File Note: It is submitted that M/s Ambe Valley, Near Naloyian Chowk, Chintpurni Bye Pass Road, Hoshiarpur has earlier obtained renewal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide CTOW/Renewal/HSP/2018/8734416 dated 22.11.2018, valid upto 30.09.2020, for a residential colony............. It is pertinent to mention here that the residential colony was given personal hearing before the Chief Environmental Engineer, Jalandhar on 29.01.2026 in the matter of notice issued under Section 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and Section 31-A of the Air (Prevention & Control of Pollution) Act, 1981. During the proceedings, it was brought on record that the project proponent had not applied for fresh/renewal of consents under the Water Act, 1974 after expiry of the earlier consent. It was further observed that the STP installed in the residential colony was not in operation and its condition indicated that it had not been used for a long time. Accordingly, after considering the facts on record, the Chief Environmental Engineer, Jalandhar ex-parte decided as under:............. 1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the Punjab State Power Corporation Limited (PSPCL) not to release any new electric connection for any flat/plot/house/shop or other components of this project with immediate effect. 2. The Revenue Authorities are directed not to register any fresh sale deed related to any plot/flat/house/shop/any other component of this project with immediate effect and revenue authorities shall provide provision/patch in the jamabandi portal to restrict the registration of land, plots, shops etc. of the said project. 3. The Regional Office, Hoshiarpur shall keep strict vigil of the operation of residential colony........ In compliance with the above directions, directions to the Revenue Authorities and PSPCL were subsequently issued............... Further, the project proponent submitted a letter to this office acknowledging the shortcomings/violations pointed out by the Board, inter alia, non-renewal/non-obtaining of Consent to Operate under the Water Act, 1974, earlier non-operation of STP, and deficiencies regarding wastewater disposal and solid waste management. In the said letter, the project proponent submitted that the STP has now been made operational, the wastewater generated from the colony is being treated therein and the treated wastewater is being utilized/disposed of for plantation/horticulture purposes within the premises. The project proponent also undertook to operate the STP regularly and efficiently, maintain proper records, ensure compliance with applicable environmental laws, and requested that the present CTO application may be considered................. The project does not attract the provisions of the EIA Notification, 2006, as the built-up area of the project is 107,170 sq. m. and the total project area is 188,178.8 sq. m. (i.e. 18.817 hectares)............. Further, the project proponent has deposited a fee of Rs. 2,16,000/- vide transaction No. HDFCR52026030677994894 and Rs. 1,30,000/- vide transaction No. HDFCH00847037735, both dated 06.03.2026, under the Water (Prevention & Control of Pollution) Act, 1974, which is adequate for 05 years.......... In reference to the present application, the residential colony was visited by the undersigned along with Er. Rackinder Veer Singh, JEE on 01/03/2026, and the following was observed:........... 1. It is a residential colony with most of the plots sold and constructed. 2. The STP installed in the colony was found operational at the time of visit. 3. The wastewater generated from the colony was found being treated through the installed STP, having components screen chamber, oil & grease chamber, collection tank, aeration tank, SAFF reactor, secondary sedimentation tank, sludge recycle pump, filter feed pump, PSF and ACF, and all the components were found in operation. 4. No bypass of untreated wastewater was observed during the visit. 5. The treated wastewater was being disposed of/utilized in the plantation area within the premises through flexible as well as permanent pipe network. 6. The colony has made arrangements for disposal/utilization of treated wastewater within its premises. 7. Solid waste management arrangements in the colony were found improved as compared to earlier observations. 8. Municipal solid waste is being collected from the colony by Municipal Corporation, Hoshiarpur, collection slips of the same were produced during the visit. Further, samples of treated wastewater were collected from the outlet of STP and sent to the Zonal Laboratory, Jalandhar for analysis. The analysis report has been received and the results are as: pH: 7.3, TSS: 22 mg/l, TDS: 364 mg/l, COD: 52 mg/l, BOD: 14 mg/l and O & G: BDL.......... The analysis results reveal that the treated wastewater sample conforms to the prescribed standards of the Board. Further, it was observed during the visit that approximately 10 acres of plantation area and green space has been developed within the premises of the residential colony, which is adequate for disposal/utilization of the treated effluent generated from the project........... In view of the above, if approved, it is recommended that Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 may be issued to the residential colony for a period of six months with the usual general and special conditions. It is further recommended that the directions already issued under Section 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be deferred for a short period of six months.:............. Special Conditions: 1. The project proponent shall operate the installed STP regularly and efficiently so as to ensure that the treated effluent always conforms to the standards prescribed by the Board. 2. The project proponent shall ensure that no untreated sewage/domestic effluent is discharged outside the premises and that the entire wastewater generated from the colony is treated through the installed STP. 3. The treated wastewater shall be utilized/ disposed of only for plantation/horticulture purposes within the premises through the existing pipe network and no untreated or treated wastewater shall be discharged into any drain, water course or adjoining area. 4. The project proponent shall maintain proper record regarding operation and maintenance of STP, including flow records, electricity consumption, maintenance logbook and disposal/utilization of treated wastewater. 5. The project proponent shall maintain proper solid waste management arrangements within the colony and shall ensure segregation, collection and disposal of municipal solid waste in accordance with the Solid Waste Management Rules, 2016. 6. The project proponent shall comply with the directions issued by the Board from time to time and shall not violate any provision of the Water Act, 1974, Air Act, 1981, and rules framed thereunder. 7. The project proponent shall submit the compliance regarding operation of STP and disposal/utilization of treated wastewater as and when called for by the Board. 8. The project proponent shall ensure that no objectionable smell, stagnation or environmental nuisance is caused in and around the residential colony on account of handling, treatment or disposal of sewage and solid waste. 9. The project proponent shall obtain renewal of consent well in time and shall not operate the project without valid consent of the Board...........
