It is submitted that the industry has applied for obtaining Consent to Establish (CTE) under Water Act, 1974 and under Air Act, 1981 for production of eggs @ 12000 nos/day by using Chicks @ 12000 Nos/day as its raw material. The industry has submitted the required documents including CRO report, Site suitability letter and site layout.
Site Suitability
As per the CRO report, the industrial site complies with the siting guidelines laid down by the PPCB for such type of industry. Besides, the industry has obtained a Site Suitability Report from DTP, Patiala dated 24.02.2026. As per the report, the site falls under the jurisdiction of Samana, District Patiala. Further, the Master Plan for the said area has not been prepared yet. Accordingly, vide letter no. 2180–2283 STP(PB)/SD-432 (Gen) dated 14.06.2023, it has been stipulated as under:
"The applicant shall be liable to abide by the provisions of the Master Plan and shall also be bound to follow the provisions of Section 79 along with other relevant provisions of the PRTPD Act, 1995, in case the site falls in a non-conforming land use zone after the notification of the Master Plan, and no claim shall be demanded by the applicant from the Department."
Therefore, the site is considered suitable for establishment of the poultry farm under Green Category.
PWRDA Applicability
The industrial unit consumes fresh water only for domestic purpose @ 2.0 KLD and thus, industry does not require PWRDA authorization.
Fee Details
The industry falls under green category and has deposited the required fee of Rs. 1900/- vide Txn no: 593715220 dated 30.03.2026 under both the acts. The fee deposited is adequate for 1 years, i.e., up to 31.03.2027.
Accordingly, the industry was visited by Undersigned on 09.04.2026 to verify the contents of the application and it was observed as under:
1. The land is an agriculture land.
2. It was observed that no construction activity has been carried out at the site.
3. The industry land is located more than 500 meters away from the residential zone and more than 200 meters away from the village link road.
4. The land is found suitable for establishment of the industry.
In view of the above, it is recommended that, if may approved, the consent to establish under Water Act, 1974 and Air Act, 1981 be granted up to 31.03.2027 to the industry subject to following conditions:
1. The industry shall obtain Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 before starting operation of the poultry farm.
2. The applicant shall be liable to abide by the provisions of the Master Plan and shall also be bound to follow the provisions of Section 79 along with other relevant provisions of the PRTPD Act, 1995, in case the site falls in a non-conforming land use zone after the notification of the Master Plan, and no claim shall be demanded by the applicant from the Department.
3. The industry shall ensure that poultry litter, manure and solid waste generated from the poultry farm shall be collected regularly and stored on an impervious platform under covered shed to prevent leachate generation and odor nuisance.
4. The industry shall ensure that poultry litter/manure shall be disposed of or utilized in an environmentally sound manner such as composting or supply to authorized users/farmers and shall not be dumped indiscriminately.
5. The industry shall ensure proper management of dead birds. The dead birds shall be disposed of through deep burial pit/incineration as per prescribed guidelines, so as to prevent nuisance and health hazards.
6. The industry shall ensure that adequate measures are taken to control odor nuisance arising from poultry operations and proper housekeeping shall be maintained within the premises.
7. The industry shall ensure that storm water does not come into contact with poultry litter, manure or other waste and proper drainage system shall be provided within the premises.
8. The industry shall plant and maintain adequate green belt within the premises along the boundary to control odor, dust and improve environmental conditions.
9. The industry shall ensure that no burning of poultry litter, feathers or any other solid waste is carried out within the premises.
10. The industry shall ensure that the noise level from operation of equipment, if any, shall remain within the prescribed limits of the Board.
11. The industry shall comply with all the provisions of the Solid Waste Management Rules, 2016 and other applicable environmental rules and regulations.
