File Note: The Project Proponent (PP) has applied for Consent to Establish (CTE/NOC) for development of a residential colony namely “Ajmer Avenue” over a total area of 61 Kanal 0 Marla 4.5 Sarsai, comprising 83 residential plots and EWS area, located at Sri Muktsar Sahib-2. 2. Initial Observations / Issues During scrutiny, following objections were raised: 1. Land Area Mismatch o Proposed land: 61 Kanal 0 Marla 4.5 Sarsai o Documents submitted: 15 Kanal (sale deed) + 36 Kanal 13.5 Marla (consent letter) o Total available land: 51 Kanal 13.5 Marla o Deficit in land documentation vis-à-vis proposed project area 2. MC Letter Regarding Sewer/STP o Municipal Council letter indicated inability of existing STP earlier and proposed discharge linkage to MC system. o Clarification required on adequacy and feasibility of sewer disposal. 3. Site Inspection Findings • Located on Abohar Road, Sri Muktsar Sahib. • No MAH industry within 250 m and no major air-polluting industry within 100 m. • A rice sheller (Arora Rice Mill) exists within 500 m. • Initial observation: absence of confirmed 15 m green belt buffer towards industrial side. • Concern raised regarding compliance of siting guidelines. • Issue also flagged regarding non-submission/uncertainty of CLU initially. 4. PP’s Reply PP submitted: • Project lies in notified residential master plan zone. • Arora Rice Mill stated to be converted into Sortex (Green category unit). • Claimed no requirement of 15 m buffer as per siting policy since industry is beyond 100 m / green category. • Submitted: o LOI / License from Competent Authority o Approved layout plan o MC permission for sewer discharge o Proposal of STP (140 KLD) with reuse system 5. Zonal Office Examination • Verified that land falls under residential master plan zone. • Clarified: o Green belt requirement not applicable since no air-polluting industry within 100 m. o STP and reuse system proposed as per policy. o MC sewer permission available for surplus discharge. 6. Remand & Further Clarification Earlier ZO directed RO to further clarify: • Status of nearby rice sheller • Applicability of buffer norms • Functional status of municipal STP system • Compliance of siting guidelines RO submitted detailed justification stating: • Unit falls under green category / non-hazardous use • Master plan zoning already accounts for land use compatibility • No MAH or significant pollution source nearby • Municipal sewer network available with PP’s STP arrangement 7. Final Recommendation based on RO report and PP submission After examination of reply and documents: • Site is within approved residential master plan zone • Adequate statutory permissions (LOI, layout approval, MC sewer NOC) obtained • No MAH industry within prohibited distance • Buffer requirement not applicable as per siting clarification • STP and waste management proposal compliant 8. Conclusion In view of the above facts, the NOC (Consent to Establish) may be granted to the Project Proponent (PP) for a period of one year for development of a residential colony comprising 83 residential plots and EWS area, subject to the following conditions: Conditions 1. Validity of Submitted Information If any document submitted by the project proponent is found to be forged, incorrect, or misleading at any stage, the Consent to Establish shall be liable to be cancelled forthwith. The Board shall not be responsible for any expenditure incurred by the project proponent. 2. Adherence to Approved Layout The project proponent shall strictly adhere to the approved layout plan and shall not alter the land use, number of plots/units, built-up area, or project configuration without prior approval of the Board. The provisions of the applicable Master Plan shall be complied with. 3. Sewage Treatment Plant (STP) The project proponent shall install and commission a Sewage Treatment Plant (STP) of adequate capacity (140 KLD or as required) prior to occupation/operation of any part of the project. The STP shall be operated and maintained efficiently to meet prescribed discharge standards at all times. 4. Sewerage Network The internal sewerage network shall be fully laid, tested, and made functional, and connected to the STP prior to occupation or operation of any unit. 5. Reuse of Treated Wastewater The project proponent shall ensure maximum reuse of treated wastewater within the premises through a dual plumbing system for flushing and green area development. Freshwater shall not be used for horticulture purposes. Out of the total treated wastewater: • 40 KLD shall be reused within the premises: o 30 KLD for flushing through dual plumbing o 10 KLD for green area/plantation • The remaining 94.46 KLD shall be discharged into the Municipal Committee sewer as per permission issued by Municipal Council, Sri Muktsar Sahib vide Memo No. 3304 dated 29.10.2025, subject to availability of adequate sewer capacity. 6. Groundwater Extraction The project proponent shall not extract groundwater without prior permission/NOC from the Punjab Water Regulation and Development Authority (PWRDA) or any other competent authority. 7. Water and Wastewater Monitoring Electromagnetic flow meters shall be installed at: • Fresh water inlet • STP inlet • STP outlet • Treated water reuse lines Monthly records shall be maintained and submitted to the Board as and when required. 8. Environmental Clearance (EC) The project proponent shall obtain clarification regarding applicability of Environmental Clearance (EC) from SEIAA/MoEF&CC, particularly for projects having built-up area between 20,000 sqm and 1,50,000 sqm. No construction shall be undertaken without obtaining EC, wherever applicable. Any violation shall be at the risk and cost of the project proponent. If the built-up area exceeds thresholds under the EIA Notification dated 14.09.2006 (as amended), prior EC shall be mandatory. 9. Consent to Operate (CTO) The project proponent shall obtain Consent to Operate under the Water Act, 1974 and Air Act, 1981 prior to occupation or operation of the project. 10. Monitoring Facilities Adequate sampling arrangements shall be provided at the STP outlet. Online monitoring systems shall be installed and connected to the Board server as per applicable directions. 11. Solid Waste Management Municipal solid waste shall be managed in accordance with the Solid Waste Management Rules, 2016 and provisions applicable to Bulk Waste Generators. The project proponent shall: • Install in-house composting/vermi-composting facilities • Ensure no waste is dumped, burnt, or disposed of in open areas, drains, or water bodies 12. Green Belt Development Adequate green belt/plantation shall be developed and maintained using treated wastewater, along with proper landscaping within the premises. 13. Construction Phase Measures During construction, the project proponent shall implement: • Dust suppression measures • Covering of construction material • Proper management of C&D waste • Adequate sanitation facilities for labourers 14. Corporate Environmental Responsibility (CER) The project proponent shall undertake CER activities, including environmental awareness programs and promotion of sustainable practices in and around the project area. 15. Ban on Single-Use Plastics Use of single-use plastic and thermocol items shall be strictly prohibited within the premises as per applicable regulations. 16. Rainwater Harvesting Adequate rainwater harvesting structures and storm water drainage system shall be provided to ensure groundwater recharge and prevent mixing of storm water with sewage. 17. Statutory Compliance This NOC is issued from a pollution control angle only. The project proponent shall obtain all other statutory approvals from concerned authorities. 18. Documentation and Technical Compliance Any discrepancy found in the submitted data/documents may lead to revocation of the NOC without further notice. CC SEE
