The Regional Office has submitted detailed report w.r.t. the application filed by the project promoter.
In consideration of the report/ recommendations of RO in the matter; if approved, the ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution)Act, 1974 and the Air (Prevention & Control of Pollution)Act,1981,may be granted to the project proponent for one year subject to general & additional conditions as proposed by RO in its note and some of the following additional conditions:
1. The present Consent to Establish (CTE) is strictly limited to the commercial component only (4.209 Acres out of total site of 17.371 Acres) as applied for, and shall not be construed as approval for any part of the group housing/residential component of the total project site (17.371 Acres).
2. The project proponent shall not undertake any site development, construction activity, infrastructure creation, or allotment in respect of Group Housing-I and Group Housing-II areas, in any manner whatsoever, without obtaining prior Environmental Clearance (if applicable) and subsequent CTE from the Board.
3. The project proponent shall physically demarcate the commercial area and group housing areas at site, with clear boundary markers/signages, to prevent any overlap or unauthorized development.
4. The project proponent shall ensure that common infrastructure (including roads, drainage, STP, water supply, etc.) under this CTE is designed and operated exclusively for the commercial component, and shall not be extended or utilized for group housing areas unless requisite approvals are obtained.
5. The project proponent shall not club or integrate utilities/services (such as STP, solid waste management facilities, water supply systems, etc.) for group housing areas at this stage.
6. The project proponent shall ensure that no third-party developer/builder is engaged for group housing development unless prior approvals (including EC & CTE) are obtained.
7. The project proponent shall ensure strict compliance with EIA Notification, 2006, and shall obtain prior EC for the entire project (if applicable cumulatively) before expansion or integration of project components.
8. The Board reserves the right to review/reassess this CTE if cumulative development (commercial + group housing) attracts provisions of Category 8(a)/8(b) under EIA Notification, 2006 at any stage.
9. n case it is established at any stage that the project proponent was required to obtain prior Environmental Clearance for the entire project (including the commercial component) under the provisions of the EIA Notification, 2006, the present Consent to Establish shall be liable to be revoked/withdrawn immediately, without any further notice, and the Board shall not be responsible or liable for any financial loss or any other consequences arising out of such revocation.
