It is intimated that the subject cited industry has applied for obtaining consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of stone crusher unit of capacity 9500 CFT/Day.
The Sub Divisional Magistrate, Dinanagar, District-Gurdaspur vide letter no. 343 dated 25/02/2026, reported that the site of the industry is situated in Village Bianpur, Tehsil-Dinanagar, District-Gurdaspur in Khasra No. 38R//20 (8- 0) & Hadbast No. 683, Total Rakba 8 Kanal 0 Marlas. As per the SDM, Dinanagar report, the site is situated at more than 31 KM from MC Limit of Municipal Corporation, Pathankot. The site is situated more than 100 KM from A-Class City and more than 31 KM from B-Class Town. The site is situated more than 12 KM other towns and cities limits. The site is located more than 1 KM from village-Lal Lakir /Phirni/Approved Residential Area (15 Pucca House) and more than 1 KM meter Wild Life Sanctuary/Zoological Park. The site is situated more than 03 KM from Historical Place/Educational Institute/Protected Monument. The site is situated more than 6 KM from National Highway & 4 KM from State Highway/Scheduled Road & more than 2 KM meter from Link Road and more than 1 KM from District Road. The site of the stone crusher is more than 500 meter from the outer edge of the Gair Mumkin Nadi, Choe, etc or similar nomenclature identifying water body on the outer/flowing side of the choe. The site of the industry is located inside 30 KM from International Border.
The Executive Engineer, Drainage Department, Pathankot vide letter no. 745/Stone Crusher dated 30/03/2026 reported that the distance of the stone crusher from flood protection embankment on the outer side of River Beas is more than 50 meters (i.e. 115 mts). There is flood protection embankment on the outer side of River Beas.
The District Forest Officer (Wild Life), Pathankot vide letter no. 2459 dated 10/03/2026, reported that the site of the industry is situated 16.40 KM away from Keshopur Shamb Community Reserve, distance from Beas Conservation Reserve is 680 meter and distance from 22 KM away from Kathlour Kaushalya Wildlife Sanctuary as such the site is suitable.
The District Mining Officer Cum Executive Engineer, Drainage Division, Gurdaspur vide letter No. 746/Stone Crusher dated 30/03/2026 has informed that M/s Kaliveer Stone Crusher, Village- Bianpur, Tehsil-Dinanagar, District-Gurdaspur has endorsed copy of agreement made by the firm with M/s Gurbaaz Singh Sidhu Mining Contractor Pathankot.
The industry has submitted policy of Government of Punjab, Department of Industries & Commerce, Notification dated 17.11.2017 which states as under:-
“In pursuance of the approval of the Council of Ministers, Government of Punjab conveyed vide no. 1/152/2017-1Cabinet/4639 dated 16.10.2017, the Governor of Punjab is pleased to notify ‘Industrial and Business Development Policy’ 2017 as per Annexure – A i.e. 10.19.2 (i) No CLU will be required in this Extreme Border Zone to set up industry. (ii) 100 % exemption from EDC charges. (iii) 75 % exemptions of all the State duties, taxes and fees such as Rural Development Fee, Market Development Fee, State Excise Duty etc. to the first unit, which comes into operations in EBZ for each sector of manufacturing and service industry. If there are higher incentives available under any other section of the policy, then the same would also be available to these units.” As the SDM, Pathankot has reported that the site is located within 30 KM of International Border, hence no CLU is required.
As per the project report submitted by the industry, the industry has proposed to install One no. Hydro-cyclone of capacity, 01 no. Jaw Crusher, 02 no. Viabrators, 01 no. Sand Screw & 02 no. Rotapactor. The industry has proposed to install one no. D.G. set of capacity 320 KVA with canopy and adequate stack. The industry will generate trade effluent from washing @ 45.0 KLD and same will be 100% re-circulated after passing through settling tanks. The domestic effluent will be generated @ 0.5 KLD and same will be discharged into septic tank.
The industry was visited by the officer of the Board on 13/04/2026 and observed that the site of the stone crusher is located in the revenue estate of Village Bianpur, Tehsil-Dinanagar, District-Gurdaspur. No physical construction has been started at the site. The site of the stone crusher is currently being used for agriculture purpose. No residential house/Mandir/ Gurudwara was found within 500 meters radius of the site. The industry has demarked the area of the site with the pillars.
In view of above, It is recommended that consent to establish (NOC) from pollution angle may be granted to the industry for one year period and with following special conditions :-
1. The industry shall obtain necessary approvals/permissions from other concerned departments before the commissioning of project.
2. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter.
3. The stone crusher shall comply with the new Environmental Guidelines issued by the CPCB for the stone crushing unit, if industry fails to comply with Environmental Guidelines issued by CPCB vide letter no. CP-12/9/2022-IPC-V-HO-CPCB-HO dated 01/08/2023.
