Gunataspal Singh, Near Aggarwal Colony at Village Malkana, Tehsil Samana, District Patiala. Reference: Application ID 31701657 dated 10.04.2026. It is submitted that the project proponent has proposed to develop a plotted Residential project namely The Royal Park at Village Malkana, Tehsil Samana, District Patiala. Accordingly, the PP has applied obtaining Consent to Establish/ NOC under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of Residential Plots @ 134 Nos under Orange category alongwith requisite documents and NOC fee. NOC Fee: As per the project report, the total cost of proposed project will be Rs. 2001.00 lakhs. Accordingly, the project proponent has deposited NOC fee amounting to Rs. 86,900/- vide online R. No. 612458524 dated 29.01.2026. As such, the fee deposited by the PP is adequate for 05 years under Orange category as per the Board's office order dated 29.10.2018. Land Documents: The PP has submitted the sale deeds of land executed between Sh. Ramnik Bir Kaur, Sh. Shaminder pal Singh, Smt. Anita Rani, Sh. Rajkumar and M/s A M buildtech total land area of 120 Kanal 0.5 Marle situated at Village Malkana Samana, Patiala Approved Layout Plan: The PP has submitted the layout plan approved vide no. PB/LOUT/PTA/SAMAN/1079 dated 16.05.2025 by the Competent Authority-cum-Additional Deputy Commissioner (Urban Development), Patiala, vide which, the total saleable area of the project will be 34,589.26 m2 (including EWS Area). License to Develop a Colony: The PP has obtained license vide no. ADC(UD)/PTL/2025/1426 dated 16.05.2025 to develop a residential colony in the name & style of "The Royal Park" comprising of the area 15 Acres as per Layout plan received on E- Naksha Portal vide file No. PB/LOUT/PTA/SAMAN/1079. Applicability of EIA notification 14/09/2006: As per the approved layout plan, the total saleable area of the project will be 34,589.26 m2 (including EWS Area). However, the project is a plotted residential project and only plots will be sold by the promoters and any construction, if undertaken, shall be carried out by the respective plot owners only. Hence, the project does not come under the purview of EIA notification dated 14.09.2006, as, the total built up area of the project will be less than 1,50,000 m2. Feasibility Report: As per the feasibility report submitted by the PP, it has proposed to install STP of capacity 250 KLD based on MBBR technology. The total water demand for the project is as under:- Residential Plots - 134 Total Residential Population – 2320 persons Total Water Consumption - 2320 x 135 liter = 315 KLD Total waste water generation (80% of total water consumption) = 250 KLD The treated domestic wastewater @ 105 KLD from STP will be reused in the flushing purpose. The remaining 145 KLD water will be reused for plantation area and rest will be discharged into m.c. sewer. It is pertinent to mention here that the project proponent has obtained permission from Municipal corporation for discharge of treated water generated from the project site vide letter no: 71 dated 08.01.2026. Solid Waste: The solid waste generation from the project will be 1000 Kg/day. The solid waste generated from the premises will be segregated. The PP has proposed to install mechanical organic waste converter for the treatment of wet waste and the remaining dry waste will be collected, transported and disposed off by the MC. It is pertinent to mention here that the project proponent has obtained permission from Municipal corporation for lifting of solid waste from the project site vide letter no: 70 dated 08.01.2026. Visit: To verify the contents of the application, the site was visited by JEE, Regional office on 17.04.2026. During visit, it was observed as under: 1. The proposed site situated at Village Malkana, Tehsil Samana, District Patiala. 2. The Project Proponent has constructed the boundary wall. 3. The Project Proponent has carried out the foundation work for the demarcation of plots and for providing 01 no. public toilet only; however, no other construction activity is being carried out by the project proponent as well as by the individual plot owners. 4. As per the boundary limits shown by the representative, it was observed that there is no rice sheller/saila plant/brick kiln/stone crusher/ screening cum washing unit/ hot mix plant/cement grinding unit within a radius of 500 mt. 5. There is no MAH industry within in a radius of 250 mt from the boundary of proposed site. 6. There is no jaggery unit, petroleum outlet within 200 mt. of the proposed site. 7. There two 2 residential colonies developed alongside the project site namely ‘Aggarwal Colony’ and ‘Green View’. Recommendations: In view of the facts mentioned above, if approved, it is recommended that the Consent to Establish/NOC Expansion under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of Residential Colony (Plotted) @ 134 Nos. may be granted to the project proponent for 05 years under Orange category with suitable conditions and following special conditions: 1. The promoter shall not carry out any construction activity of plots and the construction will be carried out by the plot owners only. 2. The promoter company shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failure which, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006. 3. The project proponent shall develop its project strictly in accordance with the layout/ building plan approved by the competent authority and shall also comply with the conditions imposed in the approval of layout plan letter. In case, there is variation in built-up area/green area/ any other details in layout plan approved by the Competent Authority (if at any stage), then the project proponent shall obtain fresh Consent to Establish from the Board. 4. If it is proven at any stage that the project is cover under the ambit of EIA notification 2006, then this CTE granted from the pollution angle shall be deemed cancelled and Board shall not be responsible for any financial liability arising due to cancellation of this CTE. Further, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006. 5. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 6. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form. 7. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 8. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 9. The PP shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. 10. The PP shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. 11. This NOC is being granted on the basis of the documents/ submissions made by the project proponent and in any case, such documents/ submissions found to be false or incorrect, this NOC shall be cancelled without any prior notice and the project proponent shall be liable for any loss due to such cancellation.
