix @ 95 TPH for one year subject to the suitable conditions along with special conditions as under:
1. The NOC is valid for a period of one year or till the commissioning of industry, whichever is earlier.
2. The industry shall comply with the conditions of the clarification given DTP Rupnagar vide no. 75 dated 13.02.2026 vide which the application shall abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 7 9 along with other provisions of PRTPD Act, 1995, in case the site falls In non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department
3. The industry shall not operate without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
4. The industry will be entirely responsible for earmarking its boundary and installation of plant at the site for which distance certificate and site suitability certificate has been issued by the Revenue Authority.
5. The industry is responsible for installing the plant at the proposed site for which distance certificate and land use classification has been submitted to DTP.
6. The industry shall obtain necessary regulatory clearances from the concerned departments.
7. The industry has been approved by the Board from pollution angle and does not give right of ownership.
8. The industry shall obtain the statutory clearances / permissions from all other concerned departments.
9. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
The industry shall comply with the code of practice laid down by the CPCB and PPCB at all time and guidelines issued by Government from time to time.
10. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received.
11. The CTE/NOC is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form and submitted in the office. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case
information/document is detected as incorrect/false/misleading at any point of time.
12. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
13. The sole responsibility for any wrong information/ declaration and/or any litigation/loss arising due to grant of this Consent to Establish shall be of the industry/ project proponent and its all the responsible/ concerned person(s).
