Naseeb Kumar, Manager At the outset, Senior Environmental Engineer, (ZP-1) brought out that: - The industry was granted 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2025/28238965 dated 05/05/2025 valid upto 31/03/2026 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2025/28228024 dated 05/05/2025 valid upto 31/03/2026 for production of Lift Housing @ 175.0 Numbers/Day, Gear Box Housing @ 22.0 Numbers/Day, F.A.B @ 5.0 Numbers/Day, Top Cover @ 20.0 Numbers/Day, Shopping Trolleys (Zinc Plated) @ 400.0 Numbers/Day, and Other Iron & Steel Fabricated Articles @ 1000.0 Kgs/day. A telephonically complaint was received regarding black smoke and chemicals coming from M/s Shine Metal Tech Pvt. Ltd. and same affecting the body of new cars parked in the premises of their company and also the cars coming for service and repairs and as such, the outer body of cars get deteriorated which cannot be cured and the customers do not purchase the same. As such, the above-mentioned black smoke and chemicals of the above- mentioned manufacturing unit of Tractors and its Motor Parts has been badly affecting the business of their company, also the bodies of their cars. Now, the industry has applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 on 30.01.2026, along with requisite documents. To verify the facts of the complaints, the unit was visited by the officers of the Board on 27.01.2026 and contacted complainant - Mr. Anuj Chabra and contacted Sh. Safal Gill, Director of the M/s Shine Metal. During visit, it is observed as under: 1. The unit was in operation and is engaged in business of machining (milling, drilling and tapping) of Top Cover, Lift Housing, Gear Box Housing, F.A.B and surface treatment of Shopping Trolleys and other iron and steel fabricated article of auto parts. 2. The industry is engaged in metal surface treatment process involving HCL, Pickling, Zinc plating and metal finishing process. The industry has provided all processes in single shed. 3. The industry has provided water meter near zinc plating section pipeline, reading was noted as 1866 KL. Record of the same has been maintained by the industry. 4. The industry has installed total 19 no. rectangular tanks for surface treatment & zinc plating at site. 5. The industry has provided storage tanks (03 no.) for collecting trade effluent. The industry has made an agreement with M/s Bantech Water Private Limited, Kurali & the effluent has been got lifted by the same energy. Last lifting was done on 18.01.2026 @ 10 KL effluent record has been maintained. 6. The housekeeping near electroplating section was very poor. 7. The industry was advised to remove extra dead pipeline as well as ETP material near ETP installed over. 8. The industry has installed alkali scrubber as APCD which needs to be rectified, as lot of emission has been sensed in the process area. 9. Record of Hazardous waste generation has been maintained. 10. Sample from the backside stagnate water disposed by the industry has been taken & sent to Head Office Lab, Patiala for analysis. 11. During visit, it was observed that rain water pipe provided by the industry at the backside was discharging rain water from its premises to the outside of the industry. However, from the physical condition of the pipe, it could be adjudged that the industry is by passing its electroplating wastewater in odd hours, as acid deposition/ traces were observed at the outlet point of the pipe 12. As per the complaint received, acid marks were found on the cars parked in adjoining Bhakra Service Station, Tehsil and District Rupnagar. It is pertinent to mention here that as per the record maintained by the industry, the industry has got lifted 40 KL effluent from electroplating section since, October 2025 to January, 2026. Further, the pickling section of the industry was in operation during visit, but industry has not lifted any effluent from pickling section since October, 2025. Further, the industry has utilized only 30 KL water since 18.09.2025 to 27.01.2026 and 40 KL was got lifted from the premises of the industry. As such, it is evident that the industry may have other water pipeline also from where it may use water for its process. The industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) 1981, intentionally and deliberately. It has now been proposed to refuse the renewal of consents to operate applied by the industry under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause/ personal hearing. As such, show cause for refusal of grant of renewal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 issued to the hospital vide Board's letter no. 8846-47 dated 27.03.2026 alongwith an opportunity to appear in person before the Chairperson of the Board in his office at Punjab Pollution Control Board, Vatavaran Bhawan, Nabha Road, Patiala on 10.04.2026 at 11:00 AM. During, hearing, the representative of the industry submitted a written reply, which was taken on record. He informed that the industry has the APCD has now been rectified at the site and the leakages earlier observed during the visit have also been stopped. He also submitted that the industry has now improved the house-keeping of the unit. However, he could not give any satisfactory reply regarding the non-compliance effluent standards from the sample collected by the visiting from the stagnated water on the backside of the unit. After hearing the representative of the industry and officers of the Board and considering the material aspects of the case, the Chairperson of the Board decided as under: - 1. Environmental Compensation be imposed on the industry, for violating the provisions of the environmental laws. Environmental Engineer, Regional Office, Rupnagar shall calculate the EC, process the file and get the EC order issued after verification from the EC committee, within 10 days. 2. The industry shall get the water audit of the unit carried out by any institute of repute (IoR), within one month and shall submit a copy of the report to PPCB within 7 days thereafter. 3. The industry shall get the ground water monitoring carried out from PBTI Mohali, within one month and shall submit a copy of the report to PPCB within 7 days thereafter. 4. The industry shall make a protocol to get the ground water monitoring carried out twice a year from Board’s Lab or PBTI Mohali.
