It is intimated that the project proponent has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Pellets (Non Torrified) @ 100 MTD by using Paddy Straw (for Non Torrified) @ 117.60 MT as raw material along with the requisite documents.
NOC Fees:
The project proponent has deposited Rs. 7200/- vide online R. no. 746587320 dated 25.03.2026 including application form fee, against the cost of the project of Rs. 675 lakhs (as per project report). The NOC fees deposited by the project proponent is adequate for 01 year.
Site of suitability details:
1. CLU Report
The industry has submitted certificate issued by the DTP Patiala vide no. 457-DTP(P)/C-34 dated 19.03.2026 (copy attached).
As per the report of DTP, the industry can establish its unit in khasra no. 92//23 provided meeting with siting guidelines of the Board with the condition mentioned in the above report.
2. Tehsildar Report
The industry has submitted a certificate issued by the Tehsildar, Samana vide letter dated 04.02.2026 (copy attached).
As per the report of the Tehsildar Samana, it is not clear that whether the village lal lakir/phirni/residential area falls in the 100 m radius of the proposed site. However, during the visit to the site by the undersigned & JEE of this office on 24.03.2026, no village lal lakir/phirni/residential area falls in the 100 m was observed during the visit.
Water Pollution:
As per the feasibility report submitted by the project proponent, the project’s total water requirement is 1.49 KLD, comprising 0.99 KLD for domestic use and 0.50 KLD for process activities such as dust suppression and air cooling. Wastewater generation is estimated at 1.09 KLD, including 0.792 KLD domestic and 0.30 KLD process effluent. All wastewater will be routed to a septic tank for treatment. The treated water will be reused for greenbelt development, ensuring efficient recycling.
Air Pollution:
As per the feasibility report, the project proposes to install Cyclone followed by Baghouse Filter as APCD to remove the coarse and fine particulates to be generated from drying & griding operations.
Visit:
Accordingly, the proposed site of the project was visited by undersigned alongwith JEE on 24.03.2026 and it was observed as under:
1. The site is located on Rajla Road, Tehsil Samana, Distt. Patiala.
2. No construction has been started at the proposed site.
3. During the site visit, it was observed that within a 100-meter radius, industries M/s Trishul Plywood and M/s Shri Hari Textile is located.
4. No Village Phirni/ MC limit / 15 pucca residential houses was found within the 100 m from the proposed site.
5. As per the above, the site is meeting with the general siting guidelines of the Board, thus, suitable for the establishment of the unit.
It is pertinent to mention here that there is another unit namely M/s SSS Green Energy, Village Badanpur, Cheeka Road, Tehsil Samana, District Patiala is operating in the Tehsil Samana, where, the above said plant has proposed to install its unit. M/s SSS Green Energy has given representation to this office dated 13.03.2026 (copy attached), wherein, it has objected for giving NOC/ consent to another plant being the possibility of scarcity of biomass resources in their area with the installation of the said plant. Also, the said unit has given the reference of the Notification No. 18/01/2021-PE1/2510 dated August 19, 2021, issued by the Punjab Department of New & Renewable Energy Sources regarding it is mandatory for all the developers setting up projects based on paddy straw/ agro residue to get the projects allocated through PEDA so that there is no chance of clash/ overlapping of command area within the Tehsil.
Also, M/s SPS Eco Friendly Fuels was granted permission/ allocation of command area of Tehsil Samana for collection of bio-mass residue of 46650 tons per annum required for 100 TPD capacity bio-mass pellet manufacturing unit.
Recommendations:
In view of the above, it is recommended that the NOC/Consent to establish from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry with the suitable conditions and following additional conditions:
1. This NOC is granted for manufacturing of Pellets (Non Torrified) @ 100 MTD by using Paddy Straw (for Non Torrified) @ 117.60 MT as raw material from pollution angle only.
2. The industry shall establish its unit in khasra no. 92//23 as per the details mentioned in the report of DTP issued vide no. 457 dated 09.03.2026.
3. The industry shall obtain command area allocation from the PEDA well before commencement of the construction of the project at the proposed site.
4. In case, the industry fails to obtain the command area from the concerned authority, the Board shall not be held liable for any financial loss whatsoever incurred by the industry in the establishment of the unit.
5. The industry will submit building plan prepared and duly authenticated by the Director of Factories/ Chartered Architect/ Chartered Engineer under the provisions of section 3-A of Punjab Factory Rules, 1952.
6. The industry is advised to obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
7. The industry shall bound to comply with the laws & bye-laws of the Master Plan to be prepared by the Department of Town and Country Planning, Punjab.
8. The applicant shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 along with other provisions of PRTPD Act, 1995, in case the site falls in non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department.
