Sir, the representative of the industry was contacted telephonically and he informed that the industry operates 24 hours, so 625 m3/Hour * 24= 15000 Nm3/Hour, thereby the details mentioned in the application form for material and production capacity. It is pertinent to mention here that the representative of the industry merely wanted the figure 15000Nm3/Hour as reflected in the recent SAC approval granted to the industry to reflect in the CTO granted by PPCB and also that the confusion was due to no knowledge of working hours of the industry which is sought now.
Subject: Application for obtaining varied ‘CONSENT TO OPERATE' under the provision of the Water (Prevention & Control of Pollution) Act, 1974 by M/s- Goyal Mg Gases Pvt Ltd Opp. Pacl Naya Nangal, Nangal, Anandpur Sahib, Rupnagar.
It is submitted that industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/RPN/2021/16779374 dated 25/10/2021 and under the Air Act, 1981 vide no. CTOA/Renewal/RPN/2021/16779342 dated 25/10/2021, having validity upto 30/06/2026, for Filling of Hydrogen Gas @ 15000 Nm3/day , subject to certain conditions as mentioned therein.
The industry was visited by the officers of the Board on 11.05.2023 and was found not complying with the conditions of consent obtained by it under the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and failed to obtain authorization under the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. Accordingly, the consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were revoked/cancelled vide Board's letter No. 4742 dated 10.07.2023 and 4744 dated 10.07.2023
Recently, the industry was given personal hearing before the Chairperson of the Board on 24.09.2025. After hearing the representatives of the industry and officers of the Board and considering the material aspects of the case, the Chairperson of the Board decided as under:
1. The industry shall submit a bank guarantee amounting to Rs. 2.00 lacs as an assurance to comply with the environmental laws at all times.
2. Environmental Engineer, Regional Office, Rupnagar shall carry out regular visit to the industry as per the frequency of visit laid down by the Board for such units and check the compliance of environmental norms. He shall also process the consent applications applied by the industry on merits.
In compliance to the decision of hearing, the industry has deposited bank guarantee amounting to Rs. 2.00 lacs vide no. 0198IGF251116366 dated 29.10.25 valid upto 30.10.2026.
It is pertinent to mention here that the industry has been granted approval of site by Site Appraisal Committee (SAC) vide no. SAC/26/1/1286412/2026 dated 08.01.2026.
Now, the industry has applied for obtaining varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents.
The industry has submitted the CA certificates without depreciation wherein the value of the industry is of Rs. 2.02 Cr as on 25.06.2025. The industry has deposited NEFT_IN :36KKBKH25198943362KKBK0000958 / / KKBKN62025071762860215 / GOYAL MG GASES PVT Rs. 54000/- dated 17/07/2025 and NEFT_IN: 36KKBKH25198943416KKBK0000958 // KKBKN62025071762859639/ GOYAL MG GASES PVT Rs. 54000/- dated 17/07/2025 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 18000 vide receipt no. 123858432 dated 02.04.2026 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 18000 vide receipt no.949812247 dated 02.04.2026 under the Air (Prevention & Control of Pollution) Act, 1981 which is adequate upto 31.03.2031.
The industry has submitted Air Samples result of Lab (Evapo tech- NABL Accredited Environment Testing Laboratory, Power of attorney, Renewal of Fire NOC, Safety audit report, License to store compressed gases from Petroleum and safety Organisation, approved site plan, flow chart.
The site was recently visited by Himani Goyal, AEE of this office on 19.03.2026 and Sh. V P Gupta, (Representative) was contacted during visit, it was observed as under:
1. The unit was in operation.
2. The industry has installed 05 no. of compressors. Representative of the industry informed that they would be applying for varied consents and are in the process of arranging documents for the same.
3. The industry is engaged in the process of bottling of compressed hydrogen gas.
Raw material-> compressor -> compressed H2 Gas -> bottling -> Dispatched
4. The industry has installed 01 submersible and has provided water meter over the same and is maintaining proper record of the same.
5. The domestic effluent is being discharged onto land for plantation after passing through septic tank. The unit in totality has approximately 30.75 sq.m. of green area.
6. The industry has installed 02 no. of DG sets of capacity 125 KVA each which are placed in acoustically treated room and stacks of adequate height have been provided with them.
7. The industry deals with hazardous waste of category 5.1. It is being stored in a designated area with proper lock facility and sign board.
8. No source of air pollution/water pollution observed as such on the site.
9. The industry was advised to maintain the record of the hazardous waste generated and its lifting.
10. The representative of the industry requested telephonically that the production capacity be taken as @ 15000 Nm3/day instead of @ 625 m3/h as they were unable to change it in the application form.
From the above mentioned facts, it is clear that the industry is complying with provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of above, if approved, it is recommended that the varied consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2031, subject to suitable conditions and additional condition as under:
1. The industry will maintain the record of water consumption and energy meter on the daily basis and shall submit the same to the Board quarterly.
2. The industry will not operate its plant more than the consented capacity of packaging of Hydrogen gas @ 15000 Nm3/day.
3. The industry shall utilize treated effluent from the septic tank for plantation purpose only.
4. The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.
5. The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use • decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. 6. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
7. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received.
8. The Consent is being issued to the industry based upon the documents/ information/undertakings submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
9. The sole responsibility for any wrong information/ declaration and/or any litigation/loss arising due to grant of this Consent to Establish shall be of the industry/ project proponent and its all the responsible/ concerned person(s).
10. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Operate.
