It is submitted that the project proponent was given personal hearing before the worthy Member Secretary of the Board on 11.03.2026 w.r.t. Show cause notice for refusal of ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981. In the hearing, it was decided as under:
1. Environmental Engineer, Regional Office, SAS Nagar shall immediately encash Rs. 10.00 lakh out of the already submitted Bank Guarantee amounting to Rs. 20.00 lakh by the project proponent and shall retain the remaining Bank Guarantee amount of Rs. 10.00 lakh in safe custody. 2. The project proponent shall furnish an additional Bank Guarantee of Rs. 10.00 lakh within 7 days so as to maintain the total Bank Guarantee amount of Rs. 20.00 lakh as an assurance for compliance with all environmental norms and conditions stipulated in the Environmental Clearance and consents granted by the Board. 3. The application of the project proponent for renewal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 be refused. 4. The application of the project proponent for renewal of Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 be granted for a short term i.e. 6 months, subject to strict compliance of all environmental safeguards and conditions to be stipulated therein. 5. A joint inspection team comprising of Er. Anuradha Sharma, Senior Environmental Engineer; Er. Arshdeep Singh, Environmental Engineer; and Er. Arshdeep Kang, Assistant Environmental Engineer shall visit the project site within 10 days to verify the operational status of the sewage treatment plants, treated effluent disposal arrangements, solid waste management facilities and compliance of conditions stipulated in the Environment Clearance & Consents earlier obtained by the project; and shall submit a comprehensive report with clear & conclusive recommendations regarding the environmental compliance status of the project for further consideration in the matter.
In compliance to the hearing decisions, the RO has reported the point-wise reply that:
1. The project proponent has submitted DD amounting to Rs. 10 lacs and the same has been encashed vide R. No. 61/5603 dated 30.03.2026. 2. The project proponent has submitted DD amounting to Rs. 10 lacs and the same has been encashed vide R. No. 61/5603 dated 30.03.2026. As such, the BG amounting to Rs. 20 lakhs have been maintained. 3. The consent to operate applied under Water (Prevention & Control of Pollution) Act, 1974 has been refused vide no. CTOW/Renewal/SAS/2026/30692853 dated 27.03.2026. 4. Certificate shall be issued & signed after concurrence. 5. The team has been requested vide letter addressed to all members i.e. Er. Anuradha Sharma, Senior Environmental Engineer; Er. Arshdeep Singh, Environmental Engineer; and Er. Arshdeep Kang, Assistant Environmental Engineer to visit the project site.
It is brought out that the PP has submitted DD amounting to Rs. 10 lakh & the same have been encased by RO to maintain the BG amount of Rs. 20 lakh, instead of encashment of Rs. 10 lakh from its existing BG of Rs. 20 lakh & providing another BG amounting to Rs. 10 lakh as per hearing decision.
Submitted for approval for issuance of CTO certificate to the project promoter. |
