The Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale, red category dyeing and it has been granted consent to operate under Water Act, 1974 vide no. CTOW/Varied/LDH1/2019/11158656 dated 16.09.2019 valid upto 30.06.2024 for discharge of treated trade effluent @ 47 KLD into sewer after treatment through ETP. The Department of Science, Technology & Environment, Government of Punjab considering all the aspects of the matter has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter dated 10.10.2019 that industrial effluents and dairy waste whether treated / partially treated or untreated shall not be discharged into municipal sewer. A meeting was taken by Competent Authority of the Board on 13.07.2022 to review the compliance of directions u/s 5 of Environment (Protection) Act, 1986 issued dated 10.10.2019, wherein it was decided that all the water polluting industries (except garment washing and service stations) discharging their effluent into municipal sewer, Ludhiana shall take adequate steps to stop discharging their industrial effluent into municipal sewer, Ludhiana by 31.03.2023 and period of consent be reduced suitably to ensure compliance of the directions given by the Govt. Some other decisions were also taken vide letter no. 5052 dated 04.11.2022, the validity of consent to operate granted to the industry under the Water Act, 1974 was curtailed up to 31.03.2023 with a special condition that the industry shall take adequate steps to stop discharging the treated industrial effluent into municipal sewer, Ludhiana by 31.03.2023. The industry was issued notice to issue directions u/s 33-A of the Water Act, 1974 with opportunity of hearing before the Chairman of the Board on 06.12.2022, wherein decisions earlier taken were reiterated and the proceeding of personal hearing held before Chairman of the Board on 06.12.2022 were conveyed to industry vide letter no. 5708 dated 27.12.2022. The industry has failed to comply with the directions issued to it to stop discharging its industrial effluent into municipal sewer after 31.03.2023 as verified during visit on 16.05.2023. The industry was issued notice to issue directions u/s 33-A of the Water Act, 1974 with opportunity of hearing before the Chairman of the Board on 30.06.2023, wherein it was decided that the industry shall immediately dismantle and remove all outlets and shall stop discharging its trade effluent into sewer and the Authorities of Municipal Corporation Ludhiana shall immediately disconnect the sewer connection available to the industry for disposal of its trade effluent. There is a pending matter in the NGT vide O.А. пo 225/2022 & O.A. no. 546/2024 Budha Nallah case, Ludhiana, wherein it is mentioned that 26 dyeing units in industrial area-A of Ludhiana & 16 other scattered dyeing units which are not connected with any CETP are directly discharging the effluent in Municipal drain/ sewer. Directions are being issued for compliance by the Hon'ble Tribunal and the matter is being heard from time to time. The matter regarding the scattered industries which are not connected to the CETP and have not adopted alternative measures like ZLD is under the consideration of the Hon'ble National Green Tribunal in O.A NO. 546 of 2024 and O.A. No. 225 of 2022. The Hon'ble Tribunal in orders dated 27.11.2024 has directed the Board to take appropriate decision in accordance with law. The Tribunal has also sought progress / status report from the Board. The above OAs are fixed for 20.03.2025. In compliance of decision of meeting taken by Hon'ble Vidhan Sabha Committee on 26.07.2024 at Vidhan Sabha Secretariat, Chandigarh a meeting was taken by Additional Commissioner Municipal Corporation, Ludhiana to deliberate the finalization of site for installation of CETP for scattered dyeing units on 16.08.2024, wherein it was decided that for carrying out sampling of the scattered red dyeing units, a team of officials of PPCB and PWSSB be constituted and shall submit report within 07 days. In compliance to above, the treated effluent sampling of the unit was carried out by the officer of the Board along with the PWSSB Officials on 20.09.2024 and effluent samples were collected during visit and as per the analysis reports received from Board's lab, the conc. of parameter Phenolic Compound =1.3 mg/l is beyond the prescribed limits of the Board. The industry is discharging its industrial effluent into MC sewer and not complying with the directions issued u/s 33-A of the Water Act, 1974 to stop discharging its treated industrial effluent into MC sewer by 31.03.2023 and operating the unit without valid consent of the Board under the Water Act, 1974 since 31.03.2023 and is discharging effluent into sewer. The industry was issued notice for non-compliance of directions issued u/s 33-A of the Water Act, 1974 along with notice for imposition of Environmental Compensation (EC) with opportunity of hearing before the Chairman of the Board on 14.11.2024, wherein it was decided as under: 1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued sealing of the wet processes of the industry. 2. The sewer, industry shall dismantle & remove all outlets and stop discharging its trade effluent into as already directed by the Board. 3. On best assessment and judgement, the industry shall deposit Environmental Compensation amounting to Rs. 3 Lac for non-compliance of directions issued u/s 33-A of Water Act, 1974 for closure of its outlets into municipal sewer in proportionate to the discharge of industrial Effluent to the Environmental Engineer, Regional Office-1, Ludhiana, within 15 days. 4. Environmental Engineer, Regional Office-1, Ludhiana shall visit the industry and send compliance report to the above decisions. In compliance, directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued for sealing of the wet processes of the industry vide Board's letter no. 6555-56 dated 20.11.2024 and Regional Office-1, Ludhiana was directed to seal the wet processes of the industry. The industry as visited by officer of the Board on 27.11.2024 for sealing of the wet process. But, sealing not carried due to resistance by the industry during the visit. Thereafter, Industrial Area-A Dyers Association, 251, Industrial Area-A, Ludhiana through its Secretary Sh. Atul Verma and 22 other dyeing units situated in Industrial Area-A and nearby areas of Baba Gajja Singh Colony, Baba Deep Singh Nagar, Ludhiana filed appeal to set aside order dated 07.07.2023 and consequent notice 08.11.2024 whereby the permissible source of discharge of the treated effluent which was earlier permitted to be discharged in the Municipal Sewer. The Appellate Authority has passed an order dated 23.01.2025 that the Appellate Authority is not having the jurisdiction to entertain the appeal arising out of the directions issued by the Board u/s 33-A of the Water Act, 1974. Hence, the appeal is dismissed. The appellant is advised to approach the Hon'ble National Green Tribunal for the redressal of its grievance. The industry was again visited by the officers of the Board on 13.12.2024 and observed that the unit is still operating the outlet for discharge of treated effluent into sewer. The industry has not deposited Environmental Compensation of Rs. 3 lacs in the Regional office till date, as imposed by the Board. Thus, the industry is not complying with decisions of hearing dated 14.11.2024. The matter has been considered by the Competent Authority of the Board and it has been decided to issue notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 alongwith notice for imposition of Environmental Compensation (EC) with opportunity of personal hearing before Chairman the Board on 04.03.2025. Sh. Ramesh Arora, Partner & Sh. Rajesh Kumar, Partner of the industry attended the hearing and submitted a written reply, which was taken on record. He submitted that the industry has decided to install ZLD system for its trade effluent of 40 KLD, for which placed an order to M/s Aqua Solution Enterprises for installation of ZLD. The industry has also given an advance of Rs. 3,90,000/- against UTR no. UBINR22025022701352095 (10% of total amount) to M/s Aqua Solution Enterprises and ensure to complete ZLD system within 06 months. The industry is not able to deposit Environmental Compensation charges, because industry is suffering from finance. The unit is very tiny unit. They requested to wave off the environmental compensation imposed on them. They have got the effluent sample tested from M/s HTC laboratories pvt. Ltd. Haryana on 14.02.2025 and results are within norms. They have already requested the Board to take an effluent sample of treatment plant. During last sampling conducted by the Board, only one parameter Phenolic Compound failed to qualify the standards of the Board. They have now made upgradations in effluent treatment plant and thoroughly changed filter media of both filters and properly reactivated the carbon filter. The plant is now functioning in perfect condition. They assure the Board that new samples will comply with the prescribed standards of PPCB and MoEF. Further, he requested not to seal the machinery of the industry. The industry is committed to upgrade the treatment plants by installing ZLD system and same will be completed by September 2025. The trial and commissioning will be completed by 31.12.2025. After hearing the industry, officers of the Board and considering material facts on record, the Chairman of the Board decided as under: 1. The industry shall deposit Environmental Compensation amounting to Rs. 3 Lac for non- compliance of earlier directions issued u/s 33-A of Water Act, 1974 for closure of its outlets into municipal sewer, within 03 days. 2. The industry shall submit the receipt of at least 10% of the total amount of purchase order or minimum of Rs. 10 Lacs deposited by the industry to the company for installation of ZLD system, to the Board, within a week or submit a Bank Guarantee of balance amount (difference between Rs. 10 Lakh and the advance given), within one week as an assurance to complete to install ZLD system by 30.09.2025 (fully stabilize and commission by 31.12.2025). 3. The industry shall deposit environmental compensation amounting to Rs. 1 lakh minimum on account of not meeting with the prescribed standards in the last sampling, within 03 days. In case, there is failure of more than one parameter, then the industry have to pay Rs. 2 lakh as an environmental compensation. 4. Environmental Engineer, Regional Office-1, Ludhiana shall get the Environmental Compensation deposited from the industry and submit the compliance report to the above decisions. 5. The progress in the matter and compliance of the above decisions shall be reviewed on 12.03.2025 in the personal hearing of the industry to be held before the Chairman of the Board and further action shall be taken accordingly. Accordingly, notice has been issued to the industry with opportunity of hearing before the Chairman of the Board on 12.03.2025 to the review the compliances of above decision. Sh. Rajesh Kumar, Partner of the industry attended the hearing and submitted a written reply which was taken on record. He submitted that the industry has deposited Environmental Compensation (EC) amounting to Rs. 3 lakhs vide cheque no. "036105" to the Board. The industry placed order for ZLD system for its trade effluent of 40 KLD to M/s Aqua Solution Enterprises for installation of ZLD. The industry has given total advance of Rs. 10 lacs to complete to M/s Aqua Solution Enterprises. They will deposit Environmental Compensation of Rs. 1 lakh for not meeting with the prescribed standard within 03 days. The industry is committed to upgrade the treatment plants by installing ZLD system and same will be completed by September 2025. The trial and commissioning will be completed by 31.12.2025. After hearing the industry, officers of the Board and considering material facts on record, the Chairman of the Board decided as under: 1. The industry shall ensure that the work of installation of ZLD system is completed well within the timelines as per commitment made by the industry in writing during the personal hearing. 2. The industry will submit the progress with respect to the upgradation of ETP to ZLD technology well before the 5th of every month along with the photographs and expenditure details viz-a-viz the timelines given in the PERT chart. 3. The industry shall deposit environmental compensation amounting to Rs. 1 lakh on account of not meeting with the prescribed standards in the last sampling, within 03 days. 4. Till the installation & commissioning of upgraded ZLD plant, the industry shall continue to operate its existing ETP regularly and efficiently, so as to achieve the effluent discharge standards prescribed for such discharges. 5. The industry shall submit the receipt of at least 10% of the total amount of purchase order along with the bank statement within 03 days. 6. Environmental Engineer, Regional Office-1, Ludhiana shall monitor the installation work of ZLD system regularly as per the timelines mentioned in the PERT chart, shall get the Environmental Compensation deposited from the industry and submit monthly report to the higher authorities along with compliance report to the above decisions. In compliance to the decisions of the personal hearing, the industry was visited by the officer of this office on 12.08.2025. However, the report was sent through e-noting no. 13972763 dated 28.08.2025. Accordingly, the industry was issued Notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 along with notice for imposition of Environmental Compensation (EC) with hearing before the worthy Chairperson on 16.10.2025. Sh. Rajesh Kumar, Partner from the industry attended the hearing and submitted written reply which was taken on record. He submitted that they are fully committed to upgrade their effluent control arrangements to ZLD to stop the discharge into public sewer inline within Govt. directions dated 10.10.2019. however, there are technological and financial constraints of small-scale industries due to which the progress remained slow. The industry has placed order along with 5 lacs advance to M/s Eros Envirotech (P) Ltd. to install ZLD system of capacity 50 KLD for treatment of Dyeing & Finishing of Acrylic yarn wastewater. The entire trade effluent must be treated and recycled for reuse back into dyeing process. Due to building being very old, instead of going for civil work, they are getting the ETP Plant ready in MS. ETP with modification and addition of Biological Treatment Plant is now in progress and it will be completed by 30th November 2025. They will install / complete UF (Ultra Filtration), RO (Reverse Osmosis) & Multi effect Evaporator as per proposal. They are hopeful and assured to the Chair that the ZLD plant will be completed and commissioned before 31.12.2025. After hearing the industry, officers of the Board and considering material facts on record, the Chairperson of the Board decided as under: 1. The industry shall submit the revised PERT chart of activities to be carried out for successful completion, stabilization and commissioning of ZLD plant by 31.12.2025, positively within 07 days. 2. The industry shall submit a Bank Guarantee of Rs. 02 lakh within 07 days as an assurance for successful completion, stabilization and commissioning of ZLD plant by 31.12.2025. 3. The industry will submit the progress with respect to the up-gradation of ETP to ZLD technology after every 15 days alongwith the photographs and expenditure details viz-a- viz the timelines to be given in the revised PERT chart as above in decision no. 1, to the Regional Office-1, Ludhiana and Zonal Office-1, Ludhiana and through e-mail (ppcbro1@yahoo.com and ppcbzo1ldh@gmail.com). 4. The industry till the installation of the ZLD shall continue to operate its existing conventional effluent treatment systems and ensure that the treated effluent shall conform to the standards prescribed for such disposals. 5. In case, the industry failed to provide ZLD plant and stop the industrial effluent discharge into public sewer by 31.12.2025, in compliance to the State Govt. directions dated 10.10.2019, the Board reserves the right to take coercive actions against the industry as deemed fit and as proposed in the notice. 6. Environmental Engineer, Regional Office-1, Ludhiana shall monitor the installation work of ZLD system regularly as per revised PERT chart to be submitted by the industry and submit monthly report to the higher authorities. Now, the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Dyeing of acrylic yarn @ 900 kgs/day by using the raw material Acetic Acid @ 9 Kgs/day, Dyes @ 6 Kgs/day, Common Salt @ 18 Kgs/day and Acrylic Yarn @ 900 Kgs/day with the discharge of trade effluent @ 47 KLD into sewer after ETP and domestic effluent of 2 KLD into sewer along with request letter for extension in the validity of consent, Time for completion of ZLD project installation and request for permanent restoration of electric connection. The industry has filled an online application form, uploaded latest CA certificate, manufacturing process, Compliance of earlier granted consent, site plan. The industry has deposited fee of Rs. 4000/- vide R. No. 558767576 dated 22.01.2026 including Rs. 2200/- as NOC Regularization fee and Rs. 3600/- vide R. no. 357072666 dated 13.02.2026 under the Water Act, 1974 and Rs. 1800/- vide UTR No. 904219014 dated 22.01.2026 and Rs. 3600/- vide R. No. 323185900 dated 13.02.2026 under the Air Act, 1981 which is adequate up to 24.02.2027. The industry was visited by the Er. Jagpreet Singh, AEE of the Board on 25.02.2026 and it was observed that: - 1. The industry was not in operation during visit due to the lack of production. 2. The industry is engaged in the process of dyeing of Acrylic Yarn. 3. The industry has installed machinery i.e. 10 no. Cabinet Hank Dyeing of capacity 30 kg each, 1 no. Hydro in the premise. 4. The industry is under the process of upgrading the ETP to Zero liquid discharge technology (ZLD). However, the installed components are as follows: Storage tank > Settling tank > Flocculator > Dosing tank > Tube settler/Clarifier > MBBR >EA Reactor > Sludge tank >tube settler >Filtration tank > Filter (Sand and Carbon) > Into sewer. The representative also informed that the 60 % of the work has been completed till date. 5. The domestic water generates through the premises directly discharged into the public sewer. 6. The revised PERT chart submitted by the industry and stated that - a. In this phase, we will completely modify the existing ETP plant and it will be completed by 15.11.2025. b. In this phase, we will install UF (Ultra filtration) and RO (Reverse Osmosis) and it will be completed by 15.02.2026. c. In this phase, we will install Multi effect evaporator and it will be completed by 31.03.2026. However, the industry has modified the existing ETP plant by 15.11.2025 but has failed to install the UF, RO and Multi effect evaporator till date. The industry has failed to meet the timelines given in the revised PERT chart. 7. In the meantime, the industry has installed MBBR tank, EA Reactor, Tube settler and Filtration tank within the premises which will come into operation after the pipeline fabrication work. 8. In compliance to the decisions of the personal hearing before the worthy Chairperson on 16.10.2025, Wherein it was decided as under: a. The industry shall submit the revised PERT chart of activities to be carried out for successful completion, stabilization and commissioning of ZLD plant by 31.12.2025, positively within 07 days. REPLY: The revised PERT chart submitted by the industry and stated that 1. In this phase, we will completely modify the existing ETP plant and it will be completed by 15.11.2025. 2. In this phase, we will install UF (Ultra filtration) and RO (Reverse Osmosis) and it will be completed by 15.02.2026. 3. In this phase, we will install Multi effect evaporator and it will be completed by 31.03.2026. However, the industry has modified the existing ETP plant by 15.11.2025 but has failed to install the UF, RO and Multi effect evaporator till date. The industry has failed to meet the timelines given in the revised PERT chart. b. The industry shall submit a Bank Guarantee of Rs. 02 lakh within 07 days as an assurance for successful completion, stabilization and commissioning of ZLD plant by 31.12.2025. REPLY: The industry has submitted the Bank Guarantee of Rs. 02 lakh Vide BG No. 52060GI3D432025 dated 31.10.2025 valid up to 30.10.2026 as an assurance for successful completion, stabilization and commissioning of ZLD plant by 31.12.2025. c. The industry will submit the progress with respect to the up-gradation of ETP to ZLD technology after every 15 days alongwith the photographs and expenditure details viz-a- viz the timelines to be given in the revised PERT chart as above in decision no. 1, to the Regional Office-1, Ludhiana and Zonal Office-1, Ludhiana and through e-mail (ppcbro1@yahoo.com and ppcbzo1ldh@gmail.com). REPLY: The industry has failed to submit the progress with respect to the upgradation of ETP to ZLD technology along with the photographs. d. The industry till the installation of the ZLD shall continue to operate its existing conventional effluent treatment systems and ensure that the treated effluent shall conform to the standards prescribed for such disposals. REPLY: The industry has installed ETP of capacity 50 KLD which was not in operation. The trade effluent generates through the manufacturing process is treated through the ETP which further discharged into sewer and domestic water into sewer. e. In case, the industry failed to provide ZLD plant and stop the industrial effluent discharge into public sewer by 31.12.2025, in compliance to the State Govt. directions dated 10.10.2019, the Board reserves the right to take coercive actions against the industry as deemed fit and as proposed in the notice. REPLY: The industry has failed to provide the ZLD plant by 31.12.2025. f. Environmental Engineer, Regional Office-1, Ludhiana shall monitor the installation work of ZLD system regularly as per revised PERT chart to be submitted by the industry and submit monthly report to the higher authorities. REPLY: The industry was monitored by the regional office regarding the installation work of ZLD. However, it was observed that the industry has failed to meet the timelines given in the revised PERT chart. 9. The industry has installed Rice Husk based Boiler of capacity 4 TPH with Cyclone separator as APCD and provided with adequate stack height of chimney. 10. The industry has installed DG set of capacity 125 KVA with canopy and having adequate stack height. It is pertinent to mention here that an O.A. no. 284 of 2025 titled as “INDUSTRIAL AREA-A DYERS ASSOCIATION VS STATE OF PUNJAB AND ORS.” has been filed before the Hon’ble National Green Tribunal, New Delhi. The next date of hearing is fixed for 14.07.2026. Keeping in view of the above, it is recommended that the matter should be taken up by the competent authority as the uniform decision for such type of scattered dyeing units is under consideration with the competent authority.
